Councilman Ruby said that he had talked to Mr. Porter, and that it seems there is an apple t:bee in the street mont:'-oned and it seemed to be f1uite important to Mr. Porter, the street is a dead end street and the property adjoining belongs to the city and felt r~ Porter was ready to make a qeal with the city regarding the purchase of the property. Mayor ~mtth said the felt the city should aquire the property if possible at fair market value, for it would not be to long in the :tluture when the city would have to expand the treatment plant. Councilman Hoglund said he would again contact Mr. Porter on the purchase of the property in question. 0:. BUILDING PERMITS The two building permits were presented and acted upon as follows: Paul Craton; House, Frame:, 59th & Hill:, Block No~50' Lot 5-6:, Cal~ Addn~ SBm Swanson, House, Frame, 59th 2.: Hill, Block No. 50, Lot '7-:-8., Cal. Addn. $12:,000.00. $10,000.00 Engineer Warren, said that the owners of lots five through eight of block 50 of the calif. addn. came in for'~uilding permits, brought along drawings and expressed their interest in getting utilities, he said there VlnS a complication due to the fact that thÐ street the utilities should come down is leased, and it would be a legal matter whether or not the city could have u tili tie~ on the street t;zhile the lease exis ts. A ttorney Abraham said that t:le:e was no provisions for utilities or anything else, ~nd could put nothing in the street until the lease is terminated. Engineer Warren also stated that the lots thenlselves appear to be far to narrow to permit adequate building at this time. Mayor Smith commented that the lots were only 20' wide and 50' long and that the county owned the property in front. }Ær Craton, said that if the street under lease ca~ not be used for utilities, they would agree to put the utilities according to citys specifications on~their own property and when the lease expired they would move the utility lines back on to the street. Counc ilman Hoglund asked if TIr Hall tlsd been contac ted about putting utili ties on the Ie ased street. Mr Swanson said that tj10Y had not contacted far Hall, what they were attempting to do was to get permision to build and would agree to put in utilities according to specifications. He said that the county owned the land in front and was sure the could come to a working agreement with the county to stop erosion of tho property. Af'ter s::>lTIe further discussion it was moved by Councilman Ruby seconded by Councilman Lindsey that th9 building permits be granted with the stipulation that they would put in the utilities according to city specifications Motion carried. Attorney ~braham informed tho council that on build ng permits, construction hnd to begin within six months, it did not state how long it took to complete ths construction once it had been started.
