RESOLUTION NO. 04-058
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND,
WASHINGTON, DECLARING SANTIAM EMERGENCY EQUIPMENT, INc. AS THE
SOLE SUPPLIER OF SECURITEX FIREFIGHTING PROTECTIVE CLOTHING
WHEREAS, the City was awarded a Federal Assistance to Firefighter Grant in the sum
of $278,000, a portion of which was designated for structural firefighters protective clothing also
referred to as Turnout Gear; and
WHEREAS, a committee of Fire Department personnel determined that the Securitex
Brand of clothing most closely met its specifications and provided the latest technology in
manufacturing the protective suits; and
WHEREAS, Santiam Emergency Equipment, Inc. is the sole source provider for the
specified clothing manufactured by Securitex Bunker Gear (Firefighting) and STX Apparel
(EMS); and
WHEREAS, State law and the City's own purchasing ordinance require purchases of
materials and supplies over $15,000 a year to be competitively bid, unless an exemption to
competitive bidding applies; and
WHEREAS, RCW 39.04.280 allows competitive bidding to be waived in certain
circumstances, including, where purchases are clearly and legitimately limited to a single source
of supply. RCW 39.04.280 is applicable to code cites under 20,000 population like Port
Townsend by RCW 35.23.352(9); and
WHEREAS, a competitive bidding process would only produce one bid; and
WHEREAS, PTMC 3.46.090 (A) requires a resolution by Council declaring an
exemption from bidding under the sole source provision for contracts over $30,000.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port
Townsend to declare Santiam Emergency Equipment, Inc. the sole source for personal protective
equipment produced under the brand names of Securitex (bunker gear) FireGear (bunker gear)
and STX Apparel (EMS gear) to allow the ordering of much needed protective clothing.
ADOPTED by the City Council of the City of Port Townsend at a regular meeting
thereof, held this fifteenth day of November 2004. (' . ~ / .
