HomeMy WebLinkAbout12-015 Cost Recovery for Fire District Emergency Response Resolution 12-015 RESOLUTION NO. 12-015 A RESOLUTION OF THE CITY OF PORT TOWNSEND PROVIDING FOR COST RECOVERY FOR FIRE DISTRICT EMERGENCY RESPONSE RECITALS: A. The Fire District requests the City approve a Resolution that allows the District to seek cost recovery for certain services. Services include District response to hazardous spills, house fires, extrications, and motor vehicle accidents. Cost recovery would be limited to a responsible party's insurance company only. B. The District currently contracts with EF Recovery(Gig Harbor, WA) for cost recovery services. District recovery currently is limited to incidents in the County but not in the City. This Resolution provides "authority to bill" a responsible party for response costs for certain incidents in the City. C. The City Council determines with this Resolution that its taxpayers should not be required to subsidize the costs of responding to emergency incidents where such costs can be recovered from a responsible party. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND AS FOLLOWS: To the extent permitted by law, Jefferson County Fire District No. 1 ("District") is authorized to pursue cost recovery against persons or entities who necessitate the service for the following services provided within the City of Port Townsend: 1. Emergency Medical Services; 2. Hazardous Material Response Extraordinary Costs; 3. Motor Vehicle Accident Responses. 4. Structure Fires.
