I The City Council of the City of Port Townsend, met in regular session this 6th day of April 1971 at 7:30 p.m. in the council chambers of the city hall. Mayor Smith presiding. POLICE REPORT The police report WaS read in full for the Month ~f ~arch 1971 and was ordered filed. 8 COMMUNICATIONS The following communications were presented and acted upon as follows: From James A. DeLeo Port Townsend, Wn. March 15, 1971 to-wit: Hon. Mayor Frank Smith and City Council Port TÐwnsend, Wn. Gentlemen: I After lengthy discussions with fellow members of the Fire Department during our March 8,1971 meeting, it was unanimously concluded that re~uest be made to terminate the official p~sitiJn ef Volunteer Fire Chief, in conjunction with the retirement of Ed Lindsey. In my capacity as Assistant Volunteer Fire'Chief, donating twenty years of service and observing the mechanics of efficient fire protection, it has become apparent that a prominent change in the Supervisory position should be inaugurated. In behalf of my-fellow colleagues in the department, I hereby request the consideration of a full time Fire Chief, in lieu of a part-time Volunteer Fire Chief; thus eliminating one paid employee in the Fire Department under the direction of the Port Townsend City Government. This change would assure a closer tie betw:)en the paid members and the volunteers. The Chief would be the leading authority over both forces, with an Assistant Volunteer Fire Chief acting under the direction of the Chief on behalf of the Volunteers. This proposal would in no way effect the seniority of the present paid men. The senior paid member would assume the title of Assistant Fire Chief, and aid and control in the Chief's absence. Under this leadership, and, the good Lord willing, the City of Port Townsend wold be assure~ full and uninterrupted fire protection for approximately the next fifteen years. DeLeo I 8 Mayor Smith said that with the retirement of Mr Lindsey, he would like to eliminated the part time fire chief and appoint Bob Jones full time chief, but due to having to pay full salary to Mr Lindsey for the next six months it creates a financial problem so would keep this under advisement until a later date. ..-- I - MINUTES OF THE REGULAR SESSION OF APRIL 6,1971, CONTINUED ; From Mrs Awisus l134 Grant, Port Townsend Wh. Mar. 29, 1971 to-wi t: 8 City Council City of Port Townsend: . , Dear Sirs: . I We live at the corner of 12th & Grant Streets in Victorian Village. On the evening of March 12th we parked our car on Grant Street in the area across :from our driveway, when we went out the next morning we -found our car sunk up to the frame in mud. There was no way we could get the car out so we had to call a towing service aqd have it removed, costing us $7.88. I These street have long been" neglected and both my husband & I have called the Mayor, the street department, Mr. Morgan etc. But to no avail. We have been informed that these are ci ty streets supposedly if you can call mud holes city streets." Our taxes go up while we wallow around in mud trying to get into and out of our driveway. "Several weeks ago we came home to find a car stuck in our yard a good 15 feet o:ff off of Grant- street. Apparently someone had tried to avoid the mud hole and chose to drive across our yard but sunk into it instead and then left the car there (it was eventually removed). Since then, several motor scooters and the like have taken to short cutting across our lawn. So in addition to having to pay to get out of the mud ourselves, we are having our yard turned into a thoroughfare and a muddy mess. We pa id our taxes - you fix our streets. If we have' to b.e towed out of that mud one more' . time we will have them bill the city direct. ", ", . From Port Townsend Planning Commission April 3,1971 to-wit: , I Honorable Mayor City Council Members City of Port Townsend At the regular March Meeting of the Port Townsend Planning Commission, the Commissioners entered into discussion' of the proposed Zoning Ordinance for the City of Port Townsend. r I' I I The Port Townsend Planning Commission therefore respectfully renuests early action by the Council on the Zoning Ordinance; and recommends either approval or rejection of the proposed Zoning Ordinance as soon as possible. - Port Townsend Planning Commission Kay Miner, Ac ting Chairman Mayor Smith said he would place the zoning ordinance on the agenda for the next regular session. Councilman Steve suggested another working session of' the" council concerning the zoning ordinance. .. 8 From Port 'rownsend Planning Commission April 3, 1971 to-wit: Honorable Mayor City Council Members City of Port Townsend I At the regular March meeting of the Port Townsend Planning Commission, the Commission took into consideration a letter from the City Engineer, indicating a request has been made-for a variance of the set-back" Ordinance, by Mr. and Mrs. Al Reierson; tò build a garage on their preperty at Lots 1 and 4, Block 35, of the Pettygrove 1st Addition. They offered several reasons in support of the variance request, and also a drawing of he proposed garage at the proposed location. . The Port Townsend Planning Commission would therefore recommend to the City Council to aecept the set-bacl variance of lot 1 and 4, Block 35, of the Pettygrove 1st addition, as requested by Mr. and Mrs. Al Reierson. Olson, Sr. Members of the City Council City of Port Townsend Port Townsend, March 26, 1971 to-wit: 8 Dear Sirs: On the evening of the 23rd of March, while on my way to deliver some books to a mobile home located in Victorian Village, I turned off of Sheridan street onto 12th street heading towards Grant street. I became hopelessly mired in the mud hole that, constitutes the corner of 12th & Grant streets. '..'--.--..---.-------- .,-----.---:-..--",.,----.---,.--------- , , I have since spoken to a member of the city street department and have been informed that these are indeed city streets. When a city street is impassable it is supposed to have a warning posted to alert motorist. Well, the street was impassable and there were no warnings, therefore, I feel the city should pay the resulting towing charge. I, Richard W.Olson, Sr., hereby submit the enclosed towing charge to the city of Port Townsenà. Sincerely; Richard W. Olson, Sr. Taxpayer Mayor Smith said that this was a combination of a letter and and a claim if it could be calle~ B.. claim. Street Sup. Hawley said that his particular street is one which had never been appreved it was a part of the Victorian Village development and was never officially accepted as an epened street. After same discussion, Attorney Abraham suggested that the city install Street Cl@sed signs on such type streets, and said that the claim was not in proper form. BID OPENING The following Bid was opened for the Hancock Street Wateerline Project and acted upon as føllow: ' J.P. Surace Hadlock Wn. $2,500.00 Councilman Steve said he was not to pleased with this project and was not pleased with himself for not checking intotlms more than he had. He said it seems like somebody is taking somebody, he could not understand why the city is going to have to be stuck with an 1,800.00 debt for . lifetime. Councilman 3teve said he dosent know why other property owners should be envolved in Mr Bishops development project in helping by paying his water installation~ The 1,800.00 will never get back into the revolving fund. . Mayor Smith said that the item we are doing right now is opening of the bid, the council approved the project, the council wither had to accept it or reject it. He said the city was supporting this project to a certain extent, we cant do the whole thing and this is the purpese of a revolving fund. Attorney Abraham s.aid the whole purpose Gf this revolving fund Was to enable these water projects put in where it was recognized. He said that the people that did not get on the line at this time did not have to pay at this time, but later on if they tied into the Hancock line they WGuld have to pay the three dollar footage which would go back into the revolving fund and also they would have to pay the hook up charge. . Councilman Norwood said she was on the committee that mat, and as it was presented to them and to other property owners that were eDvolved and who were willing to pay, the committee felt that this was beneficial to the city and that they had enough interested who would pay to make it a worth while project. . After some further discussion, Councilman Norwood made a motion seconded by Councilman Hoglund, that the bid of J.P. Surace for $2,500.00 be accepted. Metion carriei. ORDINANCE NO. 1618 AN ORDINANCE AUTHORIZING AND DIRECTING THE LOAN OF $4,237.50 FROM THE CURRENT EXPENSE FUND TO THE CITY STREET FUND, AT INTEREST OF 5% PER ANNUM OVER SIX YEARS, APPROPRIATING THE SUM OF $4,237.50 TO CAPITAL OUTLAY IN THE 1971 BUDGET OF THE STREET DEPARTMENT AND DECLAR ING AN EMERGENCY. Due to the nature ef Ord. No. 1618 it had to be held over until the next regular session. RESOLUTION 71-5 ARESOLUTION TRANSFERRING THE SUM OF $1,000.00 FROM ROADWAYS TO EQUIPMENT RENTAL IN THE 1971 BUDGET OF THE STREET DEPARTMENT. Councilman Hoglund said that this WaS a month rental for a grader that the street department had. Councilman Heglund made a motion seconded by Councilman Camfiel€l that the resolution he adepted. Motion carried. Mayor Smith said Councilman Hoglund brought up at the last meeting the project of hireing a group of youngsters during the summer. He asked Mr Roy who was associated with the Washington state Parks and Recreation Commission Youth Development and Conservation Corps Pr9gram to speak be£ore the council. Mr Roy gave a brie£ presentation on the program saying it would cost the city around $4,500.00, that only youths who lived in the city limits would be elgiable. He said he would like to get the pregram started by June 21st. Mayor Smith said that nothing could be àaid tonight that the financial situation was sort of in the bind but would have an answer on or before the next regular meeting. Mayor Smith referred the request to the light committee for a report at the next regular session. Gentl amen: Pedersen Oil- Co. respectfully requests your consideration of a proposal to lease a portion of I the street knewn as Water street adjacent to our bulk storage plant between Sims Way and Water Street. I Our request is for a portion of Water Street lying paralles to the road, that portion being 55 feet long and 12 feet wide. The pro¡:e rty in question is presently in the street right-of- way but not developed as street. II The purpose for this request is so that we can remodel our existing bulk plant facilities, to facilitate delivery of bulk product via truck and trailer. The modlfication to our plant will I be both extensive and expensive in nature. The method of delivery ås compared to our present system of water-born barge will also be considerably more expensive. This is being done primarily to protect this community and its citi2;ens from the chance of a dangerous and tragic oil spill. We feel that our industry must accept its role in the protec- tion of our environment, despite the increased costs. By using truck transpprt we will virtually eliminate the hazard 'of - Em-oil spill escaping te Admiralty Inlet, _but to make this possible we must have continued access to this property which will be us'ed to uhload the truck transports located in the city street will be the cement p:¡.d on which the trucks-will park while unloading.- A drain in this pad will direct any spill back int& the confines of our perimeter dike at the bulk plant. - As time goe_s by, other companies will come to the same conclusion a::1 we in this matter and will probably need help from you in a like manner. We are glad that Mobil was one of the first to recognize the p~oblem and take measures to remedy a potentially dangereus situation. Our company is ready to proceed at once with construction and I would on your behalf be rp,ade to give a decision on this matter this evening to a comm:i,ttee. Councilman Steve asked if the present retaining wall around the storage tanks wer.ë up to fire code standards, Mr Pedersen said that the walls conformed to the requirements of the ciW. Mr Pedersen said that all that was needed was a cement slaþ for the trucks to run upon S0 they could unload, Councilman Hoglund said he èould not see the need for a 1 ease. Mayor Smith said he was and always had been against hasty action, so would refer the request to the street committee for a recommendation. ff}. petition for a side-sewer contractors license for J.P. Motion carried. Call For Bids The 6ity Clerk ask~d permission of the council to èall for bids on Liability Insurance c0verage for the city, bids to be opened May 4, 1971-.. It was moved by Councilman Hoglund seconded by CoUncilman Steve that the Ci~ Clerk be authorized to call for bids as requested. Motion carried. Tpe City Clerk informed the council that.Josepþ Minish would reach retirement.age June 1st 1971 and would have to retire unless the council extended his retlr'3ment for one more year. It was moved by Councilman Norwood seconded bý Councilman Hoglund that Joseph Minth retirement be ex~ended for another year. Motion carried.
