HomeMy WebLinkAbout2862 Adoption of Historic Preservation Committee Design Guidelines on an Interim Basis Ordinance No. 2862 AN ORDINANCE OF THE CITY OF PORT TOWNSEND PROVIDING FOR THE ADOPTION OF mSTORIC PRESERVATION COMMITTEE DESIGN GUIDELINES ON AN INTERIM BASIS WHEREAS, the City's Historic Preservation Committee (HPC) has formulated design guidelines ("guidelines) relating to the following: . Draft Revised Design Review Guidelines - Overall; . Design Guidelines for Signs in the Special Overlay Design Review District and National Landmark Historic District; . Port Townsend's National Landmark Historic District Approved Color Palette; . Design Guidelines for Awnings in the Special Overlay Design Review District and National Landmark Historic District; . Design Guidelines for Murals in the Special Overlay Design Review District and National Landmark Historic District; . Design Guidelines for Exterior Mechanical System Elements in the Special Overlay Design Review District and National Landmark Historic District; . Design Guidelines for Neon Signage in the Special Overlay Design Review District and National Landmark Historic District. WHEREAS, the HPC has utilized the guidelines for a number of years in reviewing applications, for purposes of providing consistent treatment to applicants; and WHEREAS, the guidelines provide for City Building and Community Development (BCD) staff to take certain actions on routine design items (for example, vents) without HPC, as otherwise provided by the code, thereby saving applicants, staff and HPC time and expenses; and WHEREAS, the guidelines have not been adopted by the City Council; and WHEREAS, the City Council finds that adoption of the guidelines on an interim basis, pending further review of the guidelines, is a useful and necessary matter in the administration of the City and HPC design review process, because they provide a consistent treatment to applicants on the matters in the guidelines, and further same applicants, staff and HPC time and expense on routine matters; and WHEREAS, adoption of the guidelines would preserve the status quo with respect to how applications relating to matters covered by the guidelines have been handled for a number of years; and Page 1 Ordinance 2862 WHEREAS, RCW 35A.63.220 (applicable to code cities such as Port Townsend), and RCW 36.70A.390 (a part of the Growth Management Act), authorize cities to enact interim regulations to preserve the status quo while new plans for regulations are considered and prepared. NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows: SECTION 1. The City Council hereby adopts by reference the HPC design guidelines set forth below, which are contained in a notebook entitled "HPC Design Guidelines" (a copy of which is on file and available to the public for viewing and examination at the office of the City Clerk), and makes them applicable in reviewing development improvements subject to the City's Historic Preservation Code (Chapter 17.30, Port Townsend Municipal Code): . Draft Revised Design Review Guidelines - Overall; Design Guidelines for Signs in the Special Overlay Design Review District and National Landmark Historic District; Port Townsend's National Landmark Historic District Approved Color Palette; Design Guidelines for Awnings in the Special Overlay Design Review District and National Landmark Historic District; Design Guidelines for Murals in the Special Overlay Design Review District and National Landmark Historic District; Design Guidelines for Exterior Mechanical System Elements in the Special Overlay Design Review District and National Landmark Historic District; Design Guidelines for Neon Signage in the Special Overlay Design Review District and National Landmark Historic District. . . . . . . SECTION 2. Public Hearings on Ordinance. Pursuant to RCW 36.70A.390, the City shall hold a public hearing on this ordinance within sixty (60) days. At or immediately after the public hearing, the City Council shall adopt findings of fact on the subject of these interim regulations either justifying their continued effect, or cancel the regulations, or take other appropriate action. SECTION 3. Severability. If any sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase or work of this ordinance. Page 2 Ordinance 2862 SECTION 4. Effective Date. This Ordinance shall take effect five days after passage. Publication of this ordinance shall be by a summary thereof consisting of the title.
