HomeMy WebLinkAbout04-048 RESOLUTION NO. 04-048 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND, WASHINGTON, SUPPORTING CITY CONTRIBUTION TO ALDRICH SIDEWALK RECONSTRUCTION WHEREAS, the owners of Aldrich's is in the process re-constructing Aldrich's Market following a fire which demolished Aldrich's Market on August 4, 2004; and WHEREAS, while the reconstruction of Aldrich's Market could possibly make use of the existing sidewalks without re-doing the sidewalks, the City Manager, in consultation with the City Public Works Department, recommends that the sidewalks should be improved. Improvements would provide better handicapped access, and lessen grade differences between sidewalk grades and street grades, thereby providing significant public benefits. WHEREAS, City Code (PTMC 12.12.220) provides for City 50-50 cost sharing in sidewalk improvement projects proposed by the abutting owner, "where funds are available." (Alternatively, the code provides that in lieu of 50-50 cost-sharing, the City can demolish and remove the existing sidewalk. Demolition and removal here by the City is not recommended because of the substantial nature of the sidewalk and the fact it is poured over the foundation, and removal could cause foundation damage and potential liability to the City.) NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Port Townsend as follows: The City Council hereby authorizes the City Manager to commit the City to funding the sidewalk demolition and reconstruction abutting Aldrich's on a 50-50 cost sharing basis, not to exceed $15,000 City contribution. The City Manager may determine to contribute the cost of materials only.
