AN ORDINANCE VACATING THOSE PORTIONS OF LANDES,
OXFORD AND KUHN STREETS LYING BET%~EN BLOCKS 3,
4, 5 AND 6 OF THE MOORE PLACE ADDITION TO THE
CITY OF PORT TOWNSEND, EXCEPT THE SOUTHERLY
PORTION OF LANDES STREET ABUTTING LOT 6 OF
BLOCK 6 AND LOT 6 OF BLOCK 5; VACATING ALL IN-
TERIOR LOT LINES OF BLOCKS 3, 4, 5 AND 6 OF
THE MOORE PLACE ADDITION; VACATING THE WEST
LINES OF BLOCKS 3, 4 AND 5, AND THE EAST LINES
OF BLOCKS 4, 5 AND 6 OF THE MOORE PLACE ADDI-
TION; ESTABLISHING CONDITIONS TO THE STREET AND
BOUNDARY LINE VACATION; AND ESTABLISHING AN EF-
FECTIVE DATE
WHEREAS, the Planning Commission and the City Council for the
City of Port Townsend have considered Street Vacation Application
9101-10, and following due notice have held public hearings upon
the application, and ~
WHEREAS, the City Council for the City of Port Townsend
adopted its Findings of Fact and Conclusions on July 2, 1991, as
amended on July 16, 1991, now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS
FOLLOWS:
Section 1. That all of those portions of Landes Street, Ox-
ford Street and Kuhn Street, lying between Blocks 3, 4, 5 and 6 of
the Moore Place Addition to the City of Port Townsend, except the
Southerly portion of Landes Street abutting Lot 6 of Block 6 and
Lot 6 of Block 5, be and the same are here and hereby vacated.
Section 2. That all of the interior lot lines of Blocks 3,
4., 5 and 6 of the Moore Place Addition to the City of Port Town-
send be and the same are hereby vacated.
Section 3. 'That the West boundary lines of Blocks 3, 4 and 5
and the East boundary lines of Blocks 4, 5 and 6 of the Moore
Place Addition to the City of Port Townsend be and the same are
hereby vacated.
Section 4. The City of Port Townsend, for itself, its suc-
cessors and assigns, hereby reserves a 25-foot easement for utili-
ties together with the right to construct, install, maintain and

operate the same, within those portions of Landes, Oxford and Kuhn
Streets vacated by this Ordinance, said easement being 12~ feet on
either side of the centerline of each of said streets.
Section 5. That the street and boundary line vacations afore-
mentioned are conditioned, however, upon the following:
A. That all fees and compensation required for
the street vacation pursuant to Chapter 12 of the Port Townsend
Municipal Code first be paid before this Ordinance shall become
effective.
Section 6. That the aforementioned conditions shall first be
satisfied, and upon satisfaction of the same this Ordinance may be
published and thereupon a certified copy of this Ordinance shall
then be recorded by the City Clerk with the Jefferson County Aud-
itor, at which time this Ordinance shall be effective.
Section 7. That the street and boundary line vacations pro-
vided for herein shall be cancelled and become automatically null
and void one year from the date of passage of this Ordinance by
the City Council, if said fees and compensation have not been paid
by the applicant within that time as set forth in Section 5.A. of
this Ordinance.
Section 8. This Ordinance shall take effect upon its passage,
approval and publication in the form and manner provided by law,
and after it has been recorded with the Jefferson County Auditor
as hereinabove set forth.
Read for the first, second and third times, passed by the City
Council for the CiTy of Port Townsend and signed by the Mayor of
the City this ~ ~ daY of July 1991.
