HomeMy WebLinkAbout2580 Public Works FeesOrdinance No. ~~ AN ORDINANCE OF THE CITY OF PORT TOWNSEND REPEALING AND REPLACING SECTION 020, PUBLIC WORKS SERVICE FEE SCHEDULE OF CHAPTER 3.36, PERMIT, APPLICATION AND APPEAL FEES OF THE PORT TOWNSEND MUNICIPAL CODE, ESTABLISHING NEW FEES FOR PUBLIC WORKS (1) INSPECTIONS; (2) ENGINEERING; (3) TECHNICAL CONFERENCE REVIEW; (4) A MINOR ACTIVITIES PERMIT; AND (5) REVISING UTILITY AND INSTALLATION CHARGES; AND REPEALING SECTION 3.36.015 IN ITS ENTIRETY, AND AMENDING 3.36.018 TO REMOVE BCD FEES FROM CHAPTER 3.36 1. WHEREAS, the City has adopted an updated and revised water, sewer, and stormwater ordinance; and 2. WttEREAS, connection fees and development charges are necessary in managing the City's public utility services; and 3. WHEREAS, the City Council desires to set an inspection fee for inspecting utility improvements at a level to help offset the City's administrative costs; and 4. WHEREAS, the City Council desires to make the Public Works preapplication fee more accurately reflect the costs of increased review by the city and service to the developer because of the hiring of a development review engineer, and to therefore limit the ability to credit the preapplication fee to the street development permit fee; and 5. WHEREAS, the City Council desires to adjust the water meter drop-in fees to more accurately reflect administrative cost to the public of providing public utility services; and 6. WHEREAS, the City Council desires to set a modest fee for waiver of the engineering design standard requirements of the Public Works' Engineering Design Standards manual, and Titles 12 and 13 PTMC; and 7. WHEREAS, the City Council desires to set a reduced fee for a street and utility development permit - minor activities, to reflect the lower administrative cost of reviewing and processing permits for minor activities on existing streets; and 8. WHEREAS, the City Council desires to specify a fee for water quality tests not specifically listed in 3.36.030; and 9. WHEREAS, the City Council desires to set a fee for city-engineered utility and street design drawings at a significantly reduced level in Tier 1 (defined as areas served by existing infrastructure) in order to reflect the City absorbing a share of engineering design costs in Tier I based on the policy directive in the Comprehensive Plan to promote "infill" development and to develop an infrastructure tiering strategy, and in doing so incorporates by reference all the Comprehensive Plan Policies related to the City's tiering strategy and all the findings related to tiering in the following newly adopted ordinances: Transportation and Rights-of-way ordinance (Title 12); Water, Sewer and Stormwater ordinance (Title 13); City Zoning code (Title 17); and City Land Division ordinance (Title 18); and 10. WHEREAS, Chapter 3.36.015 is repealed in its entirety in that PTMC Chapter 20.09 sets forth all applicable BCD fees; and 11. WHEREAS, fees for appeals from administrative decisions of the BCD director is deleted from Section 3.36.018, in that such appeal fees are covered by PTMC Chapter 20.09, 12. WHEREAS the City council desires to delete the penalty provisions in 3.36.020 since they are now covered by the Enforcement code, Chapter 20.10 PTMC, NOW, THEREFORE, the City Council of the City of Port Townsend ordains as follows: SECTION 1. Section 3.36.020, Public works and utility billing service fee schedule, is hereby repealed and recodified to read as follows: 2 Ord. 3.36.020 Public works and utility billing service fee schedule. The fees and charges listed in this section for services of the public works department and the finance department for utility billing are established. The fees and charges shall be paid in advance unless an alternate method of payment is specifically approved by the director of public works. The continuance or establishment of water and/or sewer service by the city shall be contingent upon payment of all fees and charges contained in this section. The following schedule of fees and charges shall be used: Table 3.36.020 Fees and Charges Summary Description Charges 1. Public works technical conference fee $180.00' 2. Street and utility development permit application fee $180.00' *If more than four and one-half hours of total review and process time is required, an additional hourly charge based on the rates set forth in this chapter shall be made. In the case of Type I projects in Tier 1, the technical conference fee of $180.00 shall be credited against the street and utility development permit application fee when an application for the same proposal is filed within 12 months of the date of the written review. No amount beyond the $180.00 will be credited. 3. Street and utility development permit - minor activities $35.00 4. However, in the event it is not possible to forward more than one application, the applicant will be required to pay this amount in its entirety prior to the city processing any such applications. 29. Charge for department of transportation approval $500.00 for each applicant pursuant to RCW 47.32 and WAC 468-34 or such other amount as required by department of transportation 30. SECTION 2. Severability. If any clause, sentence, paragraph, section or part of this Ordinance or its application to any person or circumstance is held to be invalid or unconstitutional by a court of competent jurisdiction, such order or judgment shall not affect the validity or constitutionality of the remainder of any part of this Ordinance. To this end, the provisions of each clause, sentence, paragraph, section or part of this law are declared severable. This ordinance shall take effect and be in force five days after the date of its publication in the manner provided by law. 8 Ord.
