RESOLUTION NO. 04-062
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON, DECLARING SEA WESTERN, INc. AS THE SOLE SUPPLIER OF
MINE SAFETY APPLIANCES SELF CONTAINED BREATHING APP ARA TUS AND
AUXILIARY ATTACHMENTS (FIRE FIGHTING EQUIPMENT)
WHEREAS, the City was awarded a Federal Assistance to Firefighter Grant in the sum
of $278,000, a portion of which was designated for self-contained breathing apparatus and
auxiliary apparatus equipment; and
WHEREAS, Sea Western, Inc. is the sole authorized supplier of Mine Safety Appliances
Company (MSA) self-contained breathing apparatus, parts and thermal imaging cameras to the
Municipal Fire Service Market in Oregon and Western Washington; and
WHEREAS, the self-contained breathing apparatus and auxiliary apparatus equipment
would allow the Fire Department to come into compliance with National Fire Protection
Association standards and Federal and State Occupational Safety and Health regulations; and
WHEREAS, State law and the City's own purchasing ordinance require purchases of
materials and supplies over $15,000 a year to be competitively bid, unless an exemption to
competitive bidding applies; and
WHEREAS, RCW 39.04.280 allows competitive bidding to be waived in certain
circumstances, including, where purchases are clearly and legitimately limited to a single source
of supply. RCW 39.04.280 is applicable to code cites under 20,000 population like Port
Townsend by RCW 35.23.352(9); and
WHEREAS, a competitive bidding process would only produce one bid; and
WHEREAS, PTMC 3.46.090 (A) requires a resolution by Council declaring an
exemption from bidding under the sole source provision for contracts over $30,000.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend to declare Sea Western, Inc. the sole source for Mine Safety Appliances Company
self-contained breathing apparatus and auxiliary MSA attachments.
ADOPTED by the City Council of the City of Port Townsend at a regular meeting
