HomeMy WebLinkAbout2500 Requiring Certain Street Improvements be Constructed as a Pre-condition to Development Approval Adjacent to Howard Street ORDINANCE NO. o) AN ORDINANCE OF THE CITY OF PORT TOWNSEND REQUIRING THAT CERTAIN STREET IMPROVEMENTS BE CONSTRUCTED AS A PRE-CONDITION TO DEVELOPMENT APPROVAL ADJACENT TO HOWARD STREET. WHEREAS, Howard Street, between 20th Street and Hastings Avenue, does not currently meet the street standards of the City of Port Townsend; and WHEREAS, new development adjacent to Howard Street between 20th Street and Hastings Avenue will add more vehicular and pedestrian traffic impacts to the area and will not have adequate road access without improvements to Howard Street; and WHEREAS, properties adjacent to Howard Street would receive a benefit if Howard Street was improved; and WHEREAS, the City Council finds that the owners of properties adjacent to Howard Street should bear the costs of the improvements to Howard Street. THE PORT TOWNSEND CITY COUNCIL ORDAINS AS FOLLOWS: Section 1. The construction of improvements to Howard Street between 20th Street and Hastings Avenue, through the methods set forth herein, is hereby required prior to the approval or issuance of a permit for any Development adjacent to Howard Street. Section 2. Definitions. (a) "Development" means all subdivision, short subdivision, industrial or commercial building permits, conditional or special use permits, or building permits (including building permits for single-family, multi-family and duplex residential structures, and all similar uses) and other similar projects which are located adjacent to Howard Street between 20th Street and Hastings Avenue, and which will have a direct traffic impact on Howard Street. Development does not include interior remodeling, changes in occupancy, or minor alterations that do not increase the traffic generation from the site. (b) "Developer" means the person applying for or receiving a permit or approval for a development as defined in this ordinance. (c) "Improvement" means any measure necessary to bring Howard Street up to the City of Port Townsend Street Standards, including, but not limited to, dedication of property, design, grading, paving, installation of curbs, gutters, storm drainage, sidewalks, street lighting, traffic controls and other similar improvements as required by the street standards of the City of Port Townsend. This Ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law. Read for the first, second and third times and passed by the City Council of the City of Port Townsend, Washington, at a regular meeting thereof, held 1995. //~John M.
