HomeMy WebLinkAbout3077 Amending PTMC Chapter 10.04 Parking Ordinance 3077 Amending PTMC Chapter 10.04 Parking Page 1 of 2 Ordinance No. 3077 AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING THE PORT TOWNSEND MUNICIPAL CODE CHAPTER 10.04 PARKING, AUTHORIZING THE CHIEF OF POLICE TO DESIGNATE NO PARKING AND LIMITED PARKING AREAS AND ESTABLISHING PENALTIES FOR VIOLATIONS RECITALS: A. The City Council detennines it appropriate to update the parking code to provide the Chief of Police, in consultation with the City Manager and Public Works Director, the authority to set parking limits. This approach allows greater flexibility to respond to parking situations. B. Currently, the code sets parking limits by ordinance but also grants the Chief the authority to limit parking in certain situations. The Council determines this dual approach is outmoded and not necessary and does not meet the need for flexibility in responding to parking situations. Other cities (including, Sequim and Poulsbo) do not set parking limits by ordinance but grant the authority to do so to the Chief of Police or Public Works Director. C. The Chief should be able to respond to changing situations without the necessity of a new ordinance designating parking limitations. Flexibility is particularly important where different responses may be tried on a trial basis and then modified as conditions warrant. D. When the Chief of Police makes parking designations under this Ordinance, the Chief shall promptly report to the City Clerk a description and listing of all designations, or change of designations. The Clerk shall maintain a list of such "no parking" areas and limited parking areas, and make the list available for viewing by members of the public, and post and update the list on the City's website. The Clerk shall also promptly transmit such designations and changes to the City Council, which can then determine to take action as appropriate, for example, directing by Resolution that other parking limits should apply. Coincident with the repeal of parking limits set by current code (in connection with the delegation of authority to the Chief to set limits), the Chief will promptly file a description and listing of all current designations with the City Clerk, which the Chief may then thereafter modify consistent with the requirements of the Ordinance. NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows: SECTION 1. Chapter 10.04 Parking of the Port Townsend Municipal Code is hereby amended to read as follows (text in strikeout is deleted, text in underline is added): See Exhibit A (attached) SECTION 2. Severability. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances, is not affected. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law. This Chapter provides rules on parking. It provides: 1. Authority of the Chief of Police to designate no parking and limited parking areas. 2. Impoundment procedures. 3. Enforcement procedures. The provisions of this Chapter are in addition to authority and procedures granted by other statutes, ordinance, rules and regulations. For example, the Washington Model Traffic Ordinance, Chapter 308- 330WAC (Washington Administrative Code), which has been adopted by_(PTMC 10.24.010, contains traffic and parking rules. Exhibit A to Ordinance 3077 Page 2 of 8 Nothing herein precludes the City Council from directing the Chief to establish or change no parking and limited parking areas. 10.04.020 Authority of Chief of Police A. In addition to other authority, the Chief of Police, in consultation with the City Manager and the Public Works Director, is authorized to designate "no parking" areas and limited parking areas, for any of the following reasons: traffic control generally and for events (including for parades); construction site safety including street construction; emergencies, safety or hazard conditions; and conditions related to traffic, nuisance, or impacts from parking, street use, use of City-owned or controlled property, or private uses that affect streets rights of way or City-owned or controlled property. B. Any designation: 1. Shall be properly signed with signage or markings indicating the parking limits or"no parking" areas. Except in an emergency, no parking designation by the Chief shall go into effect until at least 24 hours after being properly signed. In addition, except in an emergency, notice of the designation shall be given to adjacent property owners and the City Council at least 14 days prior to the designation going into effect. 2. May occur on streets or alleys or within rights of way, and on City-owned or controlled property. 3. May include prescribed methods of parking (for example, angle parking). 4. Does not include authority to meter or charge for parking on rights of way(except, the Chief in consultation with the CitV Manager may establish charges for parking on City-owned or controlled property, for example, for special events). C. "City-owned or controlled property" means property owned by the City or which the CitV controls through lease, license or other agreement. 10.04.030 List of Designated "No Parking" Areas and Limited Parking Areas. The Chief of Police shall promptly report to the City Clerk a description and listing of all designations, or change of designations, of"no parking" areas and limited parking areas that are in place for more than one week(except for construction site safetV or street construction areas). The Clerk shall maintain a list of such "no parking" areas and limited parking areas, and make the list available for viewing by member of the public, and post and update the list on the City's website. The Clerk shall also promptly transmit such designations and changes to the City Council. 10.04.040 Parking prohibited. Exhibit A to Ordinance 3077 Page 3of8 When signs or markings are erected giving notice of parking limits, it is unlawful for the owner, or other person in possession of any vehicle, to park or stand, or cause or permit to be parked or stood, such vehicle in violation of the parking limitation. 10.04.050 Impoundment A_10.^�4..142 Impoundment—When—Authority. The chief of police, and his or her designated agents, are empowered to impound motor vehicles for violation of parking designations ordinances other than meter vielatiens and further to impound abandoned vehicles, unlicensed vehicles, vehicles obstructing traffic of any kind, vehicles imposing an immediate danger, vehicles parked on parade routes after posted notice of no parking is given on said route for two hours or more or published notice is given in a weekly newspaper of general circulation once at least five days prior to such parade, vehicles left unattended by reason of the arrest of the operator or owner, and vehicles parked in a "no parking, tow-away zone" space, or in a designated handicapped parking zone under state law, and otherwise as prescribed by law. (Ord. 2000 § 1, 1984; Ord. 1753 § 1, 1976). B. 10.04.146 Impoundment—Expense borne by owner. Impoundment of vehicles for the reasons set forth in PTMC 10.04. shall be at the expense of the owner or operator of the impounded vehicle, and shall be paid by him to the towing or garage company having custody of the vehicle. (Ord. 1753§ 2, 1976). C. 10.04.148 Impoundment— Nonliability of city. No liability shall attach to the city or any of its agents for damage arising from towing or storage of vehicles impounded under the terms of the ordinance codified in this section 40-.04446-or any other ordinance of the city. On all streets of the city no person shall stop, stand or park a vehicle in any designated public parking space so that any part of such vehicle protrudes beyond the markings designating such space.
