STREET, AND HASTINGS STI~R~Tr, ALONG WITH THE ALLEY LOCATED WITHIN BLOCK 17 OF THE EISENBEIS ADDITION TO THE-CITY OF PORT TOWNSEND; ESTABLISHING CONDITIONS TO THE STREET VACATION; AND ESTA~BLISHING AN EFFECTIVE DATE. WHEREAS, thc City Council for the City of Port Townsend has considered Street Vacation Application No. 9505-03 (Pon of Port Townsend), and following duc notice has held a public heating upon thc application; and WHEREAS, thc City Council for thc City of Port Townsend adopted its Findings of Fact and Conclusions on July 17, 1995; and WHEREAS, the Port has agreed to maintain pedesLrian access through the property. TI~ Port shall either: a) maintain the existing pedestrian circulation pattern; b) develop it per the Port's adopted Comprehensive Plan; or c) submit an alternative plan for review and approval by the Director of Building and Community Development prior to eliminating the existing Walkways along Washington Street. An east-west pedestrian access connection along the Waterfront shall be maintained at all times; and WHEREAS, the Port has agreed to maintain general traffic Circulation and emergency access to city street standards. The Port shall either: a) maintain the existing transportation circulation pattern; b) develop it according to the Port's adopted Comprehensive Plan; or c) submit an alternative plan for review and approval by the Director of Building and Community Development prior to eliminating the existing roadways (i.e., Washington Street). An east-west connection between developed Haines Street and developed Benedict Street shall be open to the public at all times; and WHEREAS, the applicant has paid to the City one-half of the appraised value of the area to be vacated; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS FOLLOWS: 540 .,833 Page 1 of 3 DFC - 6 1995' Section 1. That the following streets are hereby, vacated to the Port of Port Townsend: 1) 2) 3) 4) 5) 6) 7) 8) all of that portion'of Washington Street not previously vacated and lying westerly of Benedict Street; all of that portion of Water Street lying westerly of that portion of Benedict Street vacated by Ordinance #1621; all of that portion of Front Street lying westerly of that portion of Benedict Street vacated by Ordinance #1621; all of that portion of San Juan Avenue lying southerly of Jefferson Street; all of that portion of Prosper Street lying southerly of that portion of Washington Street vacated by Ordinance//927; all of that portion of Belle Street lying southerly of that portion of Washington Street vacated by Ordinance//927; all of that portion of Hastings Street lying southerly of that portion of Washington Street vacated by Ordinance ~927; and all of the alley in Block 17 of the 1st Supplemental Plat of Eisenbeis Addition to the City of Port Townsend, as per plat recorded in Volume 2 of Plats, page 24, records of Jefferson County, Washington. Section 2. That the street vacation aforementioned is conditioned, however, on the following: After recordation of the ordinance vacating said streets, the applicant shall record utility easements within, over, and across vacated portions of San Juan Avenue and Washington Street for the construction, repair and maintenance of both existing and furore utilities (including water, sewer, and electric). Structures and/or storage within the easements shall be prohibited. A certified copy of the ordinance vacating the street shall be recorded by the City Administrator in the office of the Jefferson County Auditor. The street vacation shall be canceled and become automatically null and void one year after City Council action if said payments and recordation are not made. Section 3. This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferson County Auditor pursuant to Section 2 of this ordinance.
