No.1 for fire consolidation transfer of equipt, assets, and employees RESOLUTION NO. 06-028 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON, DIRECTING THE CITY MANAGER, IN CONSULTATION WITH THE FIRE CHIEF, TO EXECUTE AN INTERLOCAL AGREEMENT WITH JEFFERSON COUNTY FIRE PROTECTION DISTRICT NO.1 FOR FIRE CONSOLIDATION, TRANSFER OF EQUIPMENT AND ASSETS AND TRANSFER OF EMPLOYEES; TO EXECUTE A LEASE AGREEMENT FOR FIRE HALL, AND TO EXECUTE A USE AGREEMENT FOR PINK HOUSE RECITALS: A. By RESOLUTION 04-065 (approved December 13,2004,7-0), Council authorized the City Manager to execute an Interlocal Agreement with Fire District 6 for joint organizational structure under command of City Fire Chief on terms recommended by the General Govt. Committee. The City - District 6 Interlocal Agreement became effective January 1,2005. B. By Council action (approved May 16,2006,6-0, Robinson excused), Council authorized the City Manager to execute an amended Interlocal Agreement to include Fire District I. The Agreement is signed June 3, 2005. C. By RESOLUTION 05-031 (approved August 15, 2005, 6-0, Fenn excused), Council approved moving forward with interlocal agreements for establishing an operational consolidation of Fire Districts No. I and No.6 and the City of Port Townsend Fire Department, with the establishment of a joint operating fund and joint budget oversight board. D. By Council action (approved December 12,2005,7-0), Council approved amendments to the Interlocal establishing a joint fund for operational costs, authorizing the joint board to bring a combined budget to the Council for approval, and set a defined fund transfer. Agreement is effective January 1, 2006. E. By RESOLUTION 06-011 (approved May 1,2006,6-0, Benskin excused), the Council confirmed its intention to further joint fire service operations with Jefferson County Fire Protection District No.1, and directed the City Manager, in consultation with the Fire Chief, to negotiate mutually agreeable agreements for Council review and approval, as follows: I. Agreement for assignment and transfer of ownership of all rolling stock and equipment, and assets, held by the City Fire Department (based on inventory) to the District; and 2. Agreement to release and transfer City Fire Department employees to the District; and 3. Agreement for lease terms with the District for the use of the City Fire Hall. J Resolution 06-028 F. By RESOLUTION NO. 06-027 (approved November 6,2006,6-1, Benskin opposed), followoing a duly advertised public hearing and in accordance with the procedures for disposition of personal property as required by law, including Ch, 39.33 RCW Intergovernmental Disposition of Property, the Council declared certain fire department assets surplus with the intent they would be transferred to Jefferson County Fire Protection District No. I to further joint fire service operations, subject to Council approval ofterms of the Interlocal Agreement. G. The Council determines the consolidated operation of the fire services of the City and Jefferson County Fire Protection District No. I to date has been successful and provided efficiencies and benefits to the citizens of the City, including, by taking advantage of economies of scale, reducing duplication of costs and downsizing administrative positions, and the Council determines agreements for transfer of equipment, lease and transfer of the fire hall, and transfer of employees would provide a more concrete and stable partnership and unified operation; and H. The Council determines it appropriate to accomplish further consolidation of the fire protection and EMS Services into one joint operation, to streamline the administrative, operational, and financial functions of the Fire Department, by Interlocal Agreement that provides for the transfer of the equipment and vehicles listed in this Resolution to the Jefferson County Fire Protection District No. I, leasing and transferring the fire hall to Jefferson County Fire Protection District No.1, and transferring City fire service employees to Jefferson County Fire Protection District No.1, according to the terms of this Resolution and the approved Interlocal Agreement and Lease; and further to approve a use agreement of the Pink House for fire administrative offices in return for benefits provided to the City by the District. NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Port Townsend as follows: A. The City Council authorizes the City Manager to execute with Jefferson County Fire Protection District No. I: I. An Interlocal Agreement, in the form presented to Council with this Resolution, including for the disposition of the equipment and vehicles listed in Exhibit A (attached), subject to the terms of the Agreement; 2. A Lease of the fire hall, in the form presented to Council with this Resolution; and 3. A use agreement for the Pink House.
