ROLL CALL Officers and members present were as follows: mayor Steve, City Attorney Abraham, City Engineer French, Deputy Clerk Pedersen and Councilmen Hoglund, Judy, Camfield, Rosbach, Hufford. Councilman Sahli was absent and Councilman Scheyer came in after the roll call. mINUTES or THE PREVIOUS SESSION minutes of the previous session were presented and it was moved by Councilman Hoglund, seconded by Council- man July that the reading of the minutes be dispensed with. motion carried. I I . , 8 . ... e} ,J¡:--; ., d;1, ) mINUTES OF THE REGULAR SESSION OF AUGUST 1, 1972, CONTINUED 8 commITTEE REPORTS I City Engineer French reported on the Rrogress of the Woodman's Gulch Project.. He stated that the contracts have been signed for the furnishing, installation and inspection of the pipe. ~he Robert A~ Hunt Company'will inspect the pipe at $2.90 per ton or about l2Ø to l4Ø a foot. mr. Gunstone 'will be 'paid for 10 trees within the easement that will have to be removed in order tq provide acess for the equipment4 Cathotic bonding was over- looked and he said he instruct~d the City Treasurer to inform the Seattle bank to reduce the inspection fees by $1,500 and add one line item of $1,500 for cathtic inspection. He stated the project should be in full swing i~ 10 to 15 days. There is $137,00 total available money for the project and the estimate of the project is $130,pOo. Crown Zellerbach engineer Harr~ Diets estimates that their inspection fee should not run over $1,000. mayor Steve stated he would 'like to set a dat'e for the open house to show thl3 newly reAovated City Hall to the citizens. mr. French stated he had received a call from an EDA official who asked if the open house could be August 13th, since all Seattle officals could be herethën. The date was set for August 13th at¿2:oo p.m. BID OPENING As it was 8:00 p.m. the bids were opened for the improvement of .17 miles of Lawrence St. between Walker and Kearney Sts. The bids were as follows: I NORTH KITSAP GRAVEL & ASHALT CO. J.P. SURACE CONSTRUCTION CO. $38,778.20 38,776.00 The City Engineer and Street Superintendent took the bids' out for fu~ther study. 8 Police Chief Doubek brought up the probfem of garage sales. He said it was difficult to separate the legitimate ones from the illegitimate ones. He said theyhav~ been getting complaints about them ranging from parking problems, zoning, etc. He asked for some guidance from the council as how to handle the situation. City Attorney Abraham stated that the B & o. Ordinance permits casual and isolated sales or' in other words, 'your own goods, and puts no restrictions on how to do it, thus the garage sale is not contrary to the ordinance. What does present the problem is several people banping together to sell or bringing in a stock to sell under the gise of a garage sale. It was the concensus o~ the ~o~riciil that no action need be taken on the problem~ and that perhaps publicity given to the mat~er would be enough to curb abuses of this type of sale. A citizen asked if there was a leash law in Port Townsend. She complained about dogs in her neighborhood that were keeping her awake at night. The City Attorney stated that we have no leash law büt there were various- ordinance that might apply such as declaring them a nuisance.. He stated that just saying' .something is a nuisance does not make it so. It is a possible course o~ action- but ff difficult one. Discussion fo~lowed about a leash law. The City Attorney suggested that the citizen come and tal~ to him about the problem. I City Engineer French recommended acceptirigthe. bid of j.P. Surace on the Lawrence Street; Project since the North Kitsap Gravel. & Asphalt Co. had an- error of $5,362.50 in the extension of a unit price fro pipe. It was moved by Councilman Hoglund, seconded by Councilman Rosbach that the bid of J~P; 5Urace for the Lawrence Street Project be accepted. motion ~arried. RUBLIC HEARING The public hearing on the variance request for Grady_Cook at 1424 Garfield Street was opened. An abutting property owner asked if the variance were granted how it would affect them if they wanted to build on the rear of th~ir property. mr. French stated she would have to build 20 feet away and that if she wished to build closer she would need a variance. Action on this request had been held óver from the' June 1972 ~eeting to allow the Commissioners to visist and view the site in question. . . I The Port Townsend planning Commission wishes to recommend to the City Council to grant the request of ' mr. & mrs. Grady Cook for a variance to the zoning ordinance at their property located at 1424 Garfield Street. /s/ Kay miner, Chairman Port Townsend Planning Commission I Councilman Hufford moved to grant the variance. It was seconded by Councilman Judy. Councilman Hufford ~nd Judy then withdrew their motion and second. Councilman Hufford moved to grant the variance under the provisions of section 6.10 of the zoning ordinance. It was seconded by Councilman Judy and p:3ssed. . ,. -, ".. - . . - , ., . ORDINANCE NO. 1651 . " . .,. . " . 'H , . , - - . -, - , . The following ordinance was brought on the floor and read for the first time: .... ORDINANCE NO. 1651 I AN ORDINANCE AmENDING ORDINANCE NO. 1625, BY THE ADDITION or SECTION 2.109 THERETO. This is an ordinance amending the zoning ordinance to allow compressed air as a conditional use in all zones. It was moved by Councilman Hoglund, seconded by Councilman Judy that the first reading by considered the second and the third reading be by title only. motion carried. Ordinance No. 1651 was read again for the third time by title only. It was moved by Councilman Hoglund, seconded by Councilman Judy that Ordinance No. 1651 be adopted. Motion carried. NEUJ BUSINESS I The following resolution was presented: RESOLUTION NO. 72-17 A RESOLUTION DESIGNATING THAT PORTION OF JEFFERSON STREET LYING BETUJEEN KEARNEY STREET AND SIMS UJAY AN ARTERIAL STREET. I Mayor Steve explained that this resolution was drafted in order to eliminate a bottleneck on the State highway. City Engineer French stated that this resolution is required so that the Street Superintendent can use half cent gas tax monies for improvement of the street. He explained that half cent gas tax monies cannot be used unless the street is declared an arterial and put on the six yeartarterial street program. He stated that if the resolution is passed it would be submitted to the state for approval. Councilman Hoglund moved that the resolution be adopted. It was seconded by Councilman Camfield. The vote was 5 yees and 2 absent and the motion carried. The following ordinances were presented and read for the first time: ORDINANCE NO. 1652 8 AN ORDINANCE APPROPRIATING THE SUM OF 13000.00 TO CAPITAL OUTLAY IN THE 1972 BUDGET OF THE FIRE DEPARTMENT, AND DECLARING AN EMERGENCY. The Deputy Clerk explained that last year the Fire Department had money budgeted for new fire hydrants. They were ordered but were not delivered until this year so this ordinance was to put the money back in the Fire Department budget to pay for them. Because of the nat~re of this ordinance it ~ill be held over to the naxt meeting. ORDINANCE NO. 1653 - AN ORDINANCE APPROPRIATING THE SUM OF 11500.00 TO THE 1972 BUDGET OF THE CITY, CLERK, FOR PUBLISHING AND CODIFICATION EXPENSE; AND DECLARING AN EMERGENCY. The Deputy Clerk explained this was necessary to cover the expense of having the Zoning Ordinance codified. of the nature of this ordinance it will be held over to the next meeting. Because I CONDITIONAL USE PERMIT Councilman Hoglund moved that the hearing on the conditional use permit request of Ralph UJatson' be reopened. It was seconded by Councilman Camfield and pa3sed. There .was no comment from the public but there was discussion from the council concerning conditions to be attached to the conditional use permit. The hearing was closed after this discussion. ~ouncilman Hoglund moved that a conditional use permit be granted to Mr. UJatson for purpose of using an air compressor at his home at Reed & Monroe subject to the conditions of storing not ~ore than 6,000 cubic feet of air, that state inspections be conducted pursuant to the laws applicable to similar operations and that the conditional use permit be granted for a period of bne year. It was ~conded by Councilman Hufford and passed. Councilman Hufford asked if the paper would give some publicity to the fact that the council is going to request that the Humane Society check dogs for licenses and enforce the female dog legislation presently on the books. 8 ADJOURNMENT As there was no further business to come before the council at this time 't was moved by Councilman Rosbach, seconded by Councilman Scheyer that the meeting do now adjourn.
