HomeMy WebLinkAbout02/04/1969 185 MINUTES OF THE REG1JLAR SESSION OF JANUARY 21, 1969 CONTINUED 8 Councilman Lindsey~said that under old business -we were to have a discussion about union contracts, the contracts were to have been received earlier so that each councilmen could go over them, the contracts were not received until this evening. any Councilman Ruby said he wculd like to go over the contracts before making in hasty decision and would suggest holding the contracts up until the council had a chance to study them. Councilman Hoglund said he felt as councilman Ruby did, he hadnt seen the contracts untiib a few minutes ago and felt he was not in the position to pass judgement for or against and suggested that they be held over for study. I A represenative from the union was present and suggested that a meeting be held after the council meeting. After some discussion a decision was .reached that the council and w1iònnmeet after the regular council meeting was over. NEW BUSINESS The following petition was presented and acted upon as follows: I PETITION FOR STREET VACATION 8 The undersigned, who are all of the abutting owners.upon the portion of City Street hereinafter requested to be vacated, here and hereby petition the City Council, after due notice given and hearing on this Petition, to vacated that portion of Rosecrans Street lying between the Northerely boundary of Fourth Street and the Southerly boundary of State Highway No.9, in the Eisenbeis Addition of the City of Port Townsend. Petitioners agree to pay cost of publication of an Ordinance providing for the vacation of said portion of said street, and to the reservation of easements for utilities over, througn and across said portion of street. Lyman M. Ellis Rachel J. Ellis Mayor Smith referred the petition to the street committee and the planning commission to have a report on at the next regular session. MayoÐ.Smith s!åd that he had been asked by the school about the old light stro1dards on Lawrence street, he was informed that the standards had been given to th uptown business2 people. Dear Mayor Smtu and Council Members: 8 As a former resident of Port Townsend and as one who is concerned with your (our) city's future, may I offer my congratulations to all of you to the Planning Commission members, and to the 1'irm of Clark, Coleman & Rupeiks, Inc., upon the completion and presentation of Port Townsend's comprehensive plan. Hopefully, the early implementation 01' this plan can offer those guidelines necessary toward the maintenance of Port Townsend as one of the state's most attractive and historic cities. My compliments and fond best wishes to' all. Respectfull~y , lVLarilou Green Mayor Smith commœnted on a co~y of a letter from Standard Oil Co ~ddDesed to Hill, Ingman Chase & Co. He said that the city had approved a permit for a bulkhead around the Plaza on the approval that it would not interfer with the Standard Oil Dock that is be~ng leased by them~ity He said that Standard Oil would not approve the placing of the fill as planned but did come up with three proposals to Hill, Ingman, Chase and Co. that we~ bemng considered at this time. An Engineer from Sparkman & McLean Co. who is doing the work on the bulkhead said they they weEe going to proceed wi th par.t':;o.r:-thedbulkhead that had notni ng to do with Standard Oil and by the time thät was finished he was sure an agreement could be make with Standard Oil to finish the part in nuestion. I I £;1ayor Smith said that there had been negotiation on union contracts in connection wi th the Po ice Dept. and the Garbage Department, the last negotiating sess.ion was a week ago last tuesday, at w.:lÌch the proposed contracts was gone over by the union and city negotiators. A copy has been given to each councilmen the contracts have been signed by the representatives of the union, the next step is tile signatur:Js bt the Mayor and City Clerk wnich is subject to the approval of the council. He said the chair would now desire the council to make known their views on whether the contracts should be signed or not signed. Councilman Moody made a motion seconded by Councilman Ruby that the contracts be signed. Motion carried. City .Attorney Abraham saiEl he tV) uld have the necessary ordinance at the next regular session. 8 The city clerk read the fo~lowing letter from tie ~àanning Commission and action was taken as follows: Honorable Mayor & Members of the City Cohncil I The Port Townsend Planning Comnission, meeting on Monday, Feb. 3rd, 1969, after due §@fiàideratiQn voted unanimously against the pe ti tion to vacate "portions of Grant, Sixth, eighth, and Wilson streets, all in Eisenbeis Addition to the City of Port Townsend. It is considered opinion of the Planning commission that public access will be needed and developed in the future particularly along 6th street west of Sheridan and also on Wilson 7th & 9th streets. Therefore the Planning Commission recommends against the petition for presented in behalf of St John Hospital by Sister Shir&ey M. Smith. Respectfully Sybmitted E.G. Lindquist, Chairman will be between vacation Mayor Smith said that the renuest for the vacating of above mentioned streets had been turned overbthe Street Committee and the planning colP~ission on wheth~r or not to vacate the streets. Councilman Lindsey said that once before the council hi.ld turned down a petition to vacate the same streets and still felt they should not be vacated. Councilman Lindsey made a motion seconded by Councilman Mo~dy that the request to vacate the steets in nuestion be denied. Motion carmied. On the petition to vacate a portion of Rosecran street by Lyman M. Ellis, the petition duly incorporated in the minutes of the last previous session, the council scheduled a public hearing at a regular council meeting on the 18th of March on the peti ti~)n to vacate a portion of Rosecran street. 8 NEW BUSI NESS Under new business the ci~ clerk informed the council thät the Shell Oil Co. lease expired on March 21,1969, he said that he had been contacted by the Shell Oil çompany who asked if the counc i1 would extend the lease for 9ne year ins tead 01' 'the _ten year per19d. du!!3 to the !"ac t tlia t , they were negotiating with Harper 011 Co. for the sale of the dock Facilltles now under lease. . Councilman Hoglund said that it was not an unreasonable request by Shell Oil Co. and favored a lease for one year as requested. Mayor Smith if there was -no ßb.:jec.t:i:odif:vom;:;thn col..mcil he would now aske the ci ty clerk to contact Shell Oil Co. to tell them thetr request was granted and instructed the City Attorœy to prepare the necessary Ordinance. IlIayor Smi th asked the city clerk to read the following cormmmication from the P'lanning Commission. I Honorable Mayor and Memb ers of the City Counc il On December 16th 1968., the Port Townsend Planning Commission in a public meeting, presented to ci~ officials dnd to the public the Comprehensive Plan for Port Townsend. Subsequently the text of the Comprehensive plan was published and made available to all subscribers of the Port Townsend Leader. , . . . I Every effort has been made all along the way to inform the public of the developments of 0 ur work on the Comprehensive plan and we believe that the completed report, prepared by Clark Coleman and Rupeiks, Inc. is an excellent document which will provièè the guidelines for worthwhile. and meaningful community development'. . The Port Townsend Planning Comnission thereforë wish to present, formally, the Comprehensive plan and we urge the members of the city council to accept the plan through resolution. LindAuist Chairman Mayor Smith said the council has been presented the comprehensive plan, recommended by the planning commission, the next action to be taken would by approving the plan by resolution. He said the plan is a general guide line there are no specific boundaries, specific boundaries would be \vxpressed by the zoning ordinance wltich they are now working on. . . 0 Councilman Hoglund said he had looked the plan over and out side the statiscal portion which he believed was accurate he felt the plan was an excellent one and it is'in the best interest of the city, the best interest of the city would be served if we adopt this plan and the sooner the better. Councilman Siebenbaum asked how close the council planned to stick to the plan, for he felt we were looking at too much green belt, it is taking in to much territory, tying up to'much valuable property, the city of Port Tovmsend dosent have the mnney to develop that size of a park. I Mayor Smith explained that the green belt designation did not mean parks and formal municipal developments. It might mean additional set-back re('1uirements with a certain armmnt of land- scaping. The only way the city cC)uld develop the lànd as parks woud be to own it and did not see us able to buy it in the foreseeable,future, unless someone donated the land to tl~ city. ¡'{¡ayor Smith also cor~men ted tha t you cannot zone private property into a park. Ci tyAttorney Abraham said that the particular area that Couni1man Siebenbaum was talking about, the bulk of that property was owned by the Port Commission along with some private owners, and tte Port, as far as he knew had no intention in making B. park there, they are not in the park business. He also stated that. in the comprehensive plan there were a'couple of fac tual matters in it that he thought should be correc ted, he s aid he vms going to talk to the chairman of the planning commission about it, they are minor, nothing really that had to do with planning, it should be straightened out before adopted. > 8 Councilman Scheyer said he thol~ht what Councilman Sibenbaum was really talking about was the Carroll property not the Port property. He said as a point of interest, he thought thecauncil héid really been misrepresented, right now we are the fall guys because Jack Carroll cannot dev- elope his shopping center, but if his building permit had came upon the council floor he was sure it would have passed, yet-the local press never took the time to sound out what our position really WaS. We had no plan, vlha t we 11would have done would have asked that he landscape the' II property. Right now we are bearing the brunt of this and thought it'was an erroneous impression creatëddby the local press. I After some further discussion, Mayor Smith said that he would continue the comprehensive plan until the next regular session. œhe 6muncil members gave praise to the street and water departments in hanaling the many problems caused by the recent cold weather. . I Consulting Engineers from Hill, Ingman & Chase gave a pitch for their company in case the city of Port Tovmsend decided.to improve any streets under the urban arterial street projecto monies that would be alloted to the city from the state. Mayor Smith said that.the city,got a repeat performance on the clean city award that Mrs Grady did it again it has been the fourth time the city has revei~ed the award. 8 Mayor Smith said that the reques t for retirement for 0 ne fireman had been approved by the board. The re,..,uirements placed on. the Firemen Pension & Relief Fund is going to get heavier as tllle goes on. He said the city is leveying one millfor the fund, the state laws states that an addi tiona1 mill be levied if necessary, the fund needs it an. actural survey will show it. He said last year tl1is came up and went to court for the 2.dditinnal mill, the city lost. He said he thought it only fair and proper for the city to want this mill back again for this year and do everything possbble to get it. City Attorney Abraham said under the circumstances it had better go back to court if neccessL ary; maybey we can get the county to give it up with out going to court. It was the opinfuon of the council thút the city get an acturial survey of the firement pension and relief fund as soon as possible and then proceed to try and get the mill back that the city lost to the county by court action. . Ref: Letter Uptown Business Club to Mayor and City Council dated March 1,1965 We, the undersigned, feel that the Port Townsend School District should be given all of the subject standards, as they will be able to put them to good use and properly maintain same, using the complete unit. We therefore wish to relinquish any right of ownership we may hdve in said standards so that the title may be transferred to the school district. We ask that all of the subject standards be removed at no expense to ourselves, and that we have no further responsibility in regard to same. 8 ,I ¡
