A RESOLUTION DECLARING THE INTENTION OF THE CITY
OF PORT TOWNSEND TO ORDER THE CONSTRUCTION OF A
SEWER SYSTEM FOR A PORTION OF THE CITY LYING WEST
OF WILSON STREET AND EASTERLY OF PEARY AVENUE AND
?NORTH OF 44TH STREET, AND PROVIDING FOR A PUBLIC
HEARING RELATING THERETO
WHEREAS, it has been determined that a certain portion of the
City of Port Townsend which is not served by sanitary sewers is
now in such a situation that a public sewer may feasibly be
constructed and maintained, which portion of the City is generally
described as:
The Seaview Estates Addition to the City of Port
Townsend; that area lying within 100 feet of the
centerline of Peary Avenue between Cook Avenue and
a point 75 feet Southeast of Emerald Street; that area
within 100 feet of the centerline of Emerald Street
lying between Peary Avenue and E. Saphire Street; and
that areaiaithin 100 feet of the centerline of the
Street known as E. Saphire Street and its extension
Easterly to and along 49th Street to Wilson Street; and
which area is herinafter known as the "project area;" and
WHEREAS, RCw7 35.43.140 and RCW 35.43 provide for the creation of
local improvement districts and utility local improvement districts
and for a hearing to be Yield to permit objections being taken to
a resolution of the City Council declaring its intention to
order the improvement of the project area by the construction of
a sewer system therein, and by the assessment of property in said
project area to pay for the costs of said improvement, now, therefore,
BE IT RESOLVED:
1. That the City Council of the City of Port Townsend does
here and hereby declare its intention to order the improvement of
that portion of the City hereinabove described as the "project
area" by the construction therein of a sanitary sewer system.
2. That the City Clerk is hereby directed to give notice of
said declaration of intention to all persons who may desire to
object thereto in the manner provided in RCW 35.43.140; a public
hearing to be had for the purpose of hearing said objections at
the Council Chambers in the City Hall at Port Townsend, Washington
at 7:30 P.M. on 667p , 1983; and this resolution
shall be published in each of two consecutive weeks in the Port
Townsend Leader, the first publication to be at least 15 days prior
to said public hearing.
