HomeMy WebLinkAbout2874 Artwork Loaned to the City Ordinance No. 2874 AN ORDINANCE OF THE CITY OF PORT TOWNSEND REVISING THE PORT TOWNSEND MUNICIPAL CODE CHAPTER 3.50, PUBLIC ARTS PROGRAM - 1% FOR ARTS, SECTION 3.50.060, PUBLIC ARTS PROJECTS - CITY COUNCIL APPROVAL WHEREAS, the City Council adopted Ordinance 2866 (passed 7-0, August 9,2004), providing for, among other things, that public art displays would be "solely owned" by the City, and that the "City Council has final authority to relocate, remove, or destroy" public artwork (PTMC 3.50.060, Ordinance 2866), and WHEREAS, the City Council determines it appropriate to add to Section 3.50.060 a provision that allows for placement of loaned artwork to the City NOW, THEREFORE, the City Council of the City of Port Townsend ordains as fol1ows: SECTION 1. Amendment. Section 3.50.060 of the Port Townsend Municipal Code (adopted by Ordinance 2866) is hereby amended to read as follows (strike is deleted, underline is new) 3.50.060 Public arts projects - City Council approval. The City Council specifically reserves to itself final decision-making authority regarding the funding, purchase, erection, siting and installation of works of public art; provided, nothing prevents the City Manager authorizing temporary (not to exceed one year) placement of works of public art. The City Council indicates its intention to use a selection process and public process which incorporates members of the City's Arts Commission, and which provides opportunity to citizens to comment on any aspect of funding, purchase, erection, siting and installation of works of public art. For public art proposed for installation in an area subject to design review, the City Council will process the installation through the City's design review processes. Once installed, art work is solely owned and maintained by the City. City Council has final authority to relocate, remove, or destroy artwork, following recommendation from the Arts Commission. Loaned art may be accepted by the City Manager for a period not to exceed one year, and by the City Council for a period not to exceed two years. SECTION 2. Severability. If any provision ofthis ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected.
