Assessor's Parcel Numbers: 951-904-903 and 951-904-904 WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation Application No. LUP04-111 (Seaview/Fowlers Park L.L.C.) and following due notice has held a public hearing upon the application; and WHEREAS, the vacation request involves a section of alley lying in Block 49 of the Fowler's Park Addition, which is approximately 350 feet in length and 12 feet in width; and WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact and Conclusions on March 21, 2005; and WHEREAS, the Council's Findings and Conclusions approved in concept the proposed vacation, subject to petitioner paying for an appraisal of said alley and paying 100% of the appraised value of the land; and Ordinance 2900 499927 Page; 2 of 3 06/27/2005 11,25A ._Jefferson County., WA. SEAVIEW FOWLI;R P~RK -- O~. 21,m.L- WHEREAS, the Council's Findings and Conclusions also conditioned the vacation approval upon petitioner submitting a Lot Line Adjustment application to merge the vacated alley into petitioner's adjoining lands and agreeing to have vehicular access and utility service to the resulting lots come from Mason Street, unless otherwise approved by the Public Works Director; and WHEREAS, petitioner has now paid full appraised value of the subject alley to the City and has submitted a Lot Line Adjustment application, which has been processed and preliminarily approved by the DSD Director subject to final City Council approval and recording of the alley vacation Ordinance, NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows: Section 1. Subject to the conditions in Section 2 of this Ordinance, the following right-of- way is hereby vacated to the Seaview/Fowler's Park LLc. That portion ofthe 12-foot wide alley lying adjacent to Lots 3 through 9 and Lots 12 through 18, all within Block 49, Fowler's Park Addition to the City of Port Townsend, according to the plat thereof recorded in Volume 2 of Plats, page 16, records of Jefferson County, Washington. Section 2. Vacation of the aforementioned alley right-of-way is conditioned on the following: a. Petitioners shall adhere to all conditions of the Lot Line Adjustment, which received preliminary approval by the City DSD Department on June 8, 2005 (File No. LUPOS-OSS). Said Lot Line Adjustment merges the vacated right-of-way into one or more of petitioners adjoining properties via the recording of a Statement of Intent. It also requires petitioner to record a Notice to Title advising present and future owners of access and utility restrictions to the reconfigured lots. The Statement of Intent and Notice to Title shall be recorded with the Jefferson County Auditor consecutively with the recording of this street vacation Ordinance. The petitioner shall pay for all fees associated with recording the above documents. This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferson County Auditor pursuant to Section 2 of this ordinance.
