HomeMy WebLinkAbout2934 Utility Rates and Charges Ordinance No. 2934 AN ORDINANCE AMENDING CHAPTER 13.05, UTILITY RATES AND CHARGES, SECTION 13.05.050 STORMWATER UTILITY RATES OF THE PORT TOWNSEND MUNICIPAL CODE WHEREAS, the City of Port Townsend provides a stormwater utility to the resident of the City of Port Townsend including surface water collection, channelization and management and surface water pollution avoidance for city residents, which services are both a regional benefit and a direct benefit to property owners and occupants; WHEREAS, the City of Port Townsend last revised stormwater rates in 1997 (Ordinance 2622), almost 10 years ago; and WHEREAS, the cost of inflation of goods and services since the City of Port Townsend last revised rates in 1997 has increased by approximately 21 %; and WHEREAS, stormwater control system costs and needs have increased since the City of Port Townsend last revised rates in 1997, and the new rate more closely approximates the deliverable cost for such services and is needed to meet increasing needs of system construction, maintenance and improvement. NOW, THEREFORE, the City Council ofthe City of Port Townsend ordains as follows: SECTION 1. Amendment. Section 5.84.030 of the Port Townsend Municipal Code is hereby amended to read as follows (text in strikeout is deleted, text in underline is added): 13.05.050 Monthly stormwater rates. A. Single-Family Residential Fees. The monthly service fee for each single-family dwelling shall be $7.25~; provided, that the impervious surface on the lot shall not exceed 3,000 square feet. If the impervious surface exceeds 3,000 square feet, the rate established in subsection B of this section shall apply. B. Commercial/Multifamily and All Other Fees. The monthly fee for all other property within the city not covered by subsection A of this section shall be according to the following formula: (Impervious area/3,000 sq. ft.) x single-family rate = monthly fee. C. State Highway Charge. Pursuant to RCW 90.03.525, the city may charge a montWy fee for state highway right-of-way. 1 Ordinance 2934 Section 2. Severability. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. Section 3. Effective Date. This ordinance shall take effect on April I, 2007, which is more that 5 days after its passage, approval and publication in the form and manner provided by law. Adopted by the City Council of the City of Port Townsend, Washington, at a regular meeting thereof, held this fourth day of December, 2006.
