HomeMy WebLinkAbout3088 Amending PTMC 10.04 Parking to Correct the Section Numbering Ordinance 3088 Revising PTMC Chapter 10.04 Parking Page 1 of 2 Ordinance No. 3088 AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING PORT TOWNSEND MUNICIPAL CODE CHAPTER 10.04 PARKING TO CORRECT THE SECTION NUMBERING (PURSUANT TO PTMC 1.01.015) RECITALS: A. The City Council determined it was appropriate to update the parking code (PTMC Chapter 10.04) to provide the Chief of Police, in consultation with the City Manager and Public Works Director, the authority to set parking limits. This was accomplished by Ordinance No. 3077 which was approved on July 2, 2012. B. In conjunction therewith, the sections of PTMC Chapter 10.04 were renumbered. The result was that the newly renumbered sections do not conform to the parking code sections referenced on the City of Port Townsend Notice of Violation carbon-copy, preprinted forms utilized by the Port Townsend Police Department in enforcing the provisions of this ordinance. C. In addition, due to a typographical error, the section number for the violation of Moving Vehicle to Avoid Time Limit which is printed on the Notice of Violation form is PTMC 10.04.170. This is not the former number for this section. D. PTMC 1.01.015.A(10) allows revisions to an ordinance to "correct manifest errors or omissions in numbering or renumbering sections of the revised code." E. It would be an unnecessary expense to replace the 3000+Notice of Violation preprinted fonns on hand. Instead, it is recommended that: (i) the sections of PTMC Chapter 10.04.010— 10.04.110 be renumbered to their fonner numbers (where applicable) which were in use prior to the renumbering which occurred in conjunction with Ordinance No. 3077; and (ii) the violation of Moving Vehicle to Avoid Time Limit be renumbered from PTMC 10.04.100 to 10.04.170 to correspond to the section number printed on the Notice of Violation form. NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows: SECTION 1. SECTION 2. Severability. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances, is not affected. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law.
