HomeMy WebLinkAbout2563 Non-Charter Code CityOrdinance No. FILED JAN 1 $ 1997 ~TATE OF WASHINGTON AN ORDINANCE OF THE CITY OF PORT TOWNSEND ADOPTING THE CLASSIFICATION OF NONCHARTER CODE CITY PURSUANT TO THE OPTIONAL MUNICIPAL CODE OF THE STATE OF WASHINGTON, CHAPTER 35A.02 RCW WHEREAS, after due notice in accordance with state law, on September 3, 1996, the Port Townsend City Council held a public hearing to-consider public comments regarding the reclassification of Port Townsend from a second-class city to a code city; and WI-IEREAS~ by ResolutiOn No. 119 passed September 3, 1996, the City Council entered findings, which are incorporated herein by this reference, and declared its intention to adopt for the City of Port Townsend, the classification of noncharter code city, retaining the Mayor-Council plan of government under which it is now operating; and WHEREAS, said resolution was duly published in The Port Townsend Jefferson County · LEADER, a newspaper of general circulation within the city of Port Townsend on September 11, 1996; and WHEREAS, a period not lesS than 90 days from the date of said resolution's publication, excluding the date of the first publication, has elapsed and no timely and/or sufficient referendum petition has been filed, pursuant to RCW 35A.02.035; and WHEREAS, the City Council now desires to implement the intent expressed in ResolutiOn No. 119 by enacting an ordinance adopting the classification of noncharter code city in the manner hereinafter provided, NOW, THEREFORE, the City Council of the City of Port Townsend does ordain as follows: Section 1. There is hereby adopted for the City of Port Townsend, Washington, the classification of noncharter code city, retaining the same general Mayor-Council plan of government under which the City of Port Townsend is currently operating, but governed according to Chapter 35A. 12 RCW. The reclassification to Code City status does not constitute a reorganization of the City's plan of government, as defined in RCW 35A.01.070. Section 2. Pursuant to RCW 35A.02.040, the City Clerk is hereby authorized and directed to file a certified copy of this Ordinance with the State of Washington secretary of state. ~. Severability. If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law. Read for the first, second, and third times and passed by the City Council of the City of Port Townsend,.
