I A Hast C4k~ ~PL-J Deputy' y Clerk MAYOR MINUTES OF THE REGULAR SESSION OF MARCH 6.1973 Port Townsend, Washington The City Council of the City of Port Townsend, met in regular session this 6th day of March, 1973, at 7:.)0 P.M. in the Council Chambers of City Hall. Mayor Joseph P. Steve presiding~ I ROLL CALL Officers and members present were as follows: Mayor Steve, City Attorney Abraham~,Deputy City Clerk Pedersen, Engineer French, Councilmen Scheyer, Judy, Camfield, Rosbach, Sahli and Hufford. MINUTES OF THE PREVIOUS SESSION It was moved by Councilman Camfield, seconded by Councilman Sahli that the minutes of the previous session be dispensed with. Motion earried. I It was moved by Councilman Sahli, seconded by Councilman Judy that the bills and claims be approved as read, and that the Mayor and City Clerk draw warrants upon the proper funds for payment of same. Motion carried. The following voucher was presented for approval of payment: WOODMAN'S GULCH ....Voucher No. 19....Crown Zellerbach Corporation........ $ 79.08 It was moved by Councilman Camfield, seconded by Councilman Judy that the above voucher be approved for payment. Motion carried. COMMUNICATIONS The following communications were presented: 8 To the Mayor and City Council of Port Townsend Gentlemen: In our Club's February meeting, a motion was made and duly seconded to offer the suggestion: That the City plant trees to replace trees that have died in the planters, with the future planting to be done in the ground. Or the planters to be partially spotted below the sidewalk level, in a line approximately lO feet out from the building, and in far enough from the curb to allow car doors to be opened. Noren, Secretary Men's Garden Club PETITION FOR STREET VACATION I To the City Council of the City of Port Townsend, Washington:: The petitioners, Jim and Donna Chase, husband and wife, and Mrs. Frank Anderson, widow, and Mr. Ray S. Crist, widow, being owners of all lands upon the portion of City street hereinafter mentioned, hereby respectfully petition and request that the City Council, after due notice given and hearing' had, vacate That portion of Taft Street lying between Madison- Street and Monroe Street from the East side of Madison Street to the West side of Monroe Street. COMMITTEE REPORTS. 8 Councilman Judy reported that he had made an inspection of the property under investigation as a gravel pit site. It is 20 acres located near Cape George. He said the council should decide whether it would be wisest to buy a gravel pit or continue to obtain gravel from other sources. Mayor Steve said the price on the gravel pit is $l,OOO an acre. He also reported that the Street Superintendent has sent a letter to the State Highway Department requesting someone to drill the property to determine how much gravel was there. He suggested waiting on the decision until we hear from the State. Hufford stated he is investigating other gravel pits to see if we. could get comparable gravel at less money. Scheyer st;:~ted.:~that we need to know how much gravel we use and how much it costs a year in order to make an informed dec:isÌòo. . Councilman Sahli noted that the city owns a piece of property above the new City Equipment Barn. Steve said we are going to make a playground out of it. Mayor 428 MINUTES OF THE REGULAR SESSION OF MARCH 6th, 1973, CONTINUED -- -- - ,-------- ----- ----- -------- -------- -_u_--- ----- -_u -- ------ ---------------------- ------------ - -- ------- BID OPENING 8 The following bid to supply the city with a street sweeper was opened and read as follows: Sahlberg Equipment ænc. 5950 Fourth Ave. So. Seattle, Wa. 98108 Mobil Sweeper Model 2TE-3. The total cost will be distributed o~er 24 payments at $516.67. At the end of the 24 payments there will be one (1) final payment of $6,207.68. The unit price is ....... $18,607.68. OPTIONS: Cab mounted strobe light $69.50 Wheel mounted back up alarm 42.50 Plus Washington State Sales Tax on all the above figures. I Mayor Steve said he was under the impression this was a rental bid and this didn't sound like one to him. City Attorney Abraham said the bid called for a lease-purchase arrangement and this bid sufficiently complied with the bid call. Since the bid call also specified awarding of bid would be within 15 days the award was held over by the Mayor until the next regular council meeting. STREET VACATION PUBLIC HEARINGS The Mayor opened the public hearing on the street vacation request from James A., Michael D., and Carl J. DeLeo for that portion of Morrison Street lying between Washington and Jefferson Streets in Hastings 2nd Addition. There were no objections heard from the audiance and the hearing was closed. A letter from the Planning Commission was read which stated in part..."The Port Townsend Planning Commission wishes to point out that the DeLeos are the owners of all surrounding property, and that there is presently an existing residence on the above said street. A letter was read from Puget Power and Light Company stating that they have no objections to the proDosed vacation providing an easement is reserved for their existing lines and polès.. The Port Townsend Planning Commission voted to recommend to the City Council to grant the petition as requested, providing that proper allowances are made for utility easements." It was moved by Councilman Judy, seconded by Councilman Hufford that the vacation request be granted with the usual reservement of utility easements. Motion carried. I The Mayor opened the public hearing on the street vacation request from the Pacific NW Evangelical Free Church Homes, Inc., for that portion of Lincoln Street lying between the westerly line of Kearney and the easterly line of Decatur, all in the Estate Addition. There were no objections heard from the audiance and the hearing was closed. It was moved by Councilman Scheyer, seconded by Councilman Judy that the vacation as requested be granted. Motion carried. The City Attorney stated that thB Planning Commission in their letter of recommendation had suggested a time limit. The following excerpt from that letter was read..."The Port Townsend Planning Commission wished to recommend to the City Council to grant this petition as requested Droviding construction begin within one year after approval, and that all easements be withheld. "' Councilman Camfield moved that this stipulation be included in the approval. It was seconded by Councilman Hufford and passed. 8 The Mayor opened the public hearing on the request to vacate all streets and alleys in Cowels Addition, Fairmont Addition, McBride's Addition and Gottstein's Addition, except for 39th Street, and all unvacated streets and alleys, in and adjoining Lewis & Spitz Addition and Langert's Addition by the owners of more than two-thirds of the property abutting upon the subject streets and alleys. The Deputy Clerk stated that the Planning Commission has not finished making a recommendation on this. Kay Miner, chairman of the Planning Commission, stated they are trying to get a guarantee of right-of-way and access for a horse trail in this area since it is now commenly used thatWlY, They will act on it at the next Planning Commission meeting. Mayor Steve tabled the hearing until after the council receives the Planning Commission recommendation. The City Engineer reported that one addition (McBride's) in this area has been inserted wrong on the map and that the pIt should be turned around. If it were turned the way it should be it would not fit. I OLD BUSINESS The Deputy Clerk ~sked the council to set a public hearing date for the variance request from H.J. Carroll. The City Engineer reported he has lifted three building permits issued to him in the H.J. Carroll Addition since the building permits as shown do not agree with the way the houses are being built. One house is being built 10 feet from the property line instead of the required 20 feet. Councilman Scheyer asked if he had to conform to any street standards. Engineer French said no since the street has already been opened and is now a city street. Mayor Steve set the public hearing date for April 3,1973. 8 NEW BUSINESS Councilman Camfield asked if the council would put the sub-division ordinance on the agenda for the next meeting. Engineer French stated that it had been tabled because of the expense of publication and enforcement. He felt we should take it off the table for review and discussion at the next meeting. Councilman Hufford said there is a serious starling problem in the city. looking into a solution and also contact the county commissioners. He felt the city should be I Councilman Hufford said that he was quite upset with the letter read at the last meeting critizing a church and j.he people of Port Townsend. He said the council should make sure that this type of tripe does not get read at council meetings again. The City Attorney stated that under Initiative 276 any corresspondence coming into the city is public record and cannot be suppressed. Councilman Hufford said that he felt something also should be done about controlling the building of accessory buildings. Engineer French said that he has sent for copies of the Uniform Building Code which within its covers does cover accessory buildings. He said he will probably..recommend it for adoption. I W~ll Gariss, Community Action Council Director, was introduced from the audiance. He told the council that as of August )lst their funding will be ended. He said the cities and counties have the option to continue Community Action programs under their own financing. He said he is meeting with the County Commissioners to explain the programs to them and asked the City Council to join them. It was agreed to meet with Mr. Gariss, Tuesday, March 13th at 7:00 P.M. at the Recreation Center.
