AN ORDINANCE VACATING THE NORTHERLY 26-FEET OF THIRD STREET
LYING BETWEF~ LOTS 12, 13, 14, AND THE WEST 7.69 FEET OF LOT 15,
BLOCK 4, NATIONAI. CITY ADDITION TO TIlE CITY OF PORT TOWNSEND;
ESTABLISHING CONDITIONS TO THE STREET VACATION; AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City. Council for the City of Port Townsend has considered Street Vacation
Application No. 9505-10 (William W. Grace, Sr.), and following due notice has held a
public hearing upon the application; and
WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact
and Conclusions on July 3, 1995; and
WHEREAS, the applicant has paid to the City one-half of the appraised value of the area to
be vacated; and
WHEREAS, a restrictive covenant describing Lots 9-14 inclusive and the western 7.69 feet
of Lots 8 and 15 all within Block 4, National City Addition to the City of Port Townsend,
and prohibiting the sale of any portion of said lots unless sold in conjunction wi.th the
remainder of .*.aid lots has been executed and recorded at the Jefferson County Auditor's
Office; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS
FOLLOWS:
Section 1, That the following street is hereby vacated to William W. Grace, Sr.:
the northerly 26-feet of Third Street lying between LOts 12, 13, 14, and the
west 7.69 feet of LOt 15, Block 4, National City Addition to the City of Port
Townsend.
Section 2.
That the street Vacation aforementioned is conditioned, however, on the
following:

A certified copy of the ordinance vacating the street shall be recorded by the
City with the office of the Jefferson County Auditor.
B. An emergency access easement shall be recorded over the existing 12-foot
driveway lying within that portion of Third Street to be vacated.
Section 3.
This ordinance shall take effect upon its passage, approval and publication in
the form and manner provided by law, and after it has been recorded with the
Jefferson County Auditor pursuant to Section 2 of this ordinance.
Read for the first, second and third times, passed by the City Council for the City of Port
Townsend and signed by the mayor of the City of September, 1995.
