MINUTES OF THE REGULAR SESSION OF JANUARY 16, 122~ Port Townsend, Washington 8 The City Counêil of the City of Port Townsend, met in regular session this 16th day of January 1973, in the council chambers of the City Hall. Mayor Steve presiding. ROLL CALL . Officers and members present were as follows: Mayor Steve, City Attorney Abrahé~, City Clerk Youngblood, Councilmen Scheyer, Camfield, Rosbach, Saijli. Councilmen Hufford, Judy, Hoglund, absent. . MIMUTES: OF THE PREVIOUS SESSION I It was moved by Councilman Camfield, seconded by Councilman Scheyer, that the minutes of the previous session be dispensed with. Motion carried. Motion carried. 8 COMMUNICATIONS The following communication was presented and acted upon as follows: From: Wm. A. Eaton, Port Townsend, Wn. Jan. 2,1973 City of Port Townsend City Council Gentlemen: I Enough is enough. I do not mind paying my fair share of the utilities but in the last two years they have almost doubled and I believe it is time to consider. During the months from May through October the Motel does utilize the city facilities but from November through April the use is not much more than that of a private home. I am requisting that during the months of November through April you consider cutting my utility bill by fifty percent. Sincerely Wm. A. Eaton Mayor Steve commented that it would be illegal it cut someones utilities in half, and after some discussion, Mayor Steve referred the request to the Sewer Supt. COMMITTEE REPORTS 8 Attorney Abraham said that the fire chief had talked to him severall times about fire protection at Fort Worden, and the chief has been negotiating with the Parks and Recreation Commission people, and at the chiefs request he had proposed a letter to the Parks and Recreatign Commission, which would constitute a proDosal from the city for fire protection for the sum of eight hundred fifty dollars per annum, on a year-toyear basis and subject to negotiation for each subsequent year. Attorney Abraham asked for the reading of the memorandum that he had prepared. TO: WASHINGTON STATE PARKS AND RECREATION COMMISSION FROM: CITY OF PORT TOWNSEND, WASHINGTON SUBJECT: FORT WORDEN STATE PARK, FIRE PROTECTION I The undersigned, Mayor of the City of Port Townsendj by motion duly and regularly passed by the City Council of the City of Port Townsend on January 16,1973, is authorized to submit to the ~~shingto~ State Parks and Recreation Commission an offer to provide fire protection, and all other services provided b~ the Port Townsend Fire Department to the City of Port Townsend, for fire protection and emergency service at Fort Worden State Park in Port Townsend, Washington, for a consideration of Eight Hundred Fifty Dollars (850.00) per annum, on a year-to- year basis, said sum being payable in advance, and to be subject to negotiation fer each subsequent year. Endorsement of this memorandum by authorized representative of the Washington ~.tate Parks and Recreation Commission shall constitute a binding agreement, when accompanied with the aforesaid annual payment in advance, and the City of Port Townsend Fire Department shall thereafter undertake to provide all fire protection and emergency services normally provided for other portions of the City of Port Townse,nd to Fort Worden State Park. I JOSEPH B. STEVE: Mayor of City of Port Townsend Engineer French, mentioned that in the past, the fire department was not allowed to go on the property for hydrant inspection and felt that the fire department should be able to. Chief Jones said that the department of insti tutions had their own people, they did the:i:r own maintenance on the water sJ'stem, all they wanted was the man power to put fires out. The State Park, all they want now is to hold negotiations, he did not know just how much work they wanted done by the fire department. After some further discussion, Councilman Camfield made a motion seconded by Councilman Shali that the proposed memorandum be approved. Motion carried. 8 Mayor Steve said that he had heard the port commission had criticized the city because of the condition of city streets at the Port project, he said that we did someth ng about the water and seHer problems down there, mostly for the benefit of the Port Commission. Engineer French said that he had told th€! co~mission that the contractor was to fix up the streets as good ~s before the project was started and also told them that the streets in question might be fixed in ten years, depending upon priori ties and limited funding. May01' Steve also said that he was going to tell the port that they did not need an airport. Motion carried. BID QPENING Mayor Steve, called for the bid opening on a sewer jet pump, the following bid was presented and acted upon as follows: I Sahlberg, Equipment, Inc. 5950 Fourth Ave. South Seattle, Wn. 98108 Total Bid $10,433.65 Mayor Steve asked the City Engineer and Street SUDt. to check the bid. Mayor Steve announced that he had re-apryointed Kay Miner and Harry Deits to the city planning commission and had written letters to both. Mr Miner and Mr Deits both being in the audience said they would accept the re- appofunment. 8 PUBLIC HEARING Mayor Steve said that the Public Hearing was now open on the variance request submitted by Fred Lester to allow an overhang on a carport from five feet to four feet. Mr Ed May, member of the planning commission said that the board had approved the request of Mr Lester. mtaring no objection from the audience, Mayor Steve asked the council for action. It wag moved by Councilman Sahli seconded by Councilman Rosbach that the variance request by Fred Lester be approved. Motion carried. PUBLIC HEARING Mayor Steve said that the Public Hearing was now open on the variance request by Mr. George H. Brunner for a set back variance from twenty feet to Fifteen feet. Mr Ed May member of the planning commission said that the board had approved the reques of Mr. Brunner. Hearing no objections from the audience, Mayor Steve asked the council for action. It was moved b¡ Councilman Camfield seconoced by Councilman Scheyer that the set back request of Mr George H. Brunner be approved. Motion carried. I NEW BUSINESS A request for a variance by Russell Smith for a set back to within two feet of the property line. Engineer French stated that it was the intent of Mr Smith was to construct a plastic covered frame to be used in aqua culture for raising tomatoes with a fluid-type fertilizer, he told the council that Mr Smith had assured him that this is not a commercial venture and he had informed Mr Smith if it should ever become commercial, he would have to move the operation. Engineer French said thatfufus type of nursery is permitted in an Rl zone. Mayor Steve referred the request to the Planning Commission and set a public hearing on the 26th of February. RESOLUTION NO. 73-2 8 The following resolution was read and acted upon as follows: A RESOLUTION OF THE CITY OF PORT TOWNSEND, WASH- INGTON, DIRECTING THE MAYOR OF THE CITY OF PORT TOWNSEND, WASHINGTON TO ADVISE ALL APPROPRIATE STATE, COUNTY AND MUNICIPAL AGENCIES OF THE OPPOSITION OF THE CITY OF PORT TOWNSEND, WASHINGTON, TO ANY CHANGE IN THE STATE LAW WHICH WOULD ESTABLISH A SYSTEM OF REGIONAL LIBRARIES THROUGHOUT THE STATE OF WASHINGTO~ THAT WOULD JEOPARDIZE AND TAKE AWAY THE JURISDICTION AND CONTROL OF MUNICIPAL LIBRARY SYSTEMS FROM VARImS CITIES THROUGHOUT THE STATE. I Madge Wallin, city libr~rian, spoke on the resolution, saying she had submitted it through the city attorney following a December Board of Directors meeting where the proposed ligislation had been discussed. She said the directors felt the proposed legislation was not in the best interøst of local residents and if enacted into law it would mandate state control of your library. Mrs Wallin, in support of the resolution,read excerpts from Seattle newspaper editorials and other news paper editorials. She also stated that the Friends of the Library organization were also opposing pf the passage of HB 170. Mr Frank Kifuham, member of the library boarà, asked to speak, say~ng that he was acting president of the library board and that he was unaware of the resolution, that the board did not meet and discuss the issue and that there was another side of the story and asked that passage of the resolution be tabled. After some further discussion, Mayor Steve tagled the resolution until the next regular session. I I I ,\ 42H r MINU.TE8-0E THE REGULAR SESSION OE JANUARY 1.6_,J.9-'1-3-, CONTINUED ACCEPTANCE OF JET PUMP BID Engineer French said that the bid of Sahlberg, Equipment, Inc. of $10,433.65 was in order that it hadm met the bid spJcifications. Supt. Hawley was asked if he had the jet pump already, the answer was yes for a few weeks. It was.!moved by Councilman Sahli seconded by Councilman Camfield that the bid of Sahlberg, Equipment, Inc. for the J~tTP\fmp for $10,433.65 be accepted. Motion carried. ':. .., . , ¡ Engineer French announced that there was going to be a meeting of the Shore LinE: Management Advisory Commission at 8:00 pm at the county court house and would like very much if the Mayor, Chairmé.n of the Planning Commission ~nd as many councilmen attend as possible, it would be a combined meeting along with the county commissioners. Councilman Scheyer said that Conncilman Hoglund had asked him to make a motion to accept his resignation, at that, Councilman Scheyer made a motion to accept Councilman Hoglunds resignation. Mayor Steve said he would prefer to wait longer before accepting the resignation ,in the hopes something would change Initiatiùe 276 requirements. There was not a second to the motion. ADJOURNMENT As there was no further business to come before the council at this time, it was moved by Counc~lman Camfield seconded by Councilman Rosbach that the meeting do now adjourn. COMMUNICATIONS The following communications were presented and acted upon as follows: To: The Honorable Mayor Joseph B. Steve Members of the Port Townsend ~ity Council Subject: Request for the enactment of a resolution opposing the Statewide System of Librzries now before the Legislature in the form of HBl70 Senate B2166 The Board of Trustees of the Port Townsend Library met on January 18th to discuss the subject proposal. Members present were Namely: Fr. Frank Kilham, Mr. Gerald Barnhart, Mr. Gael Stuart and Mrs Wilbur Harms, Librarian Madge Wallin and Members of the Public. A vote was taken to ask the City Council to pass aresolution in opposition to thi~: legislation. votes against the legislation, one proponent, and Mrs. Crist voting by phone. There were 4 Therefor we requ~st your support of resolution No. 73-2, authorizing expression of' opposition to any change in state law which would enact a' Statewide system of libraries throughout the State (If Washington, that would jeopar- dize and take away the jurisdiction and control of municipal1ibrary systems from various cities throughout the state.
