Mayor Smith presiding. ROLL CALL Officers and members present were as follows: Mayor Smith, City Attorney Abraham, Deputy City Clerk Pedersen, Councilmen Hoglund, Camfield, Steve and Norwood. MINUTES OF THE PREVIOUS SESSION I Minutes of the previous session was brought upon the floor, and it was moved by Councilman Hoglund, seconded by Councilman Steve that the minutes of the previous session be dispensed with. Motion carried. BILLS & CLAIMS The following bill was presented and acted upon as follows: CURRENT EXPENSE FUND--------------------Voucher No. 8372-~---------------$33.00 I It was moved by Coucilman Hoglund, seconded by Councilman Camfield that the bills and claims be approved as read and that the Mayor and City Clerk draw the warrant upon the proper fund for payment of same. Motion carried. COMMUNICATIONS The following communications were presented and acted upon as follows: From: Re:. To: Elsie Barton and Jeanne Barton, 1237 Clay Request for variance Board of Adjustment, City of Port Townsend 8 We wish to apply for a variance according to the regulations of the recently adopted Comprehensive Zoning Ordinance of the City of Port Townsend for a wooden deck extending to the property line 22 feet along Harrison Street (the side yar of our home) and for erecting walls around a former woodshed 3t feet by 7t feet, which also extends to the property line on that same side. In regard to the shed, it was part of a structure erected in 1961 and was merely enclosed with fencing, although there was a roof over. We need more garden shed space and feel this is the most economical and least detracting way to add on. Before and after sketches are appended. The reasons for the deck were several: to rid ourselves of a disappointing piece of lawn because of a lot of clay in the soil, to take advantage of the most protected corner of our property for "outdoor living," and to enhance the use of our property. We hired Paul Anderson, contractor, of Port Ludlow to do the work, which he 15,1971.. He subsequently (between July 22 and August 13,1971) erected a fence along the deck, and to the property line on the Harrison Street side, across the the back of our house on the other side of the lot. We hired Andrew Longmire of Chimacum on July 21,1971, to survey the property lines before constructing the fence. Unknown to us, Mr. Anderson did not secure a building permit, nor did we, assuming he had done so. On the morning of August 4, a gentleman whom we later found out was Mr. Roger French, appreared and told us our deck was in violation of the city's setback ordinance, and that we would have to apply for a variance. At that time he also told Mr. Anderson, who had begun construction of the fence, that he would have to stop building the fence; but after numerous telephone calls and two trips to City Hall, we found that the building of the fence could proceed. Mr. Anderson applied for a permit for the fence. Also at that time he secured a contractor's license. All work was completed on August 13, appropriately enough, a Friday. In respect to our application, and considering the items of Section 6.10 of the Comprehensive Zoning Ordinance, we submit the following: 1. The proposed variance will not amount to a rezone nor constitute change in the district bounderies shown on the m~p. 2. Special conditions and circumstances do not result from the actions of the applicants, since all the other houses on the block have structures which extend beyond the five-foot setback; and many of the structures abut onto the property line. 3. Because of the conditions mentioned above, we are not asking for a special privilege denied other lands in the same district. 4. The deck is really very attractive; indeed, because of the slope of the land and the way the fence steps down the slope, removal of the five feet would leave an unusable gap. The shed is not a jerry-built structure - we tried to make it look like an extension of the house - and is actually now merely enclosed by solid walls, whereas before it was enclosed with fencing. As a result we do not feel that either structure is in any way detrimental to the public welfare nor injurious to the property or improvements in the vicinity. 5. No one's view is blocked in any way by the additions, except into our back yard; and the structures are set well back from the corner of Clay and Harrison Streets so that motorists are not hindered. 6. Consultation with our neighbors has elicited their apDroval of the project. To: Mayor Smith and Members of the City Council, July 23,1971 The need has existed over a long period of time for a 6-inch water main extending out 14th Street, down Discovery Road to the City Limits. . The water supply at present is woefully inadequate or non-existent, and improved service is needed both for home use and fire protection. Planned future development also depends on installation of this main. This project has been mentioned occasionally in the Water Department, and at City Council meetings, but no action has been taken. Is it possible that a compulsory (1) Local Improvement District could be formed to provide this much- needed service for present home-owners and others who might build in the area if water were available 1 8 Sincerely yours, /s/ Oliver F. NEW BUSINESS A petition for a street vacation was presented. I To the City Council of the City of Port Townsend, Washington: The petitioners, Tony Eronimo and Mabel Eronimo, husband and wife, being owners of all lands upon the portion of City street hereinafter mentioned, here and hereby respectfullJ' petition and request that the City Council, after due notice given and hearing had, vacate That portion of Jackman Street lying between Hastings Avenue and 29th Street. Another request for a variance was presented to the Council. From: To: Burdette Redding, 1520 Lawrence St. To the Council as Board of Adjustment 8 Because of positioning of house and garage on our lots, our only parking area for car and truck are drive way and street, as of now. I propose installing a concrete or macadam slab between garage and side walk, preferably with roof, large enough for automobile and truck and eventually a trailer. See sketch attached. ,Mayor Smith scheduled a public hearing on this request for September 7th, 1971. I Mayor Smith brought before the Council the 6 Year Street Program. required and set it for September 7,1971. Ci ty Attorney Abra:,ham advised the Council that the City received $6.65 from the Chloro-Alkali Anti- Trust Suit. He stated that there was approximately $300.00 left after settlement which was divided among~ the participating parties and this was our share. Councilman Camfield moved that the check be deposited in the Water-Sewer Fund. It was seconded by Councilman Steve and the motion carried. .
