AN ORDINANCE VACATING THAT PORTION OF HANCOCK STREET LYING SOUTH OF THE HASTINGS AVENUE RIGHT-OF-WAY AND NORTH OF THE 2?TH STREET RIGHT-OF-WAY~ ADJACENT TO LOTS 5 AND 6, BLOCK 9 OF THE HASTINGS 3RD ADDITION TO THE CITY OF PORT TOWNSEND; ESTABLISHING CONDITIONS ~ THE STREET VACATION; AND ESTABLISHING AN EFFECTIVE DATE WHEREAS, the City Council for the city of Port Townsend has considered Street Vacation Application 9311-01, and following due notice has held a public hearing upon the application, and WHEREAS, the City Council for the City of Port Townsend voted to vacate the subject street on November 3, 1981, but overlooked the need to ~y adoptec%an ordinance to implement the vacation, and WHEREAS, the City CounCil has ~adopted its Findings of Fact and Conclusions dated April 18, 1994, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS FOLLOWS: Section 1, That Hancock Street from the southerly line of Hastings Avenue to the northerly line of 27th Street is hereby vacated. Because the underlying rights to the subject portion of Hancock Street have been deeded to the property to the west of the street, the land shall attach to the property to the west by operation of law. Section 2. That the street vacation aforementioned is conditioned, however, on the following: The applicant shall remove all encroachments from the 27th Street right-of-way which lie south of the northerly line of the 27th Street right-of-way. e A utilities easement 15 feet in width shall be retained along the eastern border of vacated Hancock Street from the Hastings Avenue right-of-way-to the northern line of 27th Street right-of-way. 504 .. APR2 9 zy f A certified copy of this ordinance shall be recorded by the city clerk in the office of the Jefferson County Auditor. Section 3. The current standard fee for street vacations, of one-half the apPraised value of the land, shall be waived as the street vacation was originally approved by the City Council prior to the establishment of said fees. Section 4.
