AN ORDINANCE A~NDING OPDINANCE NO. 2250 AND SECTION
17.08.498 OF THE PORT TOWNSEND MUNICIPAL CODE TO
CHANGE THE DEFINITION OF "TRANSIENT ACCOMODATION" TO
CONFOP~ TO THE RECOM}~NDATION OF THE CITY PLANNING
COMMISSION MADE PRIOR TO PASSAGE OF ORDINANCE N0.2250
AND ESTABLISHING AN EFFECTIVE DATE HEREOF
THE CITY COUNCIL OF THE CITY OF PORT TO~SEND DO ORDAIN
AS FOLLOWS:
Section 1. Section 1 of Ordinance 2250 together with
Section 17.'08.498 of the Port Townsend Municipal Code are
each hereby amended to read as follows:
"17.08.498. Transient Accomodation. "Transient accomoda-
tion" means a building, structure or facility, or any part
thereof, such as a bed and breakfast inn, inn, hotel, motel,
motor hotel, tourist home, condominium or similar facility,
primarily designed for and offering one or more lodging units
to travelers and transient guests for periods of no more than
29 (~ays-im-aay-eatem~a~-yea~) consecutive calendar days for
temporary lodging and sleeping purposes, provided that an
absence for a period of le~s than 30 consecutive days followed
by re-occupancy shall be considered part of the same consecu-
tive period. Portions of calendar days shall be counted as
full days. A transient accomodation does not include an
accomodation which a person occupies or has a right to occupy
as his or her domicile or permanent residence. It shall be
presumed that occupancy of real property for a period of 30 con-
secutive days or more constitutes a rental or lease of real
property fo~ residential, rather than transient, accomodation
purposes, which presumption may however be rebutted u~on sub-
mission of satisfactory proof~by a preponderance Of t~e evidence."
Section 2. This ordinance shall take effect upon its
passage, approval and publication in the form and manner provided
by law.
Read for the first, second and third times, passed by the
City Council of the City of Port Townsend and approved and
