AN ORDINANCE OF THE CITY OF PORT TOWNSEND ADOPTING THE
DEPARTMENT OF ECOLOGY 2005 STORMWATER MANAGEMENT
MANUAL FOR WESTERN WASHINGTON
WHEREAS, the City currently operates under the Department of Ecology (DOE)
1992 Stormwater Management Manual for the Puget Sound Basin. This manual set technical
standards and best management practices for the management of stormwater quality and
quantity control related to new development and redevelopment; and
WHEREAS, in 2001 DOE published a new manual, the August 2001 Stormwater
Management Manual for Western Washington (SWMM-WW). This new manual was
intended to revise the technical basis for the stormwater standards and simplify the use of the
manual. The City did not adopt this manual and continued to use the 1992 manual and its
standards. In April 2005 DOE issued an updated manual, Stormwater Management Manual
for Western Washington, February 2005 superseding the August 2001 version. This latest
version was published to correct errors, clarify statements, update design criteria and
procedures, and apply more recent research to the 2001 Manual; and
WHEREAS, on July 5, 2005, the Council approved the Critical Areas Ordinance,
Ordinance 2899, amending the Environmentally Sensitive Areas section of the Port
Townsend Municipal Code. This ordinance included Council findings that directed the Public
Works Department to complete an update of the City's Stormwater Management Plan as soon
as practicable, and to complete promptly thereafter revisions to the implementing provisions
ofthe Engineer Design Standards manual, based upon the DOE 2005 SWMM-WW. In
developing the implementation schedule for this work, staff has concluded that it would be
more effective to adopt the new standards before updating the Stormwater Plan as the
standards would form the basis for determining the appropriate regional solutions to
stormwater management across the City; and
WHEREAS, the new 2005 SWMM-WW standards are sufficiently different from
those of the 1992 Stormwater Manual that it is prudent to give the development community
timely notice of Council's intent to adopt new standards. This would give stormwater
design engineers time to become familiar with the processes of the new manual and
developers the opportunity to incorporate the new standards into their project planning.
Staff would also need time to revise the Engineering Design Standards manual and the
administrative documents associated with stormwater management for new development
and redevelopment; and
WHEREAS, the 2005 SWMM-WW contains optional guidance (section 2.6) relating
to financial liability and off-site analysis and mitigation. Staff is not recommending the
inclusion of these elements at this time. The intent is to evaluate these elements as part of the

City's Stormwater Plan development and to make final recommendations on these elements
to Council in conjunction with the Stormwater Plan approval process. Therefore the adoption
of the basic 2005 SWMM-WW could be considered interim in nature with the final SWMM
recommendation coming to Council with the Stormwater Plan and once the City has gained
some experience and insight into the manual after using the basic February 2005 SWMM-
WW; and
WHEREAS, the Council determines it appropriate to adopt the Department of
Ecology's February 2005 Stormwater Management Manual for Western Washington ("2005
SWMM- WW");
NOW, THEREFORE, the City Council of the City of Port Townsend ordains as
follows:
SECTION 1. Adoption. The Council hereby adopts the Department of Ecology's
February 2005 Stormwater Management Manual for Western Washington ("2005 SWMM-
WW"), except for the following (which is not adopted):
. Section 2.6 - Optional guidance, relating to financial liability and off-site analysis and
mitigation.
Reference in adopted policy or regulation to "State of Washington Department of Ecology
Stormwater Management Manual for Puget Sound (SWMM)" (Engineering Design
Standards, at chapter 1, paragraph 2(b)), "DOE Stormwater Management Manual" (PTMC
13.32.010; EDS, chapter 4, paragraph 2(a)), or similar reference, are amended and replaced
with Department of Ecology's February 2005 Stormwater Management Manual for Western
Washington ("2005 SWMM-WW"), as adopted by this Ordinance.
Specifically:
1. PTMC 13.32.010 which reads as follows is amended to read (underline is added,
strike is deleted):
All developments shall comply with the DOE StBfffi'NEller Management Manool
Department of Ecology's February 2005 Stormwater Management Manual for
Western Washington ("2005 SWMM-WW"). except for the following: Section 2.6-
OPtional guidance, relating to financialliabilitv and off-site analysis and mitigation,
city engineering design standards, city stormwater master plan, and adopted drainage
basin plans for all clearing and grading activities, for erosion control during
construction and for permanent drainage system improvements.
2. Engineering Design Standards at chapter 1, paragraph 2(b) which reads as follows is
amended to read (underline is added, strike is deleted):

2(b). The conditions and standards set forth in the most current edition (except as
otherwise noted) of the following plans and specifications are incorporated into these
standards by reference and shall be applicable when pertinent or required:

3. Engineering Design Standards at chapter 4, paragraph 2(a) which reads as follows is

SECTION 2. Severability. If any provision of this ordinance or its application to
any person or circumstance is held invalid, the remainder of the ordinance, or the
application of the provision to other persons or circumstances is not affected.
This ordinance shall take effect and be in force on July 15,2006, which is more
than five days after the date of its publication in the manner provided by law.
Adopted by the City Council of the City of Port Townsend, Washington, at a
regular meeting thereof, held this 5th day of June, 2006.
