Zz~ AN ORDINANCE AMENDING THE MAXIMUM INCOME LEVEL TO $15,000 FOR LOW-INCOME SENIOR CITIZEN DISCOUNTS FOR CITY SEWER, WATER AND STORM SEWER UTILITY RATES; AMENDING SECTIONS 13.04.035~ AND 13..12.290 ' OF THE PORT TO~SEND MUNICIPAL CODE; AND ESTABLISHING AN EFFECTIVE DATE THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DO OP~AIN AS FOLLOWS: Section 1. Section 13.04.035 of the Port Townsend Municipal Code is here and her&by amended to read as follows: "13.04.035 Rates-Low-income senior citizens. A. For the purposes of this section, "low income senior citizen" is defined as a person sixty-two years and over of age, whose total income, including that of his or her spouse or cotenant, does not exceed the sum of (twelve) fifteen thousand dollars per annum. "B. For the purposes of this section, a "cotenant" is defined as any person living in or upon the same premises as those occupied by the low-income senior citizen. "C. For the purposes of this section, the term "total income" includes but is not limited to all pensions, whether from private or government sources, any disability payments, inter- est, dividends, annuity proceeds, and all and every other amount which may be available to the low-income senior citizen for pur- poses of spending the same. "D. "Low-income senior citizens" as defined in this section, upon application and proof of their status to the city clerk, shall be subject to a monthly sewer charge pursuant to Section 13.04.030, as amended, of eight dollars." Section 2. Section 13.12.290 of the Port Townsend Municipal Code is here and hereby amended to read as follows: "Section 13.12.290 -Low-income senior citizens. For the purposes of this section, the following terms shall have the following meanings: "A. "Cotenant" means any person living in or upon the same premises as those occupied by the low-income senior citi- zen. "B. "Low-income senior citizen" means a person sixty-two years and over of age, whose total income, including that ORDINANCE - 1 - of his or her spouse or cotenant, does not exceed the sum of (eem) fifteen thousand dollars per annum. "C. The term "total income" includes but is not limited to all pensions, whether from private or government sources, any disability ~payments, interest, dividends, annuity proceeds, and all and every other amount which may be available to the low-income senior citizen for purposes of spending the same. "Low-income senior citizens, upon application and proof of their status to the city clerk, shall be eligible for a monthly rate of five dollars and fifty cents, pursuant to °Sections 13.12.210 and 13.12.220." Section 3. This Ordinance shall take effect on January 1, 1992, after its passage, approval and publication as provided by law.
