HomeMy WebLinkAbout2492 Permit, Application and Appeal FeesOrdinance No. AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING CHAPTER 3.36, PERMIT, APPLICATION AND APPEAL FEES OF THE PORT TOWNSEND MUNICIPAL CODE WHEREAS, the City of Port Townsend provides an array of administrative functions benefitting individuals and the public at large; and WHEREAS, the Port Townsend City Council deems it necessary to revise certain fees and charges pursuant to the 1996 Budget in order to better reflect and defray the costs to the taxpayers for administrative services rendered on behalf of individuals, NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as follows: Section 1. Chapter 3.36, Permit, Application and Appeal Fees of the Port Townsend Municipal Code is hereby amended and shall be codified by the City's Code Reviser to read as follows: Chapter 3.36 PERMIT, APPLICATION AND APPEAL FEES Sections: 3.36.010 3.36.015 3.36.018 3.36.020 3.36.030 3.36.040 3.36.050 Fees - General. Fees - Building and land use. Appeal fees. Public works and utility billing service fee schedule. Fees - Sewer connections. Utility and garbage deposits. Fees - Fire department permits and inspections. 3.36.010 Fees - General. A. Application fees for the various applications, permits and utility connections set forth below, shall be as provided in this chapter. No application shall be considered, nor shall any permit or utility connection be allowed, unless and until the fee has been paid to the city treasurer, which fee shall not be refundable unless the application is withdrawn in writing prior to the date of the first hearing scheduled on the application. Any such refund must be approved by the director of planning and building and the clerk-treasurer and any and all costs incurred by the city deducted from fees paid. B__~. Major Projects: Some of the application fees set forth in Section 3.36.015 vary depending upon whether the proposed development project is fora "major" versus a "minor" project. The term "major project" includes the following: planned unit developments, as defined in Chapter 17.40 PTMC, in excess of 5 acres; all long subdivisions, as defined in title 18, PTMC; and all commercial projects in excess of 10.000 square feet. (Ord. § 1, 1995; Ord. 2173 § 1, 1989; Ord. 2050 § 1, 1986). 3.36.015 Fees - Building and land use. Application and service fees for the various building and land use applications, permits and agreements shall be as follows: A. For rezones, the sum of $359.00 500.0Q, plus $50.00 per hour of staff time spent in excess of 10 hours; B. For application for amendment, supplementation or modification to the text of the zoning code, $359.00 500.00, plus $50.00 per hour of staff time spent in excess of 10 hours; C__,. For applications for amendment to the Comprehensive Plan, $500.00, plus $50.00 per hour for staff time spent in excess of 10 hours. t3 D. For variances, the sum of $200.00 for single-family residences, or for an administrative variance, $150.00 for a sign variance; $350.00 for other variances; ~ _E. For street vacations, the sum of $300.00; ~ F. For conditional use permits, the sum of $250.00 when processed administratively; $~50.00 500.00 ~ for all major projects and those to be decided by the city council; plus in either case an additional $50.00 per hour of staff time spent in excess of 10 hours; t:z G. For short subdivision approval, the sum of $350.00; G H. For preliminary approval of a subdivision, condominium, binding site plan or planned unit development approval, the sum of $500.00, plus an additional $30.00 for each lot or dwelling unit proposed, plus an additional $50.00 per hour of staff time spent in excess of 10 hours; for final plat approval, the sum of $159.~a0 300.00, plus filing costs; ]4 I. For building permits, the fees and charges set forth in the Uniform Building Code, as currently adopted by the city, plus an additional $10.00 for each radon test kit to be provided as required by Chapter 19.27 RCW; plus an additional special examiner/special inspector fee pursuant to the Nonresidential Energy Code as set forth in the suggested fee schedule set by the Utility Code Group; ~ J_. For home occupation permits, the sum of $59.~c~0 30.00; ~ K. For sign permits, $25.00, plus an additional $10.00 for each additional sign included in the same permit application; ~4 L. Preparation of legal agreements, $65.00; [ M. For boundary line adjustments, $85.99 150.00, plus $50.00 per hour of staff time spent in excess of five hours; M N. For street vendor licenses, an application fee of $50.00, and an annual license fee of $350.00 payable upon the issuance of the license and on or before January 1st of each succeeding calendar year for which the permit remains valid; N O. For environmentally sensitive area permits, $250.00 plus $50.00 an hour of staff time spent in excess of 10 hours; for m~or projects. $500.00 plus $50.00 per hour of Staff time spent in excess of 10 hours; O P. For environmentally sensitive area peer reviews, the full costs, in advance, of any third party charges which may accrue; ia O. For environmentally sensitive area reasonable use exception applications, $250.00 plus $50.00 an hour of staff time spent in excess of 10 hours; q~ R. For an advance determination under the environmentally sensitive areas ordinance, $250.00; t~ S_. For an environmental checklist threshold determination, the sum of $250.00, plus $50.00 per hour for each additional hour of staff time in excess of six hours, provided that a credit of $150.00 shall be applied if an environmentally sensitive area permit is also required for the proposal; for major projects. $500.00 plus $50,00 per hour of staff time spent in excess of 10 hours with a credit of $150.00 if an environmentally sensitive area permit is also required for the proposal. 8 T. For revision of a permit application or of conditions of prior approval, the sum of $50.00 per hour of staff time, plus other direct costs to process the revision; :12 U__. For mobile home title elimination, $30.00; Id V. For shoreline substantial development permit application, a base fee of $350.00 for a primary use and $500,00 for a ov secondary use or $600.00 for a conditional use, plus $75.00 for notification of each hearing, which sum does not include the amount of deposit for posting boards used. In addition, an hourly fee in the amount of $50.00 shall be charged for staff time in excess of 10 hours; ¥ W. For a shoreline variance application, the sum of $i~t~.99 350,00 for a primary use and $550.00 for a Secondary use, in addition to the amounts set forth in subsection ~¢ X of this section. In addition, an hourly fee in the amount of $50.00 shall be charged for staff time in excess of 10 hours; W X. For a shoreline exemption letter or a residential setback analysis, the sum of $50.00; 3 ~ __Y. For recording documents with the Jefferson County auditor, the amount of the recording fees charged by Jefferson County, plus a service charge of $5.00; ¥ Z. For a temporary certificate of occupancy: $50.00 for each residential dwelling unit; $100.00 for commercial, industrial, and institutional uses. AA. For historic preservation commission design review for major projects, $500.00 plus $50.00 per hour of staff time in excess of 10 hours, (Ord. __ § 1, 1995; Ord. 2431 § 2, 1994; Ord. 2416 § 1, 1994; Ord. 2384 § 1, 1993; Ord. 2376 § 1, 1993; Ord. 2329 § 1, 1992; Ord. 2311 § 1, 1992; Ord. 2296 § 16, 1992; Ord. 2269 § 10, 1991; Ord. 2173 § 3, 1989). 3.36.018 Appeal fees. Fees for appealing any land use and building permit application determination shall be as follows: A. For appeals of sensitive area permit decisions appealable to the city council, $200.00; B. For an appeal of an environmentally sensitive area determination, $25.00; C. For an appeal of an administrative decision of the director of building and community development, pursuant to PTMC 17.64.090 and Chapter 1.14 PTMC, $200.00; D. For an appeal of the director's environmental determination made pursuant to PTMC 19.04.280, $200.00. This appeal fee shall be waived if a valid petition is signed by 200 Port Townsend citizens and is submitted to the department within the designated appeal period. Any such appeal must clearly list the name and address of each signator. E~ For a_o_t~als of any appealable decisions made by the public works director or designee, $200.00. (Ord. § 1, 1995; Ord. 2431 § 3, 1994). 3.36.020 Public works and utility billing service fee schedule. The fees and charges listed in this section for services of the public works department and the finance department for utility billing are established. The fees and charges shall be paid in advance unless an alternate method of payment is specifically approved by the director of public works. The continuance or establishment of water and/or sewer service by the city shall be contingent upon payment of all fees and charges contained in this section. The following schedule of fees and charges shall be used: Fees and Charges Summary Description Charges A. Charge for department of health water system evaluation project review and approval fees (WAC 246-290-120 and 246-290-990) $550.00 for each application, or such other amount as department of health requires pursuant to WAC 246-290-990. The city will make an effort to forward all applications for water system installation, extension, or improvement to department of health in order to minimize charges to each applicant. However, in the event it is not possible to forward more than one application, the applicant will be required to pay this amount in its entirety prior to the city processing any such applications. The fee for connection to the sewage system of the city and the connection charge therefor shall be established under the schedule of fees and charges contained in PTMC 3.36.020. (Ord. 2290 § 2, 1992; Ord. 2050 § 3, 1986). 3.36.040 Utility and garbage deposits. The clerk-treasurer may require reasonable advance deposits for utility and garbage fees and charges where it is reasonable and prudent to do so to assure collection of such fees and charges. Where a utility or garbage customer fails to pay all charges due, the city may collect interest at the maximum legal rate, costs of collection and attorneys fees incurred in collection from the delinquent customer. (Ord. 2310 § 1, 1992; Ord. 2290 § 2, 1992). 3.36.050 Fees - Fire department permits and inspections. Application and service fees for the Various permits and inspections required by. the fire department shall be as follows: A. Small residential burning permit (noncommercial applications for permits for fires not larger than eight feet in circumference and four feet in height), $1.00; B. Commercial burning permit (for all fires larger than eight feet in circumference and four feet in height, $25.00; C. Wood stove (solid fuel) inspection, $25.00; D. One-bedroom and two-bedroom bed and breakfast safety inspection: 1. Initial inspection, $40.00; 2. Annual inspection, $20.00. (Ord. 2340 § 1, 1993). Section 2, Severability. If any clause, sentence, paragraph, section or part of this Ordinance or its application to any person or circumstance is held to be invalid or unconstitutional by a court of competent jurisdiction, such order or judgment shall not affect the validity or constitutionality of the remainder of any part of this Ordinance. To this end, the provisions of each clause, sentence, paragraph, section or part of this law are declared severable. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law.
