RESOLUTION NO. 05-021
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON, ADOPTING FINDINGS IN SUPPORT OF ORDINANCE 2896
REGULATING FORMULA RETAIL ESTABLISHMENTS
WHEREAS, the City Council adopted Ordinance 2896 on April 18, 2005 regulating
fonnula retail establishments; and
WHEREAS, the City needs time to consider properly and carefully the potential location
and regulation of formula retail establishments; and
WHEREAS, based on a wide range of testimony, the Council finds that location offo11Tmla
retail establishments, without regulation as to location and development, may be counter to the
City's comprehensive plan; and
WHEREAS, the City Council finds that the City's land use integrity and planning process
will suffer significant hann unless formula retail establishments are subject to regulation as
provided in Ordinance 2896 until the planning process is completed; and
WHEREAS, the City Council finds that protection of the health, safety and welfare
supports establishment of interim land use regulations on for formula retail establishments; and
WHEREAS, RCW 35A.63.220 relating to Code cities like Port Townsend and
36.70A.390, a section of the Growth Management Act (Ch. 36.70), authorize the City to adopt
interim land use regulations and thereafter to hold a public hearing on the moratorium within 60
days of the commencement of interim regulations,
NOW, THEREFORE, the City Council of the City of Port Townsend resolves as
follows:
For the reasons set forth in the above recitals, and the recitals ("whereas" clauses) of
Ordinance 2896, Council determines it appropriate to leave the provisions of Ordinance 2896 in
effect until after the City Council has held a public hearing or hearings and taken action on
appropriate City action on regulations and zoning for fonnula retail establishments.
ADOPTED by the City Council of the City of Port Townsend at a regular meeting
