HomeMy WebLinkAbout04-049 RESOLUTION NO. 04-049 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON, APPROVING CITY CONTRIBUTION OF ONE-HALF THE COSTS TO PAVE 10TH STREET (BETWEEN SHERIDAN AND GRANT) AND GRANT STREET (BETWEEN 9TH AND 10TH STREETS) WHEREAS, James P. McCarron was issued a foundation pennit for an office project ("project") at 10th and Sheridan under pennit number 04-112-R-l on June 14,2004, with a proposed entrance off 9th Street; and WHEREAS, in the course of City review of the project, City staff saw public benefit to locating the entrance off 10th Street. Tenth Street is currently poorly paved with asphalt. Relocating the entrance to 10th Street would cause 10th Street to be re-paved; and WHEREAS, the developer, who could choose to leave the entrance on 9th Street, was agreeable to relocating the entrance to the project to 10th Street, and undertaking additional improvements (re-paving 10th Street between Sheridan and Grant, and paving Grant and putting a sidewalk on Grant between 9th and 10th Streets), so long as the City would contribute a fair share ofthe additional improvements; and WHEREAS, City staff and the developer tentatively agreed (subject to Council approval) to a City contribution of one-half the cost to pave, adjacent to the project, 10th and Grant Streets and to install a sidewalk on Grant Street, but not to exceed a total City contribution of $15,000. The City contribution would be in the fonn of paying for materials only (not to exceed one-half the total cost, or $15,000 total); and WHEREAS, state law (RCW 35.21.275) provides that a city may, on approval ofthe city council, contribute materials or the cost of materials to a private project without turning the project into a "public work"; and WHEREAS, for a City contribution of one-half the total cost (not to exceed $15,000) to pave lOth and Grant Streets and install a sidewalk on Grant Street adjacent to the project, this work, which would not be done as part of the project, gets done and provides valuable public benefits, and in addition, the developer installs other developer-required improvements - additional paving on 9th Street and curb, gutter, sidewalk on 10th Street, and curb and gutter on Grant Street, NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Port Townsend as follows: In connection with the office project at 10th Street and Sheridan, the City Manager and Public Works Department are authorized to participate with the developer of the project, and commit the City to pay up to one-half the cost, to pave 10th and Grant Streets and install a 1 Resolution 04-049 sidewalk on Grant Street adjacent to the project, but not to exceed a total City contribution of $15,000. The City contribution would be in the fonn of paying for materials only (not to exceed halfthe total cost, or $15,000 total).
