HomeMy WebLinkAbout02/03/1976 ~l)Ht MINUTES OF THE REGULAR SESSION OF FEBRUARY 3,1976 8 The City Council of the City of Port Townsend met in regular session this 3rd day of February 1976 at 7:30 p.m. in the Council.Chambers of City Hall, Mayor Joseph B. Steve presiding. ROLL CALL Officers and members present were as follows: Mayor Steve, City Attorney Abraham, City Engineer French, City Clerk-Treasurer McCoy, and Councilmen Ciprioti, Judy, Camfield, Parker, Wilson and Shaneyfelt. Councilman, Klenk was absent. MINUTES I It was moved by Councilmen Judy/Shaneyfelt that the reading of the minutes of the previous session be dispensed with. Motion carried. BILLS AND CLAIMS The following bills and claims were presented for payment: I Payroll Clearing Current Expense Fund Street Fund Library Fund Park Fund Water-Sewer Fund Equipment Rental Fund Firemen's Pension & Relief Fund Federal Shared Revenue Fund $34,865.83 18,770.82 2,767.70 2,360.28 719.53 23,702.79 2,634.79 39.00 5,590.51 / It was moved by Councilmen Judy/Camfield that the bills and claims be paid. Motion carried. 8 COMMUNICATIONS A letter from SuzAnne Abshire recommended that fees for dog licenses be amended to read: Any neute~êd dog, $2.00; any unneutered dog, $4.00, regardless of sex. This letter was referrE!d to the Legislative Commiteee. A letter from T. G. Sommer, Chairman of the Bicentennial Festival Commit:tee, requested permission to use the Marine Park facility as a focal point for the Fourth of July celebration. ~t also requested a parade permit. Mayor Steve proposed to discuss this with John Pope and get to the commi1:tee. man. A letter from Keith D. Lumbard was not read, due to its length. This matter was referred to the Legislative Committee. Copies 'had been given to each Council- COMMITTEE REPORTS I Mayor Steve reported that the city ordinance pertaining to sidewalks and the responsibility for mainten- ance of same is somewhat unclear. He directed the Legislative Committee to study and present an amendment to the ordinance placing the burden of responsibility eqUally on the property owner and 1:he city. He directed the Street Superintendent to check all sidewalks and notify owners of need for repairs. Clerk-Treasurer McCoy reported that the medical insurance for union employees has increased to $65.53 and he wished to have the Council decide whether to raise the medical for non-union employees to that amount. After some discussion, it was moved by Councilmen Camfield/Judy to pay the same ænount for non-union and union medical insurance. Councilman Wilson reported to raise the building permit fees as foot; Basements, $6 per square foot; that these rates be adopted. Motion that the Building Committee met regarding thl3 request of the City Engineer follows: First floor, $20 per ~quare foot; second floor, $10 per square and garages, $10 per square foot. It was moved by Councilmen Wilson/Ciprioti passed. Rates adopted. 8 At this point, Mayor Steve entertained audience participation. Gladys j~lauk said she represented Fred Lester, Chairman of the Rhododendron Festival and wished to thank the Council for passing Ordinance No. 1752, regulating parades. Mrs. Helen Burns rose to express thanks on behalf of the Jefferson Coun'ty Historieal Society for the interest and help the city has shown the museum. Also, she invited the Council to visit the museum to see the improvements that have been made. PUBLIC HEARINGS I Mayor Steve opened the public hearing to consider the request of Mr. and Mrs. H. Donald Bliss and Mr.. and Mrs. Delmer Q. Smith for vacation of the following street: Rose Street lying between U and V Streets. Mr. Bliss spoke for the vacation. There was no opposition. The hearing was closed to the public. The Planning Commission recommendation to grant this vacation was read. Council discussion followed, addressing the location of utility easements in the street rights-òf-way and the number of vacation requests in the immediate vicihity. It was moved by Councilmen Judy/Parker that the street vacation be granted. Unanimous affirmative vote, 6-0. Motion carried. Street vacation granted. I OLD BUSINESS 8 It was moved by Councilmen Judy/Ciprioti that Rezone #82 (Block 68, Hastings 2nd Addition, from R-3 to C-2, by Mr. and Mrs. Merlin Nelson) which was continued at the January 20,1976 Council meeting, be brought to the floor for consideration and action by the Council. Motion passed. It was reported that the Planning Commis- sion did not reconsider said application as requested by the Council but returned it with the same recommendation originally submitted, i.e., that the rezone be granted. There being considerable interest and feeling about this rezone request, comment for and against was heard from the audience. There were several proponents and a number of opponents. Both factions produced våcinity maps and all interested parties were given the opportunity to speak. The hearing was then closed to the audience and the Council took a five-minute recess. At the end of the recess, roll call was taken with all Councilmen except Klenk present. Chair called for question, there was none. Chair called for unanimous affirmative vote, there was no negative vote heard. Motion carried. It was moved by Councilmen Judy/ Ciprioti to consider said permit application. Chair called for question and unanimous affirmative vote. There was no negative vote. Motion passed. At this point Mr. Merle Hufford rose and protested that earlier in the meeting the Mayor had assured him an opportunity to speak on this subject, but the matter had been acted upon by Council without his speaking. Mayor Steve suggested that the Council reconsider. It was moved by Councilmen Càmfield/Ciprioti that it be reeonsidered. Mr. Hufford and several other members of the audience spoke against the permit. David Cunningham, County Planner, County Commissioners Bud O'Meara and B. G. Brown apd others spoke for the permit. It was moved by Councilmen Camfield/Judy that the conditional use permit be granted, findings of fact required in the zoning ordinance having been made. Chair called for question. There was none. Chair called for unanimous affirmative vote. There was no negative vote heard. Motion passed. Conditional use permit granted. 8 I RESOLUTION NO. 76-1 A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE QUIT CLAIM DEEDS FOR RELEASE OF WATER LINE EASEMENTS NOW ABANDONED. It was moved by Councilmen Ciprioti/Judy to refer this resolution to the Water Committee. Motion passed. McCune, attorney, offered to work with the Council on improving the side- walks in the city. He mentioned the curb at the southeast corner of Water and Tyler, and holes in the sidewalk on Tyler Street south of Water Street and asked the Council to use its authority to have same corrected. A letter from M. E. Freeman, a member of the Port Townsend Arts and Crafts Guild, encouraged the Council to keep "art" a community project rather than attempting to gain sponsorship from the federal government. I A letter from J.J. and E. L. Kircher of 2010 Jefferson Street stated their displeasure with the Council for rezoning lots 5 and 7 of Block 68 of the Hastings 2nd Addition and further stated reasons for their displeasure. A letter from Mr. Gordon M. Alford, Minister, First United Presbyterian to uphold and enforce its recent ordinance relating to crowd behavior during parades He stated that unless action is taken to correct the problems of recent parades, the participation of any high school or junior high school band, drill team, etc. Church, urged the Council and other public events. city will not have the A letter from Robert Balcom, Band Director, Port Townsend High School, also encouraged enforcement of the new parade ordinance and stated problems that have occurred in the past. I COMMITTEE REPORTS Councilman Shaneyfelt reported that the Legislative Committee met and reviewed Ordinance No. 1753 and made the following recommendation: Ordinance No. 1753 should be adopted with the following change: Add the words, "other than meter violations," after the words, "empowered to impound motor vehicles for violation of parking ordinances." Note: It was the Council's desire to act on Ordinance No. 1753 at this time. 8
