HomeMy WebLinkAbout02/18/1986 227 MINUTES OF THE REGULAR SESSION OF FEBRUARY 4, 1986 Cont. this ordinance until it is determined whether the lot lines have been vacated which was a condition of the approval, The motion was seconded by Councilmember Kenna and passed unanimously by voice vote, NEW BUSINESS I Trees for Port Townsend Donation, Ms, Marge Abraham was recognized and explaineö that the citizens committee who worked for several years to obtain the necessary donations to plant and maintain the trees in the downtown area and others would like to retire, She indicated that a trust has been establ ished which will con- tribute approximately one thousand dollars each year to the maintenance of these trees and requested that the council take over responsibil ity for them. A dis- cussion ensued about the cost of maintenance, Councilmember Ison made a motion directing that a resolution be prepared accepting the donation of the trees and the money to maintain them which was seconded by Councilember Hunt and passed unanimously by voice vote, ADJ O"U RNMENT There being no further business, Mayor Shirley declared the meeting adjourned at 8:57 P.M. Mayor 63=b A Attest: ¡L/~ City Clerk I MINUTES OF THE REGULAR SESSION OF FEBRUARY 18, 1986 The City Council of the City of Port Townsend met in regular se~;sion this 18th day of February, 1986, at 7:30 P,M" in the Council Chambers of City Hall, Mayor Brent Shirley rresiding, ROLL CALL Councilmenbers present at roll call were Jean Camfield, Janis Hunt, Frieda Imis- lund, Glenn Ison, Vern Jones, and Mike Kenna, Also present were City Attorney Keith Harper, Public Works Director Ted Stricklin, and Clerk-Treasurer David I Grove, Councilmember Ila Mikkelsen was excused due to illness, I MINUTES Councilmember Hunt made a motion that the minutes of February 4" 1986, be approv~d as written and to dispense with the reading of them which was seconded by Counci~- member Jones and passed unanimously by voice vote, BILLS AND CLAIMS The following bills and clòims were presented for payment: I Current Expense Street Library Park Emergency Medical Services Federal Shared Revenue Water-SevJer Equipment Rental $97,888,74 4,361.31 400,00 1,522,45 1,622,95 5,000,00 11,824,98 2,338,96 Councilmember Hunt made a motion that the bills and claims be paid from the pro- per funds which was seconded by Councilmember Ison and passed unanimously by voice vote, COMMUN I CA TI ONS 228 MINUTES OF THE REGULAR SESSION OF FEBRUARY 18, 1986 Cont, --. ------------------. ----- . - - , . --------.-.- -------..-------. -.--------.---.-------- COMMUN I CA TI ONS The council received a claim for damages dated January 27, 1986, from Della S, Richardson in the amount of $50,000,00 for pain and suffering, outrage, and humiliation for false arrest and imprisonment on May 8, 1985, as the result of a traffic citation on January 1, 1985, A written opinion dated February 14, 1986, from Keith Harper, City Attorney, was copied for the council recommending that the council reject the claim and turn it over to the insurance carrier, Councilmember Ison made a motion to that effect which was seconded by Council- member Jones and passed unanimously by voice vote, A petition with six signatures dated February 4, 1986, to Ted Stricklin was copied for the council demanding that action be taken against Charles Anderson at 340- I 26th Street for illegal use of a residence for the purpose of an auto body repair shop, Mr, Anderson was recognized and reported that he has closed his business I account at Murray Auto Parts as of February 1,1986 and discontinued any commercial auto repair at his home, He also reported that he has done no autobody repair at his home, Mayor Shirley indicated that he felt this was appropriate action to tÅke in response to the complaints, 1 The Council received a claim for damages dated February 13, 1986 from James DeLeø in the amount of $965,54 for pumping waste water from the building at 2455 Jef- ferson Street and the purchase and installation of new carpet, The cause stated was the backup of the city sewer main on January 27, 1986, On February 14, 1986, the council received written advice from the city attorney, Keith Harper, that I the claim be turned over to our insurance carrierfor review, but that it be re- jected for the time being, Councilmember Hunt made a motion to that effect whicfu was seconded by Councilmember Kenna and passed unanimously by voice vote, The council received a letter dated February 13, 1986, from Donna Frietas, Doris Williams, Pam Ajax and Jo Hawley requesting that the council continue to inquire into the practices of the new garbage collection contractor posing several questions they would like answered, Mayor Shirley referred this to the Community Services Committee, The council received a signatures of property the next step is, Mr, public hearing, Mayor it up, petition for annexation dated February 14, 1986 with twel~e owners on the Island Vista Plat, Mayor Shirley asked what Harper explained that it is necessary to conduct another Shirley indicated that he would have Kathy MacDonald set On February 14, 1986, the council received a report entitled "What will your response be to the upcoming shipments of high level radioactive waste in Puget Sound?" prepared by the Save the Resources Committee of Port Townsend, Mayor Shirley presented the council with a letter he prepared to send to Governor Booth Gardner, Councilmember Kenna made a motion that the council authorize the mayor to send a letter expressing concern in their behalf with regard to the needless transportation of nuclear waste in the form of fuel rods through the Straits of Juan De Fuca and Puget Sound which was seconded by Councilmember Jones and passed unanimously by voice vote, COMMITTEE REPORTS Street/Storm Sewer/Light, Councilmember Jones reported that the committee is not recommending that a street light be installed at the intersection of 36th and Rosecrans, With regard to the repairs to the streets in Towne Point, he reported that the committee is recommending that the propoerty owners in the development place the money in escrow to cover the cost of the repairs and the city crew will then do the work which is a similar arrangement to the way sewer repairs have been accomplished in Towne Point, Councilmember Jones made a motion directing the City Attorney to prepare the necessary documents which was seconded by Councilmember Kenna and passed unanimously by voice vote, Councilmember Jones reported that he has inspected the trees Mr, Michael would like to remove and has suggested instead that they be topped, I ¡ I I . i I I Appointment, Councilmember Hunt made a motion to approve the reappointment of I lee Scheyer to the Arts Commission which was seconded by Councilmember Kenna I \ and passed unanimously by voice vote, , I I I I Committee Job Descriptions, Councilmember Hunt suggested that each committee prepare a written job description of what their respective responsibilities include, Mayor Shirley expressed his support for this action, ~ I I I I I I 229 MINUTES OF THE REGULAR SESSION OF FEBRUARY 18, 1986 Cont, - Helander, Mr, Grove explained that the Planning Commission is recommending approval of this proposal to subdivide Tax Lot 2 at the corner of Jackson and Rosevelt into two lots on the condition I that there be a ten foot buffer in back of Lot 1 to be maintained of natural or I domestic vegetation, Mayor Shirley opened the hearing to the audience, Ms, . Helander was recognized and spoke in favor of this application describing the I work they have done to clean up this property, Mr, Alan Carmen was recognized I and spoke in favor of the application describing the deminsions and indicating I that the desired reservations have been entered on -the face of the plat, There being no further testimony, Mayor Shirley closed the hearing to the audience I and turned the application over to the council for disposition, After a brief I discussion, Councilmember Ison made a motion that the council find that the application meets the review criteria established by Ordinance No, 1806 and _I approve the final short plat which was seconded by Councilmember Hunt and passed, unanimously by voice vote, ; PUBLI C HEAR I NGS Conditional Use Permit Application No, 1085-02 - Swan School, Mr, Grove reporte6 that the Planning Commission is recommending approval of this application to i operate a private school at 24th and Kuhn, Mayor Shirley then opened the hearing to the audience, Mr, William Michael was recognized and spoke in favor of the application indicating that they have done everything that the Health Department and Fire Department has required of them to prepare the building and the site for use as a school, There being no further testimony, Mayor Shirley closed the hearing to the audience and turned the application over to the council for disposition, After a brief discussion, Councilmember Kenna made a motion that the council adopt the following findings and approve the Conditional Use Permit provided that the city paint in the appropriate crosswalks and the Swan School install the appropriate school zone signs: FINDINGS A, The proposed use would not endanger public health or where proposed and developed, and that the use will not which will tend to generate nuisance conditions such as or vibrations, B, The proposed use would meet all required conditions and specifications set forth in R-1 zone, safety if located allow conditions noise, dust, glare, C, The proposed use would not be injurious or detrimental to adjoining or abutting property, D, The proposed use would not be inconsistant with the comprehensive plan of Port Townsend and its environs, The motion passed unanimously by voice vote after a second from Councilmember Jones, OLD BUSINESS ORDINANCE NO, 2027 AN ORDINANCE APPROPRIATING THE SUM OF $17,615,00 TO THE CURRENT EXPENSE FUND AND $22,000,00 TO THE HOTEL/MOTEL TRANSIENT TAX FUND, MAKING FINDINGS, AND DECLARING AN EMERGENCY Mr, Grove read the ordinance by title and explained that it will be ready for adoption at the next regular council meeting, Street Trees, ~r, Charlie Botts was recognized and requested that the council communicate more effectively with the Park Board, He explained that they had been asked to study to proposal from "Trees for Port Townsend" and the council; acted before hearing their recommendations, . ¡ There being no further business, Mayor Shirley declared the meeting adjourned at 8:16 P,M.
