HomeMy WebLinkAbout2413 Allowing Boat Building Repair and Sales in the C-II Zoning DistrictORDINANCE AN ORDINANCE pertaining to zoning, amending Section 17.16.010 of the Port Townsend Municipal Code to allow boat building, repair and sales in the C-II zoning district, and establishing an effective date therefor. WHEREAS, boat repair and sales are important, traditional elements of the Port Townsend economy; and the C-H zoning district is primarily a general commercial district intended for the conduct of enterprise which depends on proximity to major arterial streets for trade or transportation; and WHEREAS, many boat models currently being manufactured are trailerable and may be successfully marketed and repaired on upland sites without direct access to the water; and WHEREAS, allowing boat repair and sales in the C-II zoning district may be expected to increase boating services desired by residents and visitors; and it is desirable to revise zoning regulations to remove regulatory barriers which are no longer necessary in order to enhance further economic development of boat sales and repair; Now, Therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND AS FOLLOWS: Section 1. Section 17.16.010 of the Port'Townsend Municipal Code is hereby amended to read as follows: 17.16.010 Pu _rposes of Districts--Table of ~rmitted uses. Within the various use districts as indicated on the 'official zoning map' of Port Townsend, Washington, and subject to the . requirements of Sections 17.16.020 and 17.20.010, no land, buildi~, g, .or structure shall be used and no building or structure shall be erected which is intended or designed to be used, in whole or in part, for any of the uses indicated in the "conditional" column without specific approval of the board of adjustment. The criteria of Section 17.'64.040 shall guide the board in granting or withholding apprOval. Permitted'uses in the various use districts are indicated · by an "x" in the appropriate column of the accompanying table. With the exception of conditional uses; as regulated in Sections 17.64.040 through 17.64.060, only those uses appearing below are deemed to be in the interests of public health, safety, morals, and the general welfare of the citizens of Port Townsend. Severability. In the event any one or more of the provisions of this ordinance shall for any reason be held to be invalid, such invalidity shall not affect or invalidate any other provision of this ordinanCe, but this ordinance shall be ' construed_ and enforced as if such invalid, provision, had not been contained therein; provided, that any provision which shall for any reason be held by reason of it~ extent to be invalid shall be deemed to be in effect to the extent permitted by law. Section 3. Effective Date.
