HomeMy WebLinkAbout2865 Dogs - Objectional Waste Removal Ordinance No. 2865 AN ORDINANCE OF THE CITY OF PORT TOWNSEND AMENDING THE PORT TOWNSEND MUNICIPAL CODE CHAPTER 8.08, DOGS- OBJECTIONABLE WASTE REMOVAL, SECTION 8.08.010, OWNER RESPONSIBILITY, AND SECTION 8.08.020, REMOVAL OF FECES REQUIRED, TO REQUIRE REMOVAL OF DOG FECES ON PUBLIC PROPERTY OR PRIV ATE PROPERTY NOT OWNED BY THE DOG OWNER WHEREAS, the City Council determines that it is appropriate to amend existing requirements that mandate owners or persons in charge of dogs to remove dog feces from parks to a requirement that owners or persons in charge remove dog feces from any public property, or from any private property not owned or leased by the owner or person in charge ofthe dog, based on concerns that waste left on streets and sidewalks and other public areas or on other person's property is objectionable, that un-removed feces potentially cause disease, and that un-removed feces contributes to pollution of surface water runoff. NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows: SECTION 1. Amendment. Chapter 8.08, Dogs - Objectionable Waste Removal, Section 8.08.010, Owner responsibility - Areas designated, and Section 8.08.020, Removal of feces required, of the Port Townsend Municipal Code is hereby amended to read as follows (underline is new; strike is deleted): Chapter 8.08 DOGS - OBJECTIONABLE WASTE REMOVAL Sections: 8.08.010 8.08.020 8.08.()J() 020 8.08.04() 030 8.08.()s() 040 Owner responsibility to remove feces Arcas designated. Rcmoval of feces required. Disposal requirements. Violation - Penalty. Exemptions from provisions. 8.08.010 Owner responsibility to remove feces - Arcas designated. Every person who owns or who has under his or her control or care any doKshall be responsible for picking up and removing immediately any feces left by any such animal upon any public place in the City or upon any private property in the City not owned or leased by him or her. Page 1 Ordinance 2865 No person owning or in charge of any dog shall cause or allow such dog to soil, defile or defecate on any property within Kah Tai Park, Chetzemoka Park, John Pope Park, including Seavey Memorial Sculpture project, or Cherry Street Park, within the city. 8.08.020 Removal of feces required. Any person owning or in charge of any dog which soils, defiles or defecates in any park shall immediately remove all feces deposited by any such dog, in a sanitary manner. 8.08.()J() 020 Disposal requirements. The feces removed from the aforementioned designated areas shall be disposed of by the person owning or in charge of any such dog in a sealed, nonabsorbent, leak proof container. 8.08.04() 030 Violation - Penalty. Any violation of the provisions of this chapter shall be a civil infraction, and any person found in violation thereof shall be subject to a penalty not to exceed $100.00. 8.08.()s() 040 Exemptions from provisions. The provisions of this chapter shall not apply to blind persons who may use dogs as guides. SECTION 2. Violation. Violation of this Ordinance shall be as prescribed in PTMC 8.08.040, and 8.04.390 - .440, as now or hereafter amended. SECTION 3. Severability. If any provision ofthis ordinance or its application to any person or circumstance is held invalid, the remainder of the ordinance, or the application of the provision to other persons or circumstances is not affected. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law.
