HomeMy WebLinkAbout2229 Amending Ordinance 2210 - Requirements and Standards for Certain Streets and Other Public ImprovementsORDINANCE NO. ~2.~-c~ AN ORDINANCE PERTAINING TO STREET AND OTHER PUBLIC IMPROVEMENTS REQUIRED IN CONNECTION WITH CERTAIN SUBDIVISIONS, BY AMENDING SECTION 7 OF OP~INANCE 2210, AND ESTABLISHING AN EF- FECTIVE DATE WHEREAS, the City Council of the City of Port Townsend passed Ordinance 2210 establishing a certain requirement and standards for street and other public improvements throughout the City; and WHEREAS, Ordinance 2210 was subsequently amended by Ordinance 2219, specifying conditions under which construction of certain public improvements could be deferred; and ~EREAS, it was the intention of the City Council that, under Section 7(b)(1), certain improvements not be re&uired only for those subdivisions which were or are required to make public im- provements under Title 18 of the Port Townsend }~nicipal Code; and WHEREAS, the City Council desires to amend the Ordinance to so provide; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, IN REGULAR SESSION ASSEMBLED, DOES ORDAIN AS FOLLOWS: Section 1. Section 7 of Ordinance 2210 is here and hereby amended to read as follows: "There is added to Chapter 16.04 of the Port Townsend Municipal Code a new section to read as follows: "16.04. Street Improvements. "(a) Except as set forth in Subsection (b) of this Section, no building permit shall be issued by the City until the applicant has provided street and other public improvements as re- quired by Chapter 12.04 of the Port Townsend Municipal Code, as now or hereafter amended, together with necessary utility facilities as may be required by other ordinances of the City. "(b) An applicant need not comply with Chapter 12.04 for the following reasons: "(1) A permit for a building on a lot (legally s~b~i¥i~ed) which is part of a long or short subdivision which was ORDINANCE - 1 - reviewed and approved pursuant to Title 18 of the Port Townsend -Municipal Code after the effective date of this Ordinance, and which subdivi'fion was reRuired to provide street and other public improvements in accordance with the require~ents of Chapter 18 of the Port Townsend Municipal Code or in 'accordance with ~his Or- dinance(,-s~). Any lot created by any other ~ubdivision which may have been exempt from review and approval as a long or short sub- division under Title 18 or which was not required to provide foz streets and other public improvements shall be required to comply with this ordinance. "~2) A permit to make an addition, alteration or repairs of less than $25,000.00 in cost to an existing struc- ture, provided, however, that this amount shall be adjusted annual- ly, starting October 1, 1991, if there is an adjustment in the Con- sumer Price Index - All Urban Consumers - for the City of Seattle, in relation to the base period Index, as published by the United States Department of Labor Bulletin of Labor Statistics. The base period Index shall be the Index existing on September 30, 1990, and shall be compared with the Index on October 1, 1991, and annually thereafter. The dollar amount set forth in this subparagraph shall be increased by the same percentage increase in the Index from the previous year. "(3) A permit to make wholly interior improve- ments within an existing structure." Section 2. This Ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law.
