HomeMy WebLinkAbout2570 Vacating a Portion of Hill Avenue in Block 188 of Eisenbeis Addition - Jonathan DudleyAfior R~ording Return to: City of Port Town.nd Building & Community Development Department 540 Water Str~ot Port Townsend, WA 98368 399;831 ORDINANCE NO. ~ ~ 7 ~ AN ORDINANCE VACATING THAT PORTION OF HILL AVENUE FROM SIMS WAY TO 10TH STREET LOCATED EASTERLy OF LgTs 1'7 OF BLOCK 188 IN THE EISENBEIS ADDITION TO THE CITY OF PORTTOWNSEND; ESTABLISHING CONDITIONS TO THE STREET/V/ACATION; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council for the City of Port Townsend has considered Street Vacation Application No. 9405-07 (Jonathan G. Dudley), and following due notice has held a public hearing upon the application; and WHEREAS, the City Council for the City of Port Townsend adopted its Findings of Fact and Conclusions'on December 5, 1994; and WHEREAS, the project proponent has granted a utility easement for the existing overhead feeder line in coordination with Puget Power (Auditor's file No. 397691); and WHEREAS, the applicant has paid to the City one-half of the appraised value of the area to be vacated; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT TOWNSEND DOES ORDAIN AS FOLLOWS: Section 1. That the following street is hereby vacated to Jonathan G. Dudley: the western half of Hill Avenue, as measured from the centerline, from Sims Way to 10th Street located easterly of Lots 1-7 of Block 188 in the Eisenbeis Addition to the City of Port Townsend. _ The eastern half shall be incorporated into the City Triangle park gl. That the street vacation aforementioned is conditioned, however, on the following: Aw A certified copy of the ordinance vacating the street shall be recorded by the City with the office of the Jefferson County Auditor. Be Upon recordation of the street vacation, the applicant shall install landscaping improvements and associated amenities on the eastern half of the vacated street at no cost to the City in accordance with the City's December 5, 1994, decision. These improvements shall be to the satisfaction of the Director of Building & Community Development. The City retains, and Jonathan G. Dudley shall convey a 12% foot wide easement for utility purposes for installation and maintenance of water, stormwater and sewer utilities west of the center line of the property described as follows: Hill Avenue from Si~s_~ay to 10th S_txeet lx~..ate~ easterly o(Lo~s i-7 of Block 188 in the Eisenbeis Addition to the City of Port Townsend. Section 3. This ordinance shall take effect upon its passage, approval and publication in the form and manner provided by law, and after it has been recorded with the Jefferson County Auditor pursuant to Section 2 of this ordinance.
