HomeMy WebLinkAbout2384 Building and Land Use FeesORDINANCE AN ORDINANCE relating to revenue and finance; setting fees for various building and land use applications, permits and services; amending Section 3.36.015 of the Port Townsend Municipal Code; and establishing an effective date. THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND IN REGULAR SESSION ASSEMBLED DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 3.36.015 of the Port Townsend Municipal Code is hereby amended to read as follows: 3.36.015 Fees--Building and land use. Application and service fees for the various building and land use applications, permits and agreements shall be as follows: A. For rezones, the sum of three hundred and fifty dollars ($350), plus ~ fifty dollars ($3-5-) ($50) per hour of staff time spent in excess of ten (10) hours. B. For application for amendment, supplementation or modification to the text of the zoning code (Title 17), one hundred seventy-five dollars ($175); C. For variances, the sum of two hundred dollars ($200) for single-family residences, or for an administrative variance; one hundred fifty dollars ($150) for a sign variance; three hundred fifty dollars ($350) for other variances; D. For street vacations, the sum of three hundred dollars ($300); E. For conditional use permits, the sum of two hundred and fifty dollars ($250) when processed administratively; three hundred fifty dollars ($350) when to be decided by the City Council; plus in either case an additional ~ fifty dollars (-$2~ ($50) per hour of staff time spent in excess of ten (10) hours; F~ For short subdivision approval, the sum of three hundred fifty dollars ($350); G. For preliminary approval of a subdivision, condominium, binding site plan or planned unit development approval, the sum of five hundred dollars ($500), plus an additional thirty dollars ($30) for each lot or dwelling unit proposed, plus an additional fifty dollars ($50) per hour of staff time spent in excess of ten hours; for final plat approval, the sum of one hundred fifty dollars ($150), plus filing costs; H. For building permits, the fees and charges set forth in the Uniform Building Code, as currently adopted by the city, plus an additional ten dollars ($10) for each radon test kit to be provided as required by RCW 19.27; I. For home occupation permits, the sum of fifty dollars ($50). J. For sign permits, twenty-five dollars ($25), plus an additional ten dollars for each additional sign included in the same permit application; K. Preparation of legal agreements, sixty-five dollars ($65); L. For boundary line adjustments, sixty-five dollars ($65); M. For street vendor licenses, an application fee of fifty (50) dollars, and an annual license fee of three hundred and fifty (350) dollars payable upon the issuance of the license and on or before the First of January of each succeeding calendar year for which the permit remains valid; N. For Environmentally Sensitive Area Permits, Two Hundred and Fifty Dollars ($250) plus ~ fifty_ Dollars ($50) an hour ever ten .u.e'ar: of staff time spent in excess of ten hours; O. For Environmentally Sensitive Peer Reviews, the full costs, in advance, of any third party charges which may accrue; P. For Environmentally Sensitive Area Reasonable Use Exception ApplicationS, Two Hundred and Fifty Dollars ($250) plus ~ fifty Dollars ($50) an hour o~,~aRaoa~ of Staff time spent in excess of ten hours; Q. For appeals of Sensitive Area Permit decisions appealable to the City Council, One Hundred and Fifty Dollars ($150); R. For an appeal of an Environmentally Sensitive Area Determination, Twenty-Five Dollars ($25); S. For an Advance Determination under the Environmentally Sensitive Areas Ordinance, Two Hundred Fifty Dollars ($250); T. For an environmental checklist threshold determination, the sum of two hundred fifty dollars ($250), plus m~ay-fiv~ fifty dollars ($2--5) ($50) per hour for each additional hour of staff time in excess of six hours, provided that a credit of one hundred fifty dollars shall be applied if an environmentally sensitive area permit is also required for the proposal; U. For revision of a permit application or of conditions of prior approval, the sum of *~...,....,"' ...~-'~ fifty dollars te.~,~~ fifty per hour of staff time, plus other direct costs to process the revision; V. For mobile home title elimination, thirty dollars ($30); W. For shoreline substantial development permit application, a base fee of three hundred fifty dollars for a primary or secondary use or six hundred dollars for a conditional use, plus seventy-five dollars for notification of each hearing, which sum does not include the amount of deposit for posting boards used. In addition, an hourly fee in the amount of fifty dollars ($50) shall be charged for staff time in excess of ten hours; X. For a shoreline variance application, the sum of one hundred dollars ($100) in addition to the amounts set forth in subsection W, above. In addition, an hourly fee in the amount of fifty dollars ($50) shall be charged for staff time in excess of ten hours; Y. For a shoreline exemption letter or a residential setback analysis, the sum of fifty dollars ($50); Z. For recording documents with the Jefferson County Auditor, the amount of the recording fees charged by Jefferson County, plus a service charge of five dollars ($5). Section 2. Severability. In the event any one or more of the provisions of this ordinance shall for any reason be held to be invalid, such invalidity shall not affect or invalidate any other provision of this ordinance, but this ordinance shall be construed and enforced as if such invalid provision had not been contained therein; provided, that any provision which shall for any reason be held by reason of its extent to be invalid shall be deemed to be in effect to the extent permitted by law.
