AN ORDINANCE VACATING THAT PORTION OF 18th STREET, LYING NORTH OF THE 40-FOOT RIGHT-OF-WAY FROM THE CENTER OF DISCOVERY ROAD, SOUTH OF BLOCK 143 OF THE EISENBEIS ADDITION TO THE CITY OF PORT TOWNSEND, AND BETWEEN DISCOVERY ROAD AND HANCOCK STREET; SAID VACATION BEING DESCRIBED AS PARCEL A AS SHOWN ON A SURVEY RECORDED IN VOLUME 13 OF SURVEYS, PAGE 158, IN THE RECORDS OF JEFFERSON COUNTY; ESTABLISHING CONDITIONS TO THE STREET VACATION; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation Application 9202-02, and following due notice has held a public hearing upon the application, and WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact and Conclusions on March 17, 1992, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS FOLLOWS: Section 1. That portion of 18th Street, lying north of the 40-foot right-of-way from the center of Discovery Road, south of Block 143 of the Eisenbeis Addition, and between Discovery Road and Hancock Street within the City of Port Townsend is hereby vacated. The legal description of the vacated right-of-way is: That portion of 18th Street as shown on the Plat of Eisenbeis First Supplemental Addition to the City of Port Townsend, Recorded in Volume 2 of Plats, page 24, Records of Jefferson County, Washington, described as follows: Parcel A as shown on a survey recorded in Volume 13 of Surveys, page 158, Records of said Jefferson County. Section 2. That the street vacation aforementioned is conditioned, however, on the following: A. The portion of 18th Street to be vacated shall be limited to the area which lies south of Block 143 of Eisenbeis Addition; and north of the 40-foot proposed right-of-way from the existing center of Discovery Road. The applicant shall dedicate to the City by Dedication Deed free and clear of all encumbrances, that area of Block 143 which lies within the proposed 40-foot right-of-way from the center of existing Discovery Road. Section 3. The City Council finds that the dedication of land by the applicant to the City as set forth in Section 2(B) of this Ordinance is fair and adequate compensation for the street vacation provided for herein pursuant to the Ordinances of the City. Section 4. This Ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferson County Auditor pursuant to Section 2 of this Ordinance, and after a dedication of the area to the City described in Section 2B has been recorded.
