HomeMy WebLinkAbout06-036 Authorizing CM to execute agreements with certain entities consistent with fiscal year 2007 approved budget Resolution No. 06-036 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS WITH CERTAIN GOVERNMENTAL, NONPROFITS AND OTHER ENTITIES CONSISTENT WITH FISCAL YEAR 2007 APPROVED BUDGET, AND APPROVING THE CITY-SCHOOL POOL LEASE AGREEMENT BILLINGS FOR 2005 AND 2006, AND THE 2007 CONTRACT The City Council of the City of Port Townsend, Washington resolves as follows: WHEREAS, the City Council adopted at its December 4, 2006 meeting the 2007 annual budget, which provides City funding for certain nonprofit organizations, certain other entities, and certain other annual contracts of a reoccurring nature; and WHEREAS, pursuant to PTMC 3.46.100. the City Council determines it appropriate to authorize the City Manager to execute agreements with the nonprofit organizations, and other annual contract providers, in amounts consistent with the 2007 approved annual budget, as set forth on the attached list (Exhibit A) entitled "Annual Contracts"; and WHEREAS, the Council deems it appropriate, to avoid a volatile billing situation presented the City in 2005 and 2006 due to pool operating expenses, to approve a settlement of the billings in connection with the City-School Pool Facility Lease Agreement for 2005 and 2006, and to approve a 2007 contract with the School for a base amount of $45,000 (and possible energy surcharge not to exceed $15,000), for a total not to exceed $60,000 for 2007. The approved settlement of the 2005 and 2006 billings is: 2005 School bills $55,334 based on City share oftotal expenditures to operate the pool City pays $30,000 (base contract amount) School agrees to waive billing of $25,334 2006 School bills $72,478 based on City share of total expenditures to operate the pool City agrees to pay this amount, in return for $45,000 base amount in 2007, and energy surcharge not to exceed $15,000, and a cap of not to exceed $60,000. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Port Townsend 1. That the City Manager is authorized to execute agreements in the form approved by the City Attorney with the governmental, nonprofits, other entities and certain annual contract providers, in the amounts approved in the adopted 2007 annual budget, as shown on the attached list entitled "Annual Contracts." 1 Resolution 06-036 2. The City Manager is authorized to resolve the billings in connection with the City-School Pool Facility Lease Agreement for 2005 and 2006 as set forth in the third "whereas" clause of this Resolution, and to execute a 2007 contract with the School for a base amount of $45,000 (and possible energy surcharge not to exceed $15,000), for a total not to exceed $60,000 for 2007.
