AN ORDINANCE OF THE CITY OF PORT TO~SEND ADOPT-
ING THE WASHINGTON CLEAN INDOOR AIR ACT, RCW
70.160, AS NOW OR HEREAFTER AMENDED, BY REFER-
ENCE, AND ESTABLISHING AN EFFECTIVE DATE
The City Council of the City of Port Townsend, in regular ses-
sion assembled, does ordain as follows:
Section 1. The City of Port Townsend does here and hereby
adopt by reference the Washington Clean Indoor Air Act, Chapter
70.160, Reviced Code of Washington, as now or hereafter amended, as
an ordinance of the City.
Section 2. In the event of any enforcement action required
under such Act, the City of Port Townsend shall be entitled to re-
cover, and the Court shall be authorized to award to the City of
Port Townsend, Court costs and any Court assessments in connection
therewith, in addition to any civil or other penalty which may be
imposed.
Section 3. Upon the issuance of a Civil Infraction Notice
pursuant to the Act, the penalty bail to be specified by the en-
forcement officer on the Civil Infraction Notice, shall be in the
amount of $50, provided, however, that the Court is authorized to
assess a penalty in the full amounts established by the Act.
Section 4. The City Clerk for the City of Port Townsend shall
and has retained three copies of the Washington Clean Indoor Air Act,
RCW 70.160, in its offices at City Hall, for public inspection and
pursuant to law applicable to the adoption of State statutes by ref-
erence.
Section 5. This Ordinance shall be codified as a new Chapter
in Title 6 of the Port Townsend Municipal Code.
Section 6. This Ordinance shall take effect upon its oassage,
approval and publication in the form and manner provided by law.
Read for the first, second and third times, passed by the City
Council of the City of Port Townsend, and signed and aoproved by
