HomeMy WebLinkAbout2434 Utility RatesOrdinance No. ~ ~ AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING THE PORT TOWNSEND MUNICIPAL CODE AS FOLLOWS: CHAPTER 13.04, SEWER CONNECTION RATES AND CHARGES, REVISING SECTION 13.04.030 SEWER RATES; AND CHAPTER 13.12, WATER SYSTEM AND REGULATIONS, AMENDING SECTION 13.12.220 MONTHLY WATER RATES; AND AMENDING CHAPTER 13.26, SYSTEM DEVELOPMENT CHARGES FOR WATER AND SEWER CONNECTIONS, REVISING SECTIONS 13.26.030 WATER SYSTEM DEVELOPMENT CHARGE, AND 13.26.040 SEWER SYSTEM DEVELOPMENT CHARGE WHEREAS, utility rates, charges and connection fees are necessary in managing the City's public utility services; and WHEREAS, the City Council deems it necessary to adjust certain utility rates, charges and fees in a manner consistent with the cost to the public of providing public utility services; NOW, THEREFOR, the City Council of the City of Port Townsend does ordain as follows: Section 1. Section 13.04.030 of the Port Townsend Municipal Code is hereby amended to read as follows: 13.04.030 Sewer Rates. The following monthly rates shall be charged by the city and collected by the clcrlr treasurer for the use and furnishing of sewerage service, all such rates and charges to be made and paid on a monthly basis: A. Single-Unit Residential and Duplex Customers. 1.'Average Winter Water Use Categories. For single-unit residences and duplexes, where each unit receives separately metered water service, each unit shall be charged a base rate, plus a charge per 1,000 gallons of metered water used, up to a fixed limit based on the customer's average water use calculated from meter readings actually taken during a four-month period between October 15th and March 15th, or average winter water use (AWWU). The AWWU shall be determined on April 1st of each year with the customer's maximum monthly rate from April 1st to March 30th of the next year being established by the AWWU. The AWWU category for determining monthly charges shall be established by averaging the water meter readings taken during the specified four-month period and rounding them up or down to the nearest thousand gallon amount. 2. Monthly Rates. The base monthly rate for each metered customer shall be $22.6~ $24.00 per month plus $2.25 $2.35 per 1,000 gallons of water used as established through the AWWU process. For duplexes with a single water meter, the charge shall be two times the base rate, plus a charge of $2.25 $2.35 per 1,000 gallons AWWU. Monthly sewer charges where actual water usage in a parfi'cular month is less than the AWWU shall be calculated as a combination of the base rate plus a charge of $2.25 $2,35 per 1,000 gallons of water actually used, rounded to the nearest thousand gallons. If water meter readings are taken on a bimonthly basis, an averaging method to calculate monthly billing charges may be utilized. Charges for a monthly period during which the meter is not actually read shall be calculated by averaging the prior water consumption for the period during the two months immediately preceding the period for which a meter reading is not obtained, multiplying that average amount (not to exceed the AWWU maximum) by the volume charge per thousand gallons and adding that charge to the base charge. An adjustment for actual usage shall be made in the next monthly billing based on actual meter readings, if necessary. If the customer does not have a recorded' four-month use to establish the AWWU or where during the four-month period used to calculate the AWWU there is a circumstance which, in the reasonable judgment of the clerk treasurer, would make the AWWU calculation erroneous, the charge shall be set at the base rate plus the monthly rate for ~:.,,.,,~.,nan ~,.~--,-~"n"~ the customer's past AWWU, or the AWWU within the customer class, whichever amount is deemed to most accurately reflect the probable use by the customer. If there is a change in occupancy during the AWWU determination period for a particular year, the charge shall be set at the base rate plus the monthly rate for ': ruin ~n,^~ · -,,-,,--, e, ...... the prior customer's AWWU, or the AWWU within the customer class, whichever amount is deemed to most accurately reflect the probable use by the customer. B. Multifamily Customers. 1. Base Charges. For multifamily residences with three or more units, the base monthly charge shall be based on meter size. Total Charges, The total monthly multifamily charges ihall be the base charge plus a charge of $2.25 $2.35 per 1,000 gallons of water actually used, rounded to the nearest thousand gallon amount, with the maximum per gallon charge capped at 6,000 gallons per unit. {Sewer/System Development Charges} C. Commercial Customers. Commercial accounts shall be charged the same base rate, based upon meter size, as multifamily customers. However, commercial customers shall be charged an additional amount of $2.26 $2.35 per 1,000 gallons of water used, rounded to the nearest thousand gallons, with no maximum cap on additional charges, or if a commercial customer generates high-strength waste or waste with high variability in loadings, charges shall be on a commodity basis and provided in Chapter 13.06 PTMC. D. Industrial and Contract Customers. The city may establish rates and charges for industrial and large user customers that have unique or special use characteristics. The rates and charges shall be based on existing contract conditions, costs of service, including waste volume and strength, and such other factors deemed relevant in establishing reasonable rates and services in the judgment of the director of public works. E. For all classes of users subject to metered rates, should there be a period during which meter readings cannot be obtained under a normal reading schedule, volume charges shall be calculated by averaging the prior consumption for the two months immediately preceding the period for which a meter reading cannot be obtained. Charges for the next month during which the actUal meter reading is taken shall be adjusted for the difference between the average and the actual metered volume for the period involved together with the appropriate meter rate. Where there is a circumstance which, in the reasonable judgment of the clerk treasurer, would make the volume charge calculation erroneous, the volume charge shall be established under such other method as the eter-k-treasurer deems reasonable and fair. Section 2. Section 13.12.220 of the Port Townsend Municipal Code is hereby amended as follows: 13.12.220 Monthly water rates. The following monthly rates shall be charged by the city and collected by the city e4er4etreasurer for the use and furnishing of water service, with all such rates and charges to be made and paid on a monthly basis: A. Meter Charge. All water used, except for closed connection for fire protection, shall be metered. Monthly service charges and standby fees shall be based on meter size and the quantity of water provided to the customer and shall be paid regardless of whether the service is on or off. B. Volume Charges and Summer Use Surcharges. All water use for customers within the city shall be charged a volume rate of $1.42 per 1,000 gallons or portions thereof, and all water use for customers in the outside-of-city service area shall be charged a volume rate of $1.78 per 1,000 gallons or portiOns thereof, except as provided below: 1. For single-unit residential and duplex customers with individual meters, inside the city the volume charge shall be $4,43 $1.56 per 1,000 gallons plus an additional $9.71 $0.78 per 1,000 gallons for water use in excess of 11,000 gallons e' ~ '~ (, ....$2.34 total) per month during the summer use period. For single-unit residential and duplex customers with individual meters, outside-of-city service area, the volume charge shall bc $I..7g $1.95 per 1,000 gallons plus an additional $9. °..9 $0.98 per 1,000 gallons for use in excess of 11,000 gallons ($2-~ $2.93 total) per month during the summer use period. The summer use period shall be the meter reading periods for usage during June, July, August and September. 2. For duplex customers with a joint meter and multifamily customers with three or more units inside the city, an additional $0,71 $0,78 per 1,000 gallons will be assessed for water used in excess oran average of 11 ;000 gallonsw--.re'~ ...~'~ $2.34 total) per unit for the summer use period. For duplex customers with a joint meter and multifamily customers with three or more units outside-of-city service area, an additional $9.89 $0.98. per 1,000 gallons will be assessed for water used in excess of an aVerage of 11,000 gallons ($:2~7 $2.93 total) per unit for the summer use period. The additional charge shall be based on the total meter reading for all meters used to serve the customer. {Sewer/System Development Charges} 4 3. For irrigation-only meters, inside the city, the meter charge shall be based on meter size with a volume charge of StAg $1.56 per 1,000 gallons. For irrigation-only meters outside-of-city service area, the meter charge shall be based on meter size with a volume charge of $1.78 $1.95 per 1,000 gallons. A standby or monthly service charge for irrigation-only meters will not be assessed for full month periods during which the meter is turned off by the city. The city shall assess a turn-on, turn-off charge for such requests at a rate provided by ordinance. 4. Should there be a period during which a meter reading cannot be obtained under a normal reading schedule, the volume charge shall be calculated by averaging the prior consumption for the two months immediately preceding the period for which a meter reading cannot be obtained. Charges for the next month during which the actual meter' reading is taken shall be adjusted for the difference between the average and the actual metered volume for the two-month period involved together with the appropriate meter rate. Where there is a circumstance which, in the reasonable judgment of the clerk treasurer, would make the volume charge calculation erroneous, the volume charge shall be established under such other method as the clerk-treasurer deems reasonable and fair. C. Water Charge Method for Single-Family and Duplex Uses With Individual Meters. For single-family residences and duplexes with individual water meters, meter reading shall be done, at a minimum, on a bimonthly basis. Charges for the month during which the meter is not read shall be calculated by averaging the prior consumption for the two months immediately preceding the period for which a meter reading is not obtained. Charges for the month during which the actual meter reading is taken shall add the meter rate to an adjusted volume charge which adjusts for the difference between the average calculated for the previous month and the actual metered volume for the two-month period involved, charged at the rates established under subsection B of this section. D'. Private Fire Protection. Monthly service charges for private fire protection systems shall be as follows: Inside City Outside City 2" $10.10 $12.63 4" 17.05 21.31 6" 34.38 42.98 For private fire protection systems, in areas outside the city limits, the city will specify the hydraulic capacity and flow capability of its distribution system under Specified flow and demand conditions at the request of the customer. It is the customer's responsibility to evaluate private fire protection requirements and to verify the adequacy of the city's water system to meet those requirements. {Sewer/System Development Charges} 5 E. Commercial and Contract Customers. The monthly meter charges for commercial and contract customers inside the city shall be the same as provided in subsection A of this section with an additional volume charge of ~ $1.56 per 1,000 gallons used unless a current contract specifically provides for an alternative rate schedule. Commercial and contract customers located outside the city limits shall be charged a volume charge of $1.78 $1.95 per 1,000 gallons used unless a current contract specifically provides for an alternative rate schedule. Section 3. Section 13.26.030 of the Port Townsend Municipal Code is hereby amended to read as follows: 13.26.030 Water system development charge. A. The city has evaluated the capital cost of the city's existing water system and the projected cost to expand the general facilities to meet the projected needs associated with new and expanded needs of the water system customers. The general facilities include source of supply, treatment, storage, transmission and major pumping facilities. B. A one-time SDC for each new customer shall be assessed based upon the customer's fair and equitable share of the general facilities. The SDC shall be determined by multiplying the total number of ERUs for the service(s) to be installed by e~ car, ~,~,.,,,,, $1,560 as of January 1, -1-994 1995. Section 13.26.040 of the Port Townsend Municipal Code is hereby amended to read as follows: 13.26.040 Sewer system development charge. A. The city has evaluated the capital cost of the city's existing sewer system and the cost to expandthe general, facilities to meet the projected needs associated with new and expanded needs of sewer system customers. The general facilities include the interceptor system, major pumping facilities and the wastewater treatment and associated facilities necessary to treat and dispose of the wastewater. {Sewer/System Development Charges} 6 B. A one-time SDC for each new customer shall be assessed based on the customer's fair and equitable share of the general facilities. The SDC shall be determined by multiplying the total number of ERUs for the service(s) to be installed by $-g;-3-50 $1.300 as of January 1, -1-994 1995 for domestic strength wastewater. If any clause, sentence, paragraph, section or part of this Ordinance or its application to any person or circumstance is held to be invalid or unconstitutional by a court of competent jurisdiction, such order or judgment shall not affect the validity or constitutionality of the remainder of any part of this Ordinance. To this end, the provisions of each clause, sentence, paragraph, section or part of this law are declared severable. This Ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law.
