ORDINANCE NO. 2923
AN ORDINANCE VACATING A 20' X 30' PIECE OF RIGHT-OF-WAY LYING
ADJACENT TO AN UNOPENED PORTION OF QUINCY STREET AND WITHIN
LOT 12, BLOCK 23 OF THE MOUNTAIN VIEW 2ND ADDITION TO THE CITY
OF PORT TOWNSEND; ESTABLISHING CONDITIONS TO THE STREET
V ACA TION; AND ESTABLISHING AN EFFECTIVE DATE.

WHEREAS, the City Council for the City of Port Townsend has considered Street
Vacation Application No. LUP05-125 (Keith & Katie Fleming) and following due notice has
held a public hearing upon the application; and
WHEREAS, the vacation request involves a 20' x 30' section right-of-way lying
adjacent to an unopened portion of Quincy Street and within Block 23 of the Mountain View
20d Addition; and
WHEREAS, the City Council for the City of Port Townsend adopted its Findings of
Fact and Conclusions on February 21,2006; and
WHEREAS, the Council's Findings and Conclusions approved in concept the
proposed vacation, subject to petitioner paying for an appraisal of said right-of-way and paying
100% of the appraised value of the land; and

WHEREAS, the Council's Findings and Conclusions also conditioned the vacation
approval upon petitioner submitting a Lot Line Adjustment application to merge the vacated
alley into petitioner's adjoining lands; and
WHEREAS, petitioner has now paid full appraised value of the subject alley to the
City and has submitted a Lot Line Adjustment application, which has been processed and
preliminarily approved by the DSD Director subject to final approval and recording of the
right-of-way vacation Ordinance by Council;
NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as
follows:
Section 1.
Subject to the conditions in Section 2 of this Ordinance, the following right -of-
way is hereby vacated to Keith & Katie Fleming:
That portion of Lot 12, Block 23, Mountain View Second Addition to the City of
Port Townsend as per plat recorded in Volume 2 of Plats, page 4, records of
Jefferson County, Washington described as follows:
Beginning at the Southwest comer of Lot 12 where it abuts Quincy Street; thence
Northwesterly along the Easterly line of Quincy Street a distance of 10 feet to the
True Point of Beginning; thence Northeasterly on a line parallel to the Southerly
boundary of Lot 12 a distance 000 feet; thence Northwesterly on a line parallel to
Quincy Street a distance of20 feet; thence Westerly on a line parallel to the Southerly
boundary of Lot 12 a distance 000 feet; thence Southerly on the Easterly boundary
of Quincy Street a distance of 20 feet to the True Point of Beginning;
Vacation of the aforementioned alley right-of-way is conditioned on the
following:
Section 2.
a. Petitioners shall adhere to all conditions of the Lot Line Adjustment,
which received preliminary approval by the City DSD Department on May 10,
2006 (File No. LUP06-055). Said Lot Line Adjustment merges the vacated
right-of-way into petitioner adjoining land via the recording of a Statement of
Intent. The Statement of Intent shall be recorded with the Jefferson County
Auditor concurrent with recording of this street vacation Ordinance. The
petitioner shall pay for all fees associated with recording the above documents.
Section 3.
This ordinance shall take effect upon its passage, approval and publication in
the form and manner provided by law, and after it has been recorded with the
Jefferson County Auditor pursuant to Section 2 of this ordinance.

Adopted by the City Council of the City of Port Townsend, Washington, at a regular
business meeting thereof, held this fifteenth day of May, 2006
