HomeMy WebLinkAbout2398 Modifying the Due Date for Quarterly Payments of Business and Occupation Taxes and Business License FeesORDINANCE NO. .,2.$9 g~ AN ORDINANCE RELATED TO THE PAYMENT OF CITY BUSINESS LICENSE FEES AND PAYMENT OF CITY BUSINESS AND OCCUPATION TAXES AMENDING SECTIONS 5.04.280 AND 5.04.320 OF THE PORT TOWNSEND MUNICIPAL CODE TO MODIFY THE DATE ON WHICH QUARTERLY PAYMENTS ARE DUE TO THE END OF MONTH NEXT SUCCEEDING THE END OF THE QUARTER RATHER THAN THE FIFTEENTH OF THE MONTH AND ELIMINATING THE CURRENT FIFTEEN DAY GRACE PERIOD FOR PENALTIES ON PAYMENT OF B&O TAXES BECAUSE OF THE CHANGE IN PAYMENT DUE DATE. WHEREAS, the current City business license and City B&O tax provisions of the Municipal Code allow a fifteen day grace period between the payment due date on the fifteenth of the month next following the end of a quarter for which payment is being made; and WHEREAS, the current provision often results in some parties making payment at the end of the month without penalty and this is inequitable to those who make timely payments on the fifteenth; and WHEREAS, the current inequity could be resolved by moving the payment date for all payers to the end of the month and eliminating the grace period regarding penalties; Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF PORT TOWNSEND AS FOLLOWS' Section 1. to read as follows: Section 5.04.280 of the Port Townsend Municipal Code is hereby amended 5.04.280 Quarterly payments of business license fee. The license fee or tax imposed by this chapter except the five ten dollars required to accompany the application for this license, shall be due and payable in quarterly installments, and remittance therefore shall be made on or before the ~fte.~nth final day of the month next succeeding the end of the quarterly period in which the tax accrued. The remittance shall be made as hereinafter provided and shall be accompanied by a return on a form to be provided and prescribed by the clerk Clerk/Treasurer. To the return the taxpayer shall be required to swear or affirm that the information therein given is full and true and that the taxpayer knows the same to be so. Section 2. to read as follows: Section 5.04.320 of the Port Townsend Municipal Code is hereby amended 5.04.320 Extension of time. The clerk Clerk/Treasurer for good cause shown may extend the time for making and filing any return as required under this chapter, and may grant such reasonable additional time within which to file such return as he the Clerk/Treasurer may deem proper. Provided, that any extension in excess of thirty days shall be conditioned upon payment of interest of one-half of one percent for each thirty days or portion thereof on the amount of the tax from the date upon which the tax becomes due, If tax return and/or payment are not received v,4tldn fifteen clays cf o._~n the due date a penalty must be included as follows: If ............. j .... one to thirty days are delinquent, ten percent of the tax with a minimum penalty of one dollar.
