HomeMy WebLinkAbout12-029 Declaring Approximately 4,580 Square Foot Tract Surplus and Setting Sale Terms Resolution 12-029 Page 1 of 2 RESOLUTION NO. 12-029 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON DECLARING AN APPROXIMATELY 4,580 SQUARE FOOT TRACT SURPLUS AND SETTING SALE TERMS RECITALS: A. The City Council determines Assessor Parcel No. 901084006, an approximately 4,580 square foot triangle tract of land(approximately 45' by 200'), is surplus to the City's needs and not needed for utility purposes. The tract was originally acquired in 1929 as part of the Olympic gravity water transmission pipeline. The tract is located in the County in property now platted as Lots 9 and 10 of Mountain View Vista. The tract is currently not used as part of the utility and no one in Public Works has any recollection of it ever being used, or why the parcel may have been obtained in the first place. There is no need for the tract. B. The owners of Lots 9 (Smith) and 10 (Roosevelt and Mallard) have requested by letter dated May 22, 2012 that the City declare the tract surplus. They propose a value of $1,536 for the easement based on the square foot value of two full-sized parcels that recently sold (February, 2012) in the plat, as set forth in their letter. The sales price ($175,000) was considerably less than the assessed value of these parcels ($332,000). C. The assessed value of the Smith's full-sized parcel is $211,410, which would equate to a value of$2,400 for the triangle tract on a square foot basis. Given that the tract has no utility to anyone else, and could not be sold to anyone other than the owners of lots 9 and 10 (that is, there is no commercial market for the property), and given the recent sale at considerably less than assessed value, the Public Works Director and City Attorney believe a value of$2,000 is reasonable, and the owners have agreed. County zoning is 1 dwelling per 20 acres and the City parcel could not realistically be able to be developed as a standalone parcel. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port Townsend as follows: 1. For the reasons set forth in the Recitals, the City Council determines and declares Assessor Parcel No. 901084006 described in the Recitals to be surplus to the City and not needed for utility purposes, the value of the property is $2,000, and a sale to the owners of Lots 9 and 10, Mountain View Vista, Jefferson County for that price is reasonable. 2. The City Manager is authorized to execute all documents necessary to complete a sale as set forth above. The transfer would be by quit claim deed. The deed would state the tract is incorporated into the existing parcels and does not exist as a stand alone parcel after the transfer. Resolution 12-029 Page 2 of 2 3. Sale proceeds will be credited to the Water/Sewer Fund. 4. The owners shall pay all costs in connection with this matter.
