The City Council of the City of Port Townsend met in regular session this 20th day of April 1971 at 7:30 p.m in the council chambers of t he City Hall. Mayor Smith presiding. ROLL CALL Officers and members present were as follows: Mayor Smith, Cit~ Attorney Abraham, City Clerk Youngblood, Councilmen Norwood, Lindsey, Steve, Camfield, Judy, Scheyer, Councilman Hoglund absent. MINUTES OF THE PREVIOUS SESSION The minutes of the previo'ls session were read in full and it was moved by Councilman Judy seconded by Councilman Steve that the minutes be approved as read and that the Mayor and City Clerk sign same. Motion carried. C OMrmNI CAT IONS The following communication was presented and acted upon as follows: The Mayor of Port Townsend, City Council of Port Townsend, Chief of Police, Port Townsend, County Commissioners, Jefferson Sheriff, Jefferson County, Ehe Editor, The Leader: County, The undersignod residents living on Hastings Avenue sincerely request the attention and assistance of your good offices in the serious matter of controlling speeding cars and trucks on our street. We consider the above a grave matter which threatens the lives of our families. Hastings Kvenue is no longer a country road with nobody on it. From Sheridan Avenue West on Hastings and it immediate feeder roads at last count there were no less than 38 residences and at least 60 children of varying ages. Children here frequently have guests. It is a major schÅ“ol bus route. More homes are now being.built. It is also a major horse route to out of town riding trails. .. As you know, Hastings Avenue is narrow, with no shoulders to speak of. The rolling terrain of the road creates many blind spots. Pet animals have already been killed or injured. Riders--both bicyle and horse---have been driven into the ditch or deliberat~y frightened by motorists. There are peel out marks from one end to the other. The sppding is by no means limited to teen-agers. . While we realize that the city and county law enforcement staffs are must be someway to cope with this dangereus situation. Whatever the immediate help before the life of a child, parrent or elderly person undermanned, still there solution, we earnestly ask for is lost. Mayor Smith said the problem has been discussed with the chief of police, and that the police department will work on the problem as hard as they can. Councilman Lindsey commented that what he has seen, part of the people who signed the letter, if they were checked out, it would be found out that they were doing the most speeding. CO~dITTEE REPORTS Councilman Lindsey said the street committee was .opposed to lensing a portion of water street to Mobile Oil Co. Councilman Nørwood said she had checked the street and to see if it would endanger the city in anyway if this small strip was leased. She said she thought it would ~ià a business that has been a benefit to this community and would like to askc the street committee to reconsider. After some discussion and tempers flared, Mayor Smit~ said he would delay the subject for later discussion. Councilman Judy reported that the DeLeo water line had been completed. Councilman Lindsey said it was getting close to the time for bids for Sheridan Avenue from 14th street to 19th street and also to put a one inch overlay from the bottom of 19th street to Walker street. Mayor Smith asked if if hadnt been put in the specs in the last project on Blaine street, sa)ring in other words when the work was done we didnt put as much on as should be. Councilman Linàsey said we never got around to do it, it should go on there to finish it off like Monroe Street. OLD BUSINESS Under old business the city clerk brought upon the floor Emergency Ordinance No. 1618 which is duly incorporated in the minutes of the previous session, for either passage or rejection. The City Clerk again read Ordinance No. 1618, and it was moved by Councilman Lindsey secondeè by Councilman Camfielà that Ord. NQ~ 1618 had been read for the first and second time ana that the third reading be by title only. Motion carried. PASSAGE OF ORDINANCE NO. 1618 Oràinance No. 1618 was ag~in read for the third time by title only, and it was m~ved by Councilman Lindsey seconded by Councilman Steve that the ordinance be now adepteà. Metion carrieà. Mayor Smith brought again upon the floor the requested lease of a 12'X55' stnip' of land along water street by the Mobil Bulk Plant. Mayor Smith said he could not feel that the citys interest could be served by leasing any portion of the street but on the other hand he was not opposeà to a concrete slab on the 12' strip toward the bulk þlant. Councilm~ steve said there shouldnt be any problem, the 12' would be ~b9~t the size of a sidewalk and parking strip, why cant we go ahead and authorize Mr Pedersen in someway to go ahead and build the slab without a lease but with some assurance that they can have it there to whatever length of time they want. 8 I I 8 I ~e I I 8 31'7 , , ,..- MINUTES OF THE REGULAR SESSION OF APRIL 20,1971, CONTINUED , - ,,- I Engineer French suggested the city vacate a 12' strip all along thu.t portion of Water street so that it would go on the tax; rolls. Councilman Lindsey said he would like to make a further study on the situation, that he was against leasing of any streets. Councilman Norwood made a motion seconded by Councilman Judy that the city grant a lease to the Mobil Oil Co. for the requested 12'X55' for ten years at $50.00 per year. Upon the question, and further discussion concerning the heigth of the slab, the liability that might go against the city and etc, and upon the liability question Mr Pedersen said that they would assume any and all financial and insurance liability and ]~esponsibilitmes concerning the slab. ' Councilman Norwood said she would withdraw her original motion, Councilman Judy withdrew his second, Councilman Norwood made a motion seconded by Councilman Lindsey that the city attorney be authorized to draw up a document, whether it be an ordinance, an agreement, lease, or what ever he sees fit to present to the council at the next council meeting, granting a lease or other legal permission to use the 12'K:5:5' as requested in their lettl3r to us on water & Sims Way, incorporating a release from liability in case of any accident or any liability that might be presented to the city. Motion carried. 8 I NEW BUSINE~S REQ1ÆST FOR STREEl' LIGHT \ ' ,\ The request for a street was presented and acted upon as follows: The Honorable Mayer and City Council City of Port Townsend, Ci ty Hall Port Townsend, Washington < ( Dear Sirs and Madam: ¡ There is a matter that I think should be brought to your attention and I know of no better way to do it than by means of this letter. The existing st:f\eet light on Blaine between VanBuren and Harrison Streets, almost directly opposi te the front door of the Catholic Church, is probably out of o:r>der more times than it is in working order. When the light is not on the area is extremely dark and even when it is working it does not give much light. Therefore I would like to respectfully .request that èonsideration be given of a mercury vapor light at that particular location.' The installation of certainly brighten the area and cut down on vandalism. Also it would be a are evening services. ' If you can remedy the situation it will be greatly appreciated, not only by the undersigned, but by all the memb~rs of this Parish. to the installation such a light would great aid when there :8 ;:1 'I Respectfú]y yours, Arthur J. ': ORDINANCE NO. 1619 /, The following ordinance was submitted and acted upon as follows: AN ORDINANCE ADOPTING A PORTION OF THE APPENDIX OF THE 1967 EDITION OF THE NATIONAL BUILDING CODE REGARDING PROVISIONS FOR WOOD FRAME CONSTRUCTION, HEAT AND VENTILATING APPLIANCES, WOOD ROOFING AND FOOTING DESIGN AND SOIL TEST. 8 Mayor Smith said that his WaS brought about the fact that the original ordinance adopting the code, we thought we had adopted the whole thing but have run into the fact the appendices have to be adopted pacificily by ordinance also. Attorney Abraham said that these are not all the appendices, one reason is that some parts we are not equiped to handle. Mayor Smith said he would recommend passing of the ordinance. After some discussion Councilman Scheyer made a motio seconded by Councilman Steve that the first reading be considered the second reading: and the third reading be by title only. Motion carried. PASSAGE OF ORDINANCE NO. 1619 I Ordinance No. 1619 was again read for the third time by title ably and it was moved by Councilman Judy seconded by Councilman Steve that Ordinance No. 1619 be now adopted. Motion carried. ~ ORDINANCE NO. 1.620 AN ORDINANCE AMENDING SECTION 21 OF ORDINANCE NO. 1110 I THE CITY COlmCIL OF THE CITY OF PORT TOVmSEND, IN REGULAR SESSION ASSEMBLED, DUE ORDAIN AS FOLLOWS: Section 1. 'Section 21 of Ordinance No.'lllO, passed in 1939, and amended by Ordinance No. 1380 and 1453, be and the same is hereby amended by the addition thereto of sub section '~(7)" as follows: , "7" as to any mobile home park in which the real property is not owned or leased for a period of more than, one month by the occupant of the mobile homes located in said park, all charges shall be my metered rates as set forth in Section 22 of Ordinance No. 1110." Attorney Abraham said the situation has been up before, the owner of the Mobile Home Park, his presecessor for many years was on metered water, then recently was nut on the household r~te, the existing ordinance and this ordinance has been in effect as to this portioó at least since 1939. He said what the water department is now doing is correct under the ordinance, what they were doing before was incorrect, he said that now everyting is under one sytem, the store, home, mobile homes, etc.i-He'said./llma:Þ.tb:i:s amounts to, he will have to rebuild his water system to comply with the ordinance as it now stands. Councilman Norwood asked if the ordinance couldnt be referred to the water committee, she said no one was present from the water department and would like to talk to the water Supt. before she made a decision. Mayor Smity said this could be deferred, he didnt know what the rate of payment has been, he is behind in his payments to the city. Councilman Judy said that the water bill isnt as large as it sounds, he said they had a meeting with this man, the man is delinquent in paying his monies to the city. After some further discussion, Mayor Smith fe~erred the ordinance and situation tÐ the water committee for further study. Mayor 8mit~ said he had put the zoning on the agenda for tonight, going over it with the City Attorney to get the sequence of events down, the zoning ordinance has been passed to the city council by the planning commission, the city council can pass the ordinance, they can modify the ordinance, reject it, there is nothing in the law requiring reference back to the planning commission, the~e is no legal requirement for a public hearing but felt the public é'n ~ shoulà be well aware of what the council thinks as it goes almng. The ordinance as submitteQ would from a practical standpoint require some dodification, while an ideal zoning ordinance, there were special features of the city which made it impractical from the enforcement stand- point that would apply in a lot of cases in the ci~. Councilman Steve said he would recommend that the cQuncil proceed with the Mayors recommendation and changes that been worked out and agreed during the working sessions and as far as the board of adjustments, the city council meets here twice a month and could act as the board of adjust~ ments, that they were elected on the assumption that any approved zoning would be to the public liking and that citizens seeking redress, know that they can always jump on their elected represenatives. Councilman Lindsey said he favored the councils revised version of the oràinance but would like to have a public hearing. Councilman Scheyer favored a vote on the ordinance as reviseQ by the council. Planning Commission Chairman" Kay Miner, suggested that rather than writing the board of ~djustments out of the ordinance, the matter be made permissive, allowing the council either to act as or designate such a board. After some further discussion, Mayor Smith placed the zoning ordinance on the agenda for the 18th of May. Councilman Norwood read a heusè'.:f,loor resolution, 7l- 62 adopted by the house of represenatives April 17, 1971, wishing Psrt Townsend a happy l20th bisthday. ADJOURNMENT As there WaS no further business to come before the council at this time, it was moved by Councilman Judy seconded by Councilman Lindsey that the meeting do now adjeurn.
