HomeMy WebLinkAbout05-009 Granting final planned unit development and site plan approval for phase 3 Treehouse condominum development Resolution No. 05-009 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND GRANTING FINAL PLANNED UNIT DEVELOPMENT AND BINDING SITE PLAN APPROVAL FOR PHASE III OF THE TREEHOUSE CONDOMINUMDEVELOPMENT The City Council of the City of Port Townsend, Washington resolves as follows: WHEREAS, Madrona Village, LLC has petitioned the City for final approval of a Planned Unit Development (PUD) and Binding Site Plan (BSP) covering the final phase (Phase III) of their residential condominium development known as Treehouse (LUPOS-006). Treehouse is located west of Fort Worden cemetery, along W Street and Ebony Street; and WHEREAS, the original preliminary PUD and BSP applications were submitted on or about December 3, 2001 (LUPOl-117) and involved construction of 30 residential condominium units across 6 new lots created over 5 phases. The new lot configuration is achieved via the re-platting of 22-existing lots encompassing 4.3-acres of the Pettygrove's 2nd Addition to the City of Port Townsend; and WHEREAS, the applicant has developed several phases of the project concurrently and thereby has reduced the overall number of phases from 5 to 3. This final phase, Phase III, the PUD involves the creation of 2 new lots, Condominium Lots 5 & 7. Condominium Lot 5 is approximately 15,000 square feet in size and will be developed with a maximum of S residential condominium units. Condominium Lot 7 is approximately 20,000 square feet in size and also will be developed with a maximum of S residential condominium units; and WHEREAS, the Treehouse PUD and BSP were granted preliminary approval, subject to certain conditions, by the City's Hearing Examiner on March 29, 2002. This March 29 decision was modified by the Examiner on April!?, 2002, after review of a timely request for reconsideration jointed filed by the applicant and BCD; and WHEREAS, the Development Services Department has identified an appropriate financial security for roadway and other infrastructure improvements yet to be completed within Phase III; and WHEREAS, the Development Services Department has found that, with the exception of some required landscaping and replanting, the final PUD and BSP request is in conformance with the Hearing Examiner's preliminary PUD decision, complies with applicable environmental mitigation measures, and includes appropriate measures for recording to title a Planned Unit Development Agreement (PUDA) signed by both the applicant and the City. So long as an appropriate financial security is established 1 Resolution 05-009 for the remaining landscaping, final PUD and BSP approval for Phase III of Treehouse is consistent with Chapters 17.32, 18.16 and 18.24 of the PTMC; and WHEREAS, the City Council has reviewed the proposal and concurs with the Development Services Department's determination; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Port Townsend as follows: 1. The City Council hereby APPROVES Phase III of the Treehouse PUD and directs staff to facilitate recording of the final Binding Site Plan with the County Auditor once the appropriate financial security has been established. 2. In addition, the City Manager is hereby authorized to sign the required PUDA addendum on behalf of the City after it has been reviewed and approved by the Directors of Public Works and Development Services in consultation with the City Attorney. ADOPTED by the City Council of the City of Port Townsend at a regular business meeting thereof, held this twenty-second day of February, 200S.
