AN ORDINANCE RELATING TO ZONING, AMENDING SECTION 17.08. 276 OF THE PORT TOWNSEND MUNICIPAL CODE TO INCLUDE THE AREA OF PRIVATE ACCESS EASEMENTS IN THE CALCULATION OF LOT THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS FOLLOWS: Section 1. Section 17.08.276 of the Port Townsend Municipal Code is hereby amended to read as follows: 17.08.276 Lot Area. "Lot area" means the total horizontal area within the boundary lines of a lot. Where utility or ((s~ee~--~se~TW~s)) private access easement__s are located within ((~-be~e~)) a parcel, lot area computation shall ((n~e)) include that area contained Within the easement. Where public stree~ ri~hts-of-wav are located within or borderin~ a parcel, lot ar~a...computatio.n shall not include that area contained within such riqhts-of-wa¥. ~ection. 2., Severabil~ty. In the event any one or more of the provisions of this ordinance shall for any reason be held to be invalid, such invalidity shall not affect or invalidate any other provision of this ordinance, but this ordinance shall be construed and enforced as if such invalid provision had not been contained therein; provided, that any provision which shall for any reason be held by reason of its extent to be invalid shall be deemed to be in effect to the extent permitted by law. Section 3. Effective Date. This ordinance shall become effective five days after its passage and publication. Read for the first time on /~7 7 , and for the second and third time and passed by the City Council of the City of Port Townsend, Washington, at a regular meeting thereof, held this 7~ day of /~;9~ 1991.
