HomeMy WebLinkAbout2403 Pope Marine Building Use Regulations and ChargesOrdinance No. 2403 AN ORDINANCE OF THE CITY OF PORT TOWNSEND ESTABLISHING A NEW CHAFrER 3.37 ENTITLED "POPE MARINE BUILDING USE REGULATIONS AND CHARGES", ESTABLISHING RULES AND FEES REGARDING THE POPE MARINE BUILDING WHICH ENCOURAGE ITS USE BY LOCAL RESIDENTS AND FOR PERFORMING AND VISUAL ARTS, AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of Port Townsend has constructed improvement, s to the Pt~ge Marine Building; and WHEREAS, The City Council now finds it. neces~ to establish certain procedures, rules and fees related tx) the use of said facility in order tx) e~sure a fair use sy~em and process and to provide a source of revenue to defray the operation, ma~tenance, repair and replacement costs associated with said facility; and WHEREAS, the City Council has determined the following goals for u~ of the Pope Marine Building: 1. 2. 3. 4. 5. 6. Maximize its use; Assure that priority be given tx) City of Port Townsend resident~s; Encourage use for visuai and performing arts; Recognize recurring annual needs; Allow for use by City government on an Was-available" basis; Provide rules, regulations and procedures which are simple, understandable, explainable, and easily admini~ered; and Provide a source of revenue to be used for operation, maintenance, repair, and replacement cz)sCs. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL FOR THE CITY OF PORT TOWNSEND: Section 1. A new Chapter 3.37 of the Port Towr~send Municipal Code entitled "Pope Marine Building Use Regulations & Charges~ is hereby added to the P~ Townsend Municipal Code to read as follows: 3.37 Pope Marine Building Use Regulations & Charges 3.37.010 Pope Marine Building - General Use Regulations & Reservations 3.37.020 Fees 3.37.010 Pope Marine Building - General Use Regulations It is the intention of this chapter to maximize the use of the Pope Marine Building (sometimes referred to as "the facility' for convenience) on a "first-come, first- served" basis, with priiority being given to City of Port Townsend resident,;. This chapter is also intended to encourage use of the facility by the vimal and performing arts, and to allow for certain recurring u~s of the facility by local organizations. To ensure that the Pope Marine Building is used in a manner consistent with these intentions, the following general use regulations sh',fll be applicable to users of the Pope Marine Building: A. Organizations based in Port Townsend and individuals with protff of residence in Port Townsend may re~rve the facility up to one (1) year in advance of the proposed date of use. B. Use of the facility for the visual and performing arts is encouraged. C. Organizations based outside Port Townsend and individuals not residing in Port Townsend may reserve the facility up to ninety (90) days in advance of the proposed date of use. D. City government may reserve the facility up to forty-five (45) days in advance of the proposed date of use. E. The facility may be reserved for no more than three (3) consecutive days and for no more than six (6) days per reservation. F. The facility is hereby reserved for the use of the Wooden Boat Foundation during the Wo~xlen Boat Festival each September and during the Youth Sea Symposium each June; provided, however, that this right must be exercis~ no less than ninety (90) days in advance of each such annual use, and, provided further, that the limitations on length of use imposed in the foregoing paragraph E do not apply to such uses by the Wooden Boat Foundation. G. The following blocks of 6me are available each day: 1. 8:00 a.m. to 1:00 p.m. 2. 1:30 p.m. to 6:00 p.m. 3. 6:30 p.m. to Midnight H. The facility may be occupied by no more than 78 people. The party reserving the facility shall be financially liable for any and ',ti damages to the facility, any fines imposed for excess occupancy of the facility, and for any cleaning or other charge which may be levied for failure to leave the facility as clean or cleaner than when the use pursx~ant to the reservation commenced. I. The Public Worlcs Director, in consultation with the Parks Commission, is hereby authorized to develop additional rules and regulations regarding the facility. 2 3.37.020 Fees. Fees for use of the Pope Marine Building shall be collected in advance of use in accordance with the following schedule: A. Category. I - No Charge. This category includes any activity spoxzsored or supported by the City, which the City plans, conducts, or controls, or for which the City provides funding, labor or equipment. Wooden Boat Foundation activities are Category I activities. B. Category II - This category includes any activity of a nonprofit organization and community funcfitms which are not Category I activities. The following fees apply to Category II activities: 1. Day use (8:00 a.m. to 6:00 p.m) - $10.00 Firs~ Hour + $5.00 each additional hour. 2. Evening use (6:30 p.m. to Midnight each day) and Weekend use (Friday, Saturday, or Sunday) - $15.00 First Hour + $10.00 each additional hour, with a flat rate of $100.00 per day C. Category III - This category includes all activities which are not Category I or II activities, such as activities of profit-making entities, and private parties, including but not limited to wedding receptions, retirement banquets, and family or class reunions. The following fees apply to Category III activities: 1. Day Use (8:00 a.m. to 6:00 p.m.) - $25.00 First Hour + $10.00 each additional hour. 2. Evenings (6:30 p.m. to Midnight each day) and Weekend use (Friday, Saturday or Sunday) - $30.00 First Hour + $15.00 each additional hour, with a flat rate of $200.00 per day. D. Deposits and advance payments shall be made in accordance with the following schedule: 1. All reservations shall be secured by a deposit equal to the fee for the initial peritxi of use payable within two weeks of the date the reservation is made. The deposit securing a reservation cancelled no le~s than ninety (90) days in advance of a scheduled use shall be refunded less a $15.00 administrative charge; no refund shall be made if a reservation is cancelled le~,¢ than ninety (90) days in advance of a scheduled use. All fees for a scheduled use shall be paid no less than sixty (60) days prior to the firsX day of the scheduled event. 2. For Categories II & III, a refundable damage deposit shall be made at the time of payment for the use of the facility. If it is determined by the Public Works Department that no damage has occurred during the use, the full amount of the deposit shall be refunded. A damage deposit of $50.00 is required for activities of 19 or less users when no fozxl or alcohol will be czmsumed. A damage deposit of $150.00 is required for activities of 20 or more users, or if f(x~! or alcohol will be consumed during any use. E. All revenues derived from use of the Pope Marine Building in excess of zq~eration and maintenance costs of the facility shall be segregated in a capital reserve fund identified within the City Budget for the repair and/or replacement of the facility. Section 2. This Ordinance shall become effective upon its passage, approval and Publication in the form and manner provided by law.
